Members present were Mayor Bill Gillespie, Councilman Richard Cables, Chairman Tim Smith, Vice-Chairman Reuben Gardner, Mr. Mark Hindman, Mr. Roy McAuley, and Mr. Bobby Nelson. Absent: Chief Dallis Johnson and Mrs. Paula Carpenter. (Quorum present) Staff present: Mr. Joel Duke, City Planner and Ms. Alisa Morgan, Secretary. Minutes: Mr. Hindman moved to approve the minutes of the March 16, 2017 meeting. Mr. Gardner seconded the motion. The motion passed unanimously. Old Business: There was no old business for discussion. New Business: 1. Re-Plat: Interstate Park Plat 2-A Location: 114 & 132 Medical Center Drive Owner: Dr. David Bicard Representative: Larry Speaks & Associates, Inc. Mr. Duke presented the re-plat for Interstate Park Plat 2-A. He stated that the owner is requesting to move the lot line to convert two lots into 1 to be developed for office building on the commercial zoned property. After no further discussion, the vote was called. Mr. McAuley moved to approve the re-plat of Interstate Park Plat 2-A as submitted. Mr. Gardner seconded the motion. The motion to approve passed unanimously. 2. Preliminary Plat: Nelson-Howard Plat 1 Location: 319, 321, 323 Chestnut Street Owner: John Howard & Evelyn Nelson Representative: Alabama Land Surveyors, Inc. James Monk of Alabama Land Surveyors, Inc., petitioner’s representative, presented the request for preliminary plat approval for Nelson-Howard Plat 1. He stated that the property currently contains three single family residential structures and the petitioner wants to separate into three individual parcels. Chairman Smith opened the public hearing. Bobby Hadnott, 456 Booth Street, stated that after hearing the proposed request from the representative, he had a misunderstanding of the proposed use of the property. Mr. Duke provided comments on the preliminary plat request recommending staff approval. After no further comments, the vote was called. The motion to approve passed unanimously. 3. Final Plat: Nelson-Howard Plat 1 Location: 319, 321, 323 Chestnut Street Owner: John Howard & Evelyn Nelson Representative: Alabama Land Surveyors, Inc. Councilman Cables introduced a resolution recommending approval of the final plat of Nelson- Howard Plat 1 and moved for its approval. Mr. Nelson seconded the motion. After no further comments, the vote was called. The motion to approve passed unanimously. 4. Sketch Plan: Doyle Subdivision Location: Upper Kingston & Moses Roads Owner: Randall & Martha Doyle Representative: Jeffcoat Engineers & Surveyors, Inc. Mr. McAuley introduced a resolution recommending approval of the sketch plan of Doyle Subdivision and moved for its approval. Mr. Nelson seconded the motion. Guthrie Jeffcoat of Jeffcoat Engineers & Surveyors, Inc., petitioner’s representative, introduced the sketch plan of Doyle Subdivision. He stated that the property is located near the recently approved Dawson’s Mill Subdivision. The proposed 55-lot subdivision is outside the city’s limits; there are plans to be annexed into the city. Randall Doyle, owner, stated that the 15 acre development depends on the development of Dawson’s Mill Subdivision. He stated that there are minor changes to the submitted sketch plan as presented in 2010. He stated that it will tie into the stub out of Dawson’s Mill Subdivision. Mr. Duke provided the staff report of Doyle Subdivision. He stated that the 57 lots proposes access to two lots (A & B) via two existing driveways connections to Upper Kingston Road. Access to the remaining 55 lots is provided via an extension of streets to be constructed with the Dawson’s Mill Subdivision (sketch plan approved on March 16, 2017). No additional street intersections with Upper Kingston Road, Moses Road, or Martin Luther King, Jr. Drive are proposed by the sketch plan for the Doyle Subdivision. He stated that lots A and B contain existing single-family residential structures. He stated that approval is recommended of the two lots created to accommodate the existing residential structures (Lots A and B). Since the lots are not integrated into the proposed street network, they should not be considered for division into additional lots at a later date. These limits may be achieved through deed restrictions or a low density zoning classification. He also recommended approval of the overall sketch plan contingent on plans for sanitary sewer access, storm water management, zoning being provided at a later date. After no further comments, the vote was called. The motion to approve passed unanimously. Miscellaneous Business: Mr. Duke extended an invitation to attend a Storm Water Forum on May 11-12, 2017 to the commissioners. REVISIONS DATE CITY OF PRATTVILLE Planning Commission Planning Department Staff Report SKETCH PLAN Doyle Property – Moses Road/Upper Kingston Road/Martin Luther King, Jr. Drive DATE April 18, 2017 PROPOSED DEVLOPMENT Petitioner: Randall and Martha Doyle Property Owner: Randall and Martha Doyle Agent: Jeffcoat Engineers and Surveyors, LLC Location: Moses Road – south side – east side of Upper Kingston Road - adjacent to Smith property recently considered as Dawson’s Mill subdivision. (see attached location map) Development Status and History Submission Status: Second sketch plan for site. Previous Approvals: Property first presented to the Planning Commission in May 2010 as a part of the sketch plan for the Dawson’s Mill Subdivision. The proposed Doyle Subdivision and the Dawson’s Mill property were initially part of the nearly 40 acre parcel owned by Kevin Smith. The 2010 sketch plan of the total Smith property showed the Doyle Subdivision being developed as 41 lots on 16.7 acres. The 41 lots met the minimum standards for R-3 lots. Kevin Smith later sold the western 15.75 acres to Randall and Martha Doyle. Conditions of Previous Approvals: 1. September 17, 2009 sketch plan was modified to create a loop street pattern rather than dead-end cul-de-sacs. Annexation was required to permit connection to sanitary sewer. 2. May 20, 2010 sketch plan for the overall Smith property limited access to an intersection with Martin Luther King, Jr. Drive a stub street on south property line connecting to the Powell property. Required to obtain a Page 2 of 6 permanent emergency access to Moses Road. Access may be closed when Powell property is developed and secondary access to subdivision provided. Property Configuration Acreage: 15.75 acres Proposed Number of Lots and Configuration: 57 lots located in a new subdivision. The plan proposes access to two lots (A & B) via two existing driveways connections to Upper Kingston Road. Access to the remaining 55 lots is provided via an extension of streets to be constructed with the Dawson’s Mill Subdivision (sketch plan approved on March 16, 2017). No additional street intersections with Upper Kingston Road, Moses Road, or Martin Luther King, Jr. Drive are proposed by the sketch plan for the Doyle Subdivision. The 55 lots have an average dimension of 60’ x 125’ or 7,500 square feet. They are configured around two new 50’ right-of-way streets presented as extensions of the street network to be constructed in the Dawson’s Mill Subdivision. Lots A and B contain existing single-family residential structures. Proposed Use: Single-family residential Current Zoning: Currently located adjacent to, but outside, the city limits. Ineligible for classification and regulation under the city’s zoning ordinance. Required Zoning With the exception of the Lots A and B, the area of each proposed lots is insufficient to meet the Alabama Department of Public Health’s minimum standards of 15,000 square feet for the use of private septic systems. Development of the 55 lots will require connection to city’s sanitary sewer system by annexation or approval by the City Council. Page 3 of 6 If annexed, the proposed lots would be eligible for designation as R-3 or R-5. Designation as R-3 district is the lowest density classification necessary to accommodate the dimensions of the smallest lots offered in the sketch plan. The differences between the two districts are presented below. Allowed and conditional uses in R-5 are the same as in R-3 with the exception of multi-family, which is allowed in R-3 as a use-on-appeal to the Board of Zoning Adjustment. The proposed subdivision layout and R-3 or R-5 zoning are consistent with the adopted plan. Surrounding Developments and Uses: North of the proposed development are ten single-family residential structures fronting Moses Road on the north and south side of the street. These lots have areas of between .15 and .20 acres. These structures date from the early 1980’s or earlier. Further north of Moses Road and fronting Upper Kingston Road is the Gallagher Property Page 4 of 6 currently being divided into eight single-family residential lots. The Gallagher Property does not have direct access to Upper Kingston Road and shares a single common access on Moses Road. These properties are located outside the city limits. West of the proposed development is the Kingston Oaks subdivision completed in 2004. Kingston Oaks contains single family residential structures on approximately .25 acre lots zoned R-2. South and east of the proposed development is proposed Dawson’s Mill subdivision. The sketch plan for the development was approved by the Planning Commission on March 16, 2017. The property is located in the city limits and currently zoned R-3. A proposal to create a PUD zoning district will be considered by the City Council on May 2, 2017. Street Extensions or New Streets: The proposed sketch plan contains two new streets extending from the street network to be constructed with the Dawson’s Mill Subdivision. Water and Sewer: Potable water service is available from the Prattville Water Works Board from mains on Moses Road and Martin Luther King Drive. Sufficient capacity and flow exist to serve the proposed 55 lots. Lots A and B are currently served by the water board. An 8” sanitary sewer main owned by the City of Prattville is located within the Moses Road right-of-way and in the adjacent Kingston Oaks subdivision. Sufficient capacity exists to serve the proposed 57 lots. The sketch plan does not indicate how the development will access the system. Annexation into the city limits or City Council approval is necessary before the subdivision may be connected to sanitary sewer. Unique Features: With exception of Lots A and B, development of the subdivision is contingent on the construction of roads in the Dawson’s Mill subdivision. Page 5 of 6 PLANNING STAFF EVALUATION Reviewed by: Joel T. Duke, AICP Site Visits Conducted: November 14, 2016 and April 18, 2017 Recommendation: 1. Zoning: a. If annexed, the property should be zoned R-3. The proposed development may be considered for inclusion in the Dawson’s Mill PUD. b. Lots A and B should be excluded from the overall zoning scheme. The lots should be deed restricted from further division or, if annexed, zoned FAR. 2. Sketch Plan: a. Recommend approval of the two lots created to accommodate the existing residential structures (Lots A and B). Since the lots are not integrated into the proposed street network, they should not be considered for division into additional lots at a later date. These limits may be achieved through deed restrictions or a low density zoning classification. b. Recommend approval of the overall sketch plan contingent on plans for sanitary sewer access, storm water management, zoning being provided at a later date.  Except for minor deviations in the number of lots and their dimensions and the street network, the proposed sketch plan matches the sketch plan for the overall Smith property approved by the Commission on May 20, 2010. The street alignment and lot layout are consistent with the Commission’s concept for the area around Moses Road. The plan continues the street network and limited access points defined in the Dawson’s Mill sketch plan approved on March 16, 2017. The sketch plan does not fully address utility service or storm water management. Sanitary sewer lines constructed for the Dawson’s Mill subdivision will be extended to permit access by the Doyle Subdivision. Page 6 of 6  The proposed sketch plan offers lots meeting the minimum standards for classification as R-3. If annexed, the property should be zoned R-3. If the developer request a zoning classification with a high density than R-3, the Commission may consider including the development in the Dawson’s Mill PUD. If the property remains outside the city limits and permitted to connect to city sewer, the minimum lot size should be set and regulated by covenant restrictions.  By design, the property presented as Lots A and B has been removed from the proposed street network and limited access scheme. Currently occupied by two single-family residential structures, Lots A and B are not expected to impact traffic congestion. However, subdivision of the lots would have some impact on Upper Kingston Road traffic congestion.
