District 3 Miscellaneous: Adjourn: CITY OF PRATTVILLE PLANNING COMMISSION MINUTES November 17, 2016 Call to order: Chairman Tim Smith called the meeting to order at 3:03 p.m. Roll Call: The secretary called the roll.Members present were newly appointed Councilman Richard Cables, Chairman Tim Smith,Vice-Chairman Reuben Gardner,Chief Dallis Johnson,Mrs. Paula Carpenter, Mr. Mark Hindman,Mr.Roy McAuley and Mr. Bobby Nelson.Absent:Mayor Bill Gillespie. (Quorum present) Staff present:Mr.Joel Duke,City Planner and Ms.Alisa Morgan, Secretary. Minutes: Mr.McAuley moved to approve the minutes of the October 20, 2016 meeting.Mrs. Carpenter seconded the motion. The motion passed unanimously. Old Business: None New Business: 1.Sketch Plan: Dawson’s Mill Subdivision Location: MLK Jr. Drive & Moses Road Owner: Kevin Smith Representative: Larry Speaks & Associates, Inc. Mrs. Carpenter introduced a resolution recommending approval of the sketch plan of Dawson’s Mill Subdivision and moved for its approval.Mr. McAuley seconded the motion. Mr.McAuley moved to table the sketch plan recommendation at the petitioner’s request.Chief Johnson seconded the motion. The motion to table unanimously. 2.Zoning: R-3 (Single Family Residential) to R-5 (Patio Garden Homes)Dawson’s Mill Subdivision Location: 1324 Upper Kingston Road Owner: Rossell Investments, LLC Representative: Larry Speaks & Associates, Inc. Mr. Duke stated that the petitioner is requesting that the item be tabled. He recommended that the public comments be received as the public hearing was advertised. He provided summary background information for the subject property stating that the petitioner is requesting to rezone 22.78 acres from R-3 single family residential to R-5 patio garden homes. He stated that a sketch plan for 67 lots was approved in 2009. In 2010,a revised sketch plan was approved for 89 lots and a preliminary plat for 86 lots was approved. Each of these were approved under R-3 zoning,which is the current zoning of the property.He stated that R-3 is a single family classification which requires a minimum lot size of 7,500 ft2. The requested zoning of R-5 is also single family classification but requires a minimum lot size of 4,000 ft2.He stated that the requested zoning for R-5 matches the presented sketch plan with 115 lots on the 22 acre lot. Chairman Smith opened the hearing for public comments. Deborah Harper,1323 Kingston Oaks, had questions about the storm sewer. Her property (Lot 40, Kingston Oaks Subdivision)abuts the proposed lot dedicated for the storm water detention area. She stated that she was concerned how granting a 15’ access easement for the storm water area would affect her property and adjacent Lot 41 and could the storm water area be relocated. After no further comments, the public hearing was closed. Mr. Duke addressed the public comments. He stated that the developer is required to extend the sewer to the development because the property is not currently serviced by city sewer.He stated that the applicant has presented the city with an idea of obtaining an easement through the lots in adjacent Kingston Oaks Subdivision,as described by the speaker.The city is not responsible for obtaining easement that the petitioner is trying to acquire. He stated that there are other routes to provide sewer to this site. Mr.Gardner introduced a resolution recommending approval of the rezoning of Dawson’s Mill Subdivision and moved for its approval. Mr. Nelson seconded the motion. Mr. McAuley moved to table the rezoning recommendation at the petitioner’s request. Mrs. Carpenter seconded the motion. The motion to table passed unanimously. 3.Final Plat: Ridge at Pratt Farms-Phase 1 Location: Old Ridge Road Owner: SMB Land, LLC Representative: Barrett-Simpson, Inc. Mr. McAuley introduced a resolution recommending approval of the final plat of Ridge at Pratt Farms Phase 1 and moved for its approval.Mr. Gardner seconded the motion. Blake Rice of Barrett-Simpson, Inc. presented the final plat of Ridge at Pratt Farms Phase 1. He stated that the project has been paved,all utilities are in and grading is complete. Mr.Duke provided the report for the final plat of Ridge at Pratt Farms Phase 1. He stated that the applicant submitted the final plat with a letter requesting approval with a bond for unconstructed improvements.Between the time of submission and the meeting, the development has substantially obtained completion. After no further comments, the vote was called. The motion to approve passed unanimously. 4.Proposed Zoning Amendment –Article 3, Prattville Zoning Ordinance (BZA) At the previous meeting,Mr. Duke presented the Commission with a request from the Board of Zoning Adjustment (BZA)to provide its guidance on Article 3 of the Zoning Ordinance and possible amendments to allow the BZA to operate more efficiently. Commissioner Smith along with Commissioners Carpenter and McAuley were appointed as committee members to further review Article 3 of the Zoning Ordinance.Mr. McAuley, presented the finding of the committee’s November 10th meeting. He stated that the Ordinance needed to be more precise on the requirements of appeals and re-hearings. The changes and proposals suggested were reviewed and considered. He stated that they were ready to proceed with the agreed changes to the amendment. He asked Mr. Duke to explain the process for adopting amendments to the Ordinance. Mr. Duke stated that the process of approval to amend the city’s ordinance is the same as amendments to the map. The Planning Commission conducts a hearing and forwards recommended changes to the City Council for consideration. Mr. McAuley moved to set a public hearing for recommendation of proposed changes to Article 3 of the Zoning Ordinance. Mr. Nelson seconded the motion. The motion passed unanimously. Miscellaneous Business: Chairman Smith stated that he was asked by Blake Rice, representative of SMB Land,LLC that the Commission further review the development of the park for the Glennbrooke Subdivision. Chairman Smith along with Mr. McAuley and Chief Johnson was appointed to the Park Committee of Glennbrooke Subdivision. Mr. McAuley expressed his gratitude for the assistance provided by Mr. Cimis, member of the BZA, working to implement changes to Article 3 of the zoning ordinance.
