CALL TO ORDER:
The regular meeting of the Prattville Board of Zoning Adjustment (BZA) was called to order by
Chairman Leo Jamieson at 4:00 p.m. on Tuesday, February 12, 2019.
ROLL CALL:
Present: Chairman Leo Jamieson, and Mrs. Jerry Schannep. Absent: Vice-Chairman James Miles and
Mr. Jerry Crosby. Also present was alternate members, Mr. Neal Parker and Battalion Chief Michael
Whaley.
Quorum Present
Staff present: Mr. Scott Stephens, City Planner and Mr. Austin Brass, Senior Planner.
Chairman Jamieson stated the governing rules for the Prattville Board of Zoning Adjustment according
to the Code of Alabama, 1975 and the procedure of the meeting.
MINUTES:
Mrs. Schannep moved to approve the minutes of the December 11, 2018 meeting. Chief Whaley
seconded the motion. The motion passed unanimously.

There was no old business to discuss.

Mr. Brass introduced the request for a variance to the perimeter landscaping requirements of ten feet,
and the sign setback requirements on property on a vacant lot on Cobbs Ford Road. Mr. Brass stated
that the petitioner is meeting all parking requirements, and the site is challenging to develop upon
because of existing topography.
Greg Gillian of Larry Speaks and Associates, petitioner’s representative, presented the request to
reduce landscaping requirements on the subject property. He stated the owner has attempted multiple
times in the past to develop the property but has been unable to due to the topography of the site. His
proposed site plan will include retaining walls and detention ponds and further undeveloped areas, but
the developable area is limited.
Chairman Jamieson asked Mr. Gillian if he was aware of infrastructure problems that had occurred in
the past nearby, and Mr. Gillian stated he was.
Will Roark, 418 Scott Street, and petitioner, stated he is hoping that his proposed development will
improve some of the stormwater issues on the site. He said they will be purchasing the property and
subdividing it.
Mr. Gillian stated they would be extending the turn lane in front of the development.

DESCRIPTION OF VARIANCE REQUEST:
Variance items 1-4
1) A Variance of 9.1 feet has been requested to allow for a reduced landscape depth from 10 feet to
0.9 feet on the west property line of the proposed RW Prattville retail site adjacent to the existing
billboard site.
2) A Variance of 5 feet has been requested to allow for a reduced landscape depth from the 10-foot
landscape depth requirement between the parking area and common property line on the east side
of the proposed RW Prattville retail site.
3) A Variance of 5 feet has been requested to allow for a reduced landscape depth from the 10-foot
landscape depth requirement between the parking area and common property line on the west side
of the proposed Dunkin site.
4) A Variance of 8 feet has been requested to allow for a pylon sign to be placed 2 feet off of the
east property line from the 10 foot sign setback requirement on the proposed RW Prattville site.

ZONING ORDINANCE REFERENCED:
The provisions of the Zoning Ordinance in which items 1, 2, and 3 are requested is referenced in
section 145 described below:
Section 145. - General site and off-street parking area landscaping requirements.
Perimeter landscaping requirement. Perimeter landscaping must be provided within the property lines
between the off-street parking area, adjoining properties. Planting areas existing in the public rights-of-
way or on adjoining property shall not count toward the required perimeter landscaping area. Perimeter
landscaping areas adjacent to adjoining properties shall be at least ten (10) feet in depth, excluding
walkways, measured perpendicularly from the adjacent property to the back of curb

The board may question petitioner regarding specifics about the proposed sign type, height, and
size.
STAFF ANALYSIS:
The applicants request for a perimeter landscape & signage setback variance is depicted in the attached
site plan layout included for the board’s reference. The variance request is based off of the city of
Prattville’s Ordinance requirement regarding a 10’ perimeter landscaping depth adjacent to off street
parking areas between adjoining properties. At present, the site is undeveloped with the intention of
development to subdivide the tract into two adjacent parcels sharing one common lot line. It shall be
noted that the current site does contain topographic challenges that is unique among other adjacent parcels

with deeps holes and elevation variations requiring extensive site preparation for development. Per the
proposed site plan, the buffer along the lot line does not allow for a 10’ landscape width for each
individual parcel, therefore a variance is being requested to limit each parcel to a 5’ landscape width on
each side of the lot line. Furthermore, the RW Prattville retail site shows the lot line adjacent to an
existing commercial billboard with limited depth, thus requesting a variance of 9.1’ from the required 10’
landscape width setback.
The applicants proposed signage variance is based off the City of Prattville’s Ordinance requirement
requiring a setback of 10’ of freestanding signs from property lines. The petitioner is requesting a
variance to place a pylon sign with 2’ setback off the proposed lot line on the RW Prattville Retail Site.
