MINUTES
December 15, 2016
Call to order:
Chairman Tim Smith called the meeting to order at 3:06 p.m.
Roll Call:
The secretary called the roll.Members present were Mayor Bill Gillespie,Councilman Richard
Cables,Chairman Tim Smith,Chief Dallis Johnson,Mr.Roy McAuley and Mr. Bobby Nelson.
Absent:Vice-Chairman Reuben Gardner,Mrs. Paula Carpenter and Mr. Mark Hindman.

Staff present:Mr.Joel Duke,City Planner and Ms.Alisa Morgan, Secretary.
Minutes:
Chief Johnson moved to approve the minutes of the November 17, 2016 meeting.Councilman
Cables seconded the motion. The motion passed unanimously.
Old Business:

Chairman Smith stated that the petitioners are requesting that the Sketch Plan and Zoning requestof Dawson’s Mill be held until January. He stated that he would like to form a committee to meet
with the petitioners to further review their plans.
Mr.McAuley moved to hold the sketch plan and zoning recommendation until the next meeting.
Councilman Cables seconded the motion.
The motion to hold passed unanimously.
Commissioner Smith along with Commissioners Gardner and Johnson were appointed as committee
members to further review plans of Dawson’s Mill Subdivision.

3.Zoning: R-3 (Single Family Residential)
Glennbrooke Phase 5
Location: Glennbrooke Subdivision
Owner: David & Larry Avant
Representative: Barrett-Simpson, Inc.
(This item was deferred to the end of the agenda, anticipating the arrival of a representative).
Blake Rice of Barrett-Simpson, Inc., petitioner’s representative presented the request for the zoning
of Glennbrooke Phase 5. He stated that the requested zoning meets the approved master plan of the
Glennbrooke Subdivision.
Chairman Smith opened the hearing for public comments. There were none. The public hearing
was closed.
Mr. Duke provided the staff report for the zoning request of the Glennbrooke Subdivision Phase 5.
He stated that the requested zoning amendment is consistent with the overall development plan.He
also stated that the developers have requested appointment of a committee to further review design
guidelines for the proposed park.
Mr. McAuley introduced a resolution recommending approval for the zoning of Glennbrooke Phase
5 to R-3 and moved for its approval.Chief Johnson seconded the motion.
After no further comments, the vote was called. The motion to approve passed unanimously.
4.Sketch Plan: Baptist State Board of Missions
Location:Fairview Ave. & Jasmine Trial
Owner: Baptist Health Care Authority
Mr. McAuley introduced a resolution recommending approval of the sketch plan of Baptist State
Board of Missions Plat and moved for its approval. Chief Johnson seconded the motion.
Derril Strickland of Goodwyn, Mills & Cawood,Inc.,petitioner’s representative,introduced the
proposed plans for development of an office building. He stated that the sketch plan presented is a
hypothesis of how the remainder property could be developed in the future.
Mr. Duke presented the staff report for the sketch plan of Baptist State Board of Missions.He stated
that the petitioner has requested development plan approval for an office building located in the
northwest corner of the property.The presented sketch plan creates eleven lots with frontage on
two new streets with connections to Jasmine Trail and Medical Center Drive and aligns with the
existing Jasmine Trail/Nisbett Court intersection. He stated that staff recommends approval of the
presented sketch plan.
After no further comments, the vote was called. The motion to approve passed unanimously.
5.Preliminary Plat: Goose Point Landing Plat 4
Location: County Road 10 and County Road 51
Owner: Dr. George Seier
Representative: Jarvis &Associates, Inc.
Larry Jarvis of Jarvis & Associates, Inc., introduced the preliminary plat of Goose Point Landing
Plat 4. He stated that the plat contains one 6.74 acre lot located at the intersection of county Road
10 and County Road 51. There are no new street or utilities being added.
Chairman Smith opened the public hearing for comments.
Jimmy Haynes, 1339 County Road 51, adjacent property owner inquired about the proposed use of
the property.
George Seier, petitioner, spoke to address the proposed use of the property. He stated that the lot is
being platted to make it legally a part of the subdivision in anticipation of a future sale.
After no further comments, the public hearing was closed.
Chief Johnson introduced a resolution recommending approval of the preliminary plat of Goose
Point Landing Plat 4 and moved for its approval. Mr. Nelson seconded the motion.
Mr. Duke provided the staff report of the preliminary plat of Goose Point Landing Plat 4.He stated
that the platting of the single lot meets the subdivision regulations requirements. There will be no
new road construction,nor public utilities required with this plat. He stated that platting the lot
would make it subject to the existing covenants.
After no further comments, the vote was called. The motion to approve passed unanimously.
6.Final Plat: Goose Point Landing Plat 4
Location: County Road 10 and County Road 51
Owner: Dr. George Seier
Representative: Jarvis & Associates, Inc.
Mr. McAuley introduced a resolution recommending approval of the final plat of Goose Point
Landing Plat 4 and moved for its approval. Mr. Nelson seconded the motion.
The motion to approve passed unanimously.

Please accept this memorandum as the Planning Department staff report for items on the
December 15, 2016 agenda.
1. Sketch Plan: Dawson’s Mill Subdivision, Location: MLK Jr. Drive & Moses Road
Owner: Kevin Smith, Petitioner: Rossell Investments, LLC. The petitioners’
representative has indicated a request to hold this item and Item 2 until the January 19,
2017 will be received prior to the Commission meeting. The petitioner requests an
opportunity to meet with a Commission sub-committee to review their request prior the
January 19, 2017 meeting. With the required public hearing for this item having been
conducted on November 17, the Commission may legally hold both items. The chair may
appoint a committee if he believes it appropriate.
2. Zoning: R-3 (Single Family Residential) to R-5 (Patio Garden Homes), Dawson’s Mill
Subdivision, MLK, Jr. Drive and Moses Road, Petitioner: Rossell Investments and
Kevin Smith. See report for Item 1.
3. Zoning: R-3 (Single Family Residential), Glennbrooke Subdivision Phase 5, Location:
South of Glennbrooke Subdivision, Phase 4, Owner: David & Larry Avant. The
petitioners have requested approval of an application to pre-zone 67.14 acres located west
and south of Glennbrooke Subdivision, Phase 4. The property, which will be presented for
December 14, 2016

preliminary plat approval at a later date as Glennbrooke, Phase 5, has also been presented
for annexation. The annexation request will appear on the Council agenda in January 2017.
Per §11-52-85, Code of Alabama, 1975, municipal councils may pre-zone property
presented for consideration, but not yet annexed. The proposed zoning designation of R-3
for the subject property is consistent with most recent version of the overall sketch plan for
Glennbrooke Subdivision adopted on March 19, 2015 and the city’s comprehensive plan
adopted in 2010. Staff recommends approval of the requested zoning to R-3.
4. Sketch Plan: Baptist State Board of Missions, Location: Fairview Ave. & Jasmine
Trial, Petitioner/Owner: Baptist Health Care Authority. The petitioner owns 28.88 acres
contained in two large parcels in the southeast corner of the intersection of Jasmine Trail
and Fairview Avenue. The property has frontage on Jasmine Trail and Fairview Avenue and
a stub street connection to Medical Center Drive located on the east property line. The
property is zoned B-2 General Business. The petitioner and the Alabama Baptist State
Board of Missions have requested development plan approval for an office building and site
located on 3.68 acres in the northwest corner of the property. Permit approval by the city is
expected before the end of December.
Division of the 3.68 acres from the overall site requires subdivision review and approval by
the Planning Commission. The petitioner has presented a sketch plan for the 28.88 acre
parcel. The plan creates eleven lots with frontage on two new streets. The layout provides
connections to Jasmine Trail and Medical Center Drive and aligns with the existing Jasmine
Trail/Nisbett Court intersection. The sketch plan indicates the availability of sanitary sewer
lines at several points on the property and the general pathway for stormwater drainage.
The petitioner presents the sketch plan as possible layout for public streets and lots, but
does not plan to build the streets network at this time. Staff recommends approval of the
presented sketch plan.
5. Preliminary Plat: Goose Point Landing Plat 4, Location: County Road 10 and County
Road 51, Petitioner/Owner: Dr. George Seier. Beginning in February 2003, the petitioner,
George Seier, developed the 57 acres located in the northwest quadrant of the County Road
10/County Road 51 intersection as the Goose Point Landing subdivision. Of the original
property, only a 6.74 acre parcel along County Road 51 remains undeveloped/unplatted.
The petitioner is requesting preliminary plat and final plat approval for a subdivision

containing a single 6.74 acre lot. The subdivision does not involve new streets or additional
public facilities. Staff recommends approval of the presented plats.
