Members present were Mayor Bill Gillespie, Chairman Tim Smith, Vice- Chairman Reuben Gardner, Chief Dallis Johnson, Mrs. Paula Carpenter, Mr. Seth Hayden and Mr. Mugs Mullins. Absent: Councilman Richard Cables and Mr. Martin Jackson. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Austin Brass, Senior Planner and Ms. Alisa Morgan, Secretary. Minutes: Mr. Gardner moved to approve the minutes of the August 15, 2019 minutes. Chief Johnson seconded the motion. The motion passed unanimously. Old Business: 1. Preliminary Plat: Dawson’s Mill Phase 4 Location: South Side of Moses Road Petitioner: James B. Marshall Jr. Representative: Larry Speaks & Associates, Inc. The requested item was held at the previous meeting (August 15th) to allow the City Council to make action on the rezoning. Mr. Stephens stated that the City Council has approved the R-5 rezoning request for the Dawson’s Mill Phase 4. After no further comments, the vote was called. The motion to approve passed unanimously. New Business: 2. Sketch Plan (Revised): Glennbrooke Subdivision Master Plan Petitioner: SMB Land, LLC Representative: Barrett-Simpson, Inc. Blake Rice of Barrett-Simpson, Inc., petitioner’s representative, introduced the revised sketch plan of Glennbrooke Subdivision Master Plan stating that the revised sketch is almost identical to the last master plan approved except that the realignment of Old Ridge Road has been removed. Chief Johnson introduced a resolution recommending approval of the revised sketch plan of Glennbrooke Subdivision Master Plan and moved for its approval. Mr. Gardner seconded the motion. Mr. Brass provided the staff comments stating that the city is in agreement with the removing the realignment of Old Ridge Road. Mayor Gillespie asked about the road design for the subdivision. Mr. Rice explained that the interior islands are designed to be located only at the entrance. Preliminary Plat: McGriff Street at Washington Ferry Road Subdivision Location: Southwest corner of McGriff Street & Washington Ferry Road Petitioner: Goodwyn Building Company Representative: Larry E. Speaks & Associates, Inc. Greg Gillian of Larry E. Speaks & Associates, Inc., petitioner’s representative, presented the preliminary plat of McGriff Street at Washington Ferry Road Subdivision. He stated that they are requesting to plat 10 lots west of Washington Ferry Road. He stated that they are asking for a waiver from the requirements of installing sidewalks and curb and gutter since there are none in this general area. Mr. Brass provided staff comments for the preliminary plat of McGriff Street at Washington Ferry Road Subdivision. He stated that lot 10 is the only lot proposed for septic sewer and lots 1-9 will be on public sewer. Chairman Smith opened the public hearing. Jon Lee Finnegan, 211 Deer Trace, made comments about the existing ditch and the number of lots presented on the plat differs from application submission. Clark Adams, 114 Yaupon Drive, asked about the types of homes proposed for the subdivision. Chairman Smith stated that the development is proposed for single family residential. After no further comments, the public hearing was closed. Mr. Hayden introduced a resolution recommending the approval of the preliminary plat of McGriff Street at Washington Ferry Road Subdivision and moved for its approval. Mr. Mullins seconded the motion. Mr. Stephens stated that there are three specific waivers (eliminating the curb and gutter, sidewalk and allow Lot 10 on septic sewer) that the petitioner is requesting and the Commission could vote on them individually or together. Chief Johnson suggested tabling the request and have a committee review the impact of eliminating requested waivers. Mr. Gillian stated that he was in agreement with tabling and discussing the request further. He also addressed the public’s comments. Chief Johnson moved to table the request and send to committee for further review. Mrs. Carpenter seconded the motion. The motion to table passed unanimously. Mrs. Carpenter, Mr. Gardner, and Chief Johnson were appointed to committee to further review the preliminary plat of McGriff Street at Washington Ferry Road Subdivision. 4. Preliminary Plat: Birdsong Plat 1 Location: Lower Kingston Road & Birdsong Street Petitioner: Habitat for Humanity of Autauga & Chilton Counties, Inc. Representative: PLS Group, Inc. Mr. Brass introduced the preliminary plat of Birdsong Plat 1. He stated that the private driveway provides direct access to Lower Kingston Road. Tom Risher of Habitat for Humanity of Autauga & Chilton Counties, Inc., petitioner’s representative, presented the preliminary plat of Birdsong Plat 1. He stated that both houses would face Lower Kingston Road. Chairman Smith opened the public hearing. Mary Ann Wingard, 229 Birdsong Street, spoke on concerns of additional houses impacting the current water drainage issues in the area. Chief Johnson addressed the comment stating that two additional houses would not put a bearing on the current drainage issues. Ed Seamon, 926 Seamon Street, spoke on concerns emergency vehicles obtaining access to the area with the additional lots and drainage issues. After no further comments, the public hearing was closed. Mrs. Carpenter introduced a resolution recommending the approval of the preliminary plat of Birdsong Plat 1 and moved for its approval. Mr. Mullins seconded the motion. After no further discussion, the vote was called. The motion to approve passed unanimously. 5. Sketch Plan: Messiah Ministries of Alabama at Old Farm Lane Location: West side of Old Farm Lane Petitioner: Messiah Ministries of Alabama, Inc. Representative: Larry E. Speaks & Associates, Inc. Greg Gillian Larry E. Speaks & Associates, Inc., petitioner’s representative, introduced the sketch plan of Messiah Ministries of Alabama at Old Farm Lane. He stated that the plat consists of 47 single-family R-5 lots. He stated that the existing house on the property would be used for an administration building for the church. He stated that future development will connect with Exchange North. He also stated that they are requesting a variance from the 30 lot limit and the length of the cul-de-sac over 1000 feet. Mr. Brass presented staff comments stating that as discussed with the petitioner, approval is recommended by staff contingent upon comments as indicated in the staff report (attached). Mr. Mullins introduced a resolution recommending the approval of the sketch plan for Messiah Ministries of Alabama at Old Farm Lane and moved for its approval. Chief Johnson seconded the motion. Mr. Brass presented the staff comments for the sketch plan of Messiah Ministries of Alabama at Old Farm Lane. He stated that the sketch plan is contingent upon zoning approval from FAR, B2, & R-3 to R-5 (Patio Garden Homes). Furthermore, a church and daycare use has been presented within the sketch plan. He stated that a church & day care is an allowable use in an R-5 zoning district based upon use- on-appeal approval from the City of Prattville Board of Zoning Adjustment which they have received approval (9/10). He stated that one primary access point is indicated in the sketch plan showing connectivity with Old Farm Lane. This access point would not have cross access through the existing center median along Old Farm Lane based upon the access management plan that has been adopted for the corridor. He stated that an additional stub out is provided for future access with the adjacent 84 acre parcel to the west. Mr. Brass stated that a sewer easement located to the south nearest to the Willow Ridge Apartment complex. Mayor Gillespie moved to table the request until the next meeting. Chief Johnson seconded the motion. The motion to table passed unanimously. The previous appointed committee will serve as committee representatives for this request. 6. Zoning Amendment: B-2 (General Business), R-3 (Single Family Residential) & FAR (Forest, Agricultural, Recreation) to R-5 (Patio Garden Homes) Location: West side of Old Farm Lane and north of Howard Murfee Drive Petitioner: Messiah Ministries of Alabama, Inc. Representative: Larry E. Speaks & Associates, Inc. Mr. Brass introduced the zoning amendment request to change zoning from B-2, R-3, and FAR to rezone to R-5. He stated that the proposed zoning is consistent with the Comprehensive Plan. He stated that the city recommends approval. Chairman Smith opened the public hearing. Jon Lee Finnegan, 211 Deer Trace, concerned about the use of the property not only being for church and daycare use. Jack Buckner, 318 Old Farm Lane, concerned about traffic increase. After no further comments, the public hearing was closed. Mayor Gillespie introduced a resolution recommending the zoning of Messiah Ministries at Old Farm Lane from B-2, R-3, and FAR to R-5 and moved for its approval. Mr. Gardner seconded the motion. After no further comments, the vote was called. Mr. Mullins moved to table the request until the next meeting. Chief Johnson seconded the motion. The motion to table passed unanimously. 7. Preliminary Plat: McClain Landing Subdivision, Phase 1 Location: East side of McQueen Smith Road South Petitioner: SMB Land, LLC. Representative: Barrett-Simpson, Inc. Blake Rice of Barrett-Simpson, Inc., petitioner’s representative, presented the preliminary plat of McClain Landing Subdivision, Phase 1. He stated that they had received comments and will comply with them. Mr. Brass stated that the sketch plan of the proposed preliminary plat was approved with conditions. He stated that this plat is the first phase of the development. Chairman Smith opened the public hearing. Mike Vaughn, adjacent property owner, asked about the widening of McQueen Smith Road. Mayor Gillespie stated that the widening of McQueen Smith Road is a work in progress. After no further comments, the public hearing was closed. Zoning Amendment: R-2 (Single Family Residential) to B-2 (General Business) Location: 1331 S. Memorial Drive and adjacent lot Petitioner: Mitch Devers & Zach Devers Mr. Mitch Devers along with Mr. Zach Devers introduced the zoning amendment for property located at 1331 South Memorial Drive. Mr. Brass provided staff comments for the zoning amendment. He stated that the proposed B-2 zoning would be consistent with the Comprehensive Plan for this area. Chairman Smith opened the public hearing. Adae O’Horo property manager for Eagle Point Apartments, 114 Sheila Blvd., inquired about the proposed development for the property. Chairman Smith addressed her concerns and explained what is allowed in a B-2 district. After no further comments, the public hearing was closed. Mr. Smith introduced a resolution recommending the rezoning of property located at 1331 South Memorial Drive from R-2 to B-2 and moved for its approval. Mrs. Carpenter seconded the motion. After no further discussion, the vote was called. The motion to approve passed unanimously. 9. Annexation: 307 Old Farm Lane and adjacent lot Petitioner: Anna L. Thrash Mr. Brass introduced the zoning amendment request for 307 Old Farm Lane. He stated that the city recommends the pre zoning of FAR for this property. Chairman Smith opened the public hearing. Miscellaneous Business: Mrs. Carpenter spoke about her concerns with the number of requests for annexation into the city’s limits and the impact it will have on the schools. Mr. Stephens stated that a developer has requested for a special meeting if the Commission would be available. As a base zoning of FAR is initially being established, any future zoning proposal would refer to the “Mixed-Use Transitional” land use category of the Comprehensive Plan.
