CALL TO ORDER:
The regular meeting of the Prattville Board of Zoning Adjustment (BZA) was called to order by
Chairman James Miles at 4:00 p.m. on Tuesday, March 12, 2019.
ROLL CALL:
Present: Chairman James Miles, Vice-Chairman Jerry Crosby, Mr. Charles Knapp, and Mrs. Jerry
Schannep. Absent: Mr. Leo Jamieson. Also present were alternate members Mr. Neal Parker and
Battalion Chief Michael Whaley.
Quorum Present
Staff present: Mr. Scott Stephens, City Planner, Mr. Austin Brass, Senior Planner and Ms. Alisa Morgan,
Secretary.
Chairman Miles stated the governing rules for the Prattville Board of Zoning Adjustment according to
the Code of Alabama, 1975 and the procedure of the meeting.
MINUTES:
There were no minutes available for approval.
OLD BUSINESS:
There was no old business to discuss.
NEW BUSINESS:
VARIANCE
To encroach into the required 20’ side yard setback.
913 Trotter Trail
FAR Zoning District (Forest, Agricultural, Recreation)
Thomas Roylston, Petitioner
Mr. Brass introduced the request for a variance to encroach into the side yard setback on property
located at 913 Trotter Trail. He stated that a variance of 18 feet has been requested to allow for an
open frame carport addition attached to the primary structure within 2 feet of the side yard property
line. He stated that the Hollybrooke Subdivision in which the subject site is located currently has a
zoning designation of F.A.R, however this area has a zoning characteristic that is more similar to an R-
2 Zoning district with each parcel currently having a 75 foot width or less lot. He stated that within the
R-2 Zoning district, a 10 foot side yard setback is required, thus having a 10 foot difference from the
F.A.R. district. He stated that as proposed, a variance would still be required for the carport addition if
the subject property was within the R-2 Zoning district.
Charles Nelson, petitioner’s representative, presented the request to allow a carport to encroach into
the side yard on property located at 913 Trotter Trail. He stated that the cover would not extend over
the existing concrete driveway and no extra water would drain on the adjacent property next to the
driveway.
Chairman Miles opened the public hearing.
Larry Pratt, 1909 Calumet Parkway, spoke in favor of the request.
Heath Harris, 911 Trotter Trail, spoke in opposition of the request. He stated that his house is on the
opposite side of the petitioner’s driveway. In comparing his driveway measurements to the

petitioner’s driveway, he stated that he has 20 feet from the concrete to the brick of the wall. He stated
that the eaves would overhang 1 to 2 feet which would cause water to drain onto the neighbor’s yard.
He disputed whether there is 20 feet from the petitioner’s property line and the current driveway pad.
He also stated that his neighbor on the opposite side of him put in a garage by extending the driveway
to the rear.
Mr. Nelson stated that the driveway pad is approximately 18 feet wide. He stated that their practice is
to round up any fragments of measurements. He stated that water would be controlled by a gutter
system that follows the existing water flow.
After no further comments, the public hearing was closed.
Chairman Miles opened discussion for the board. In their discussion, the Board concluded that a
statement of hardship was not provided to justify a need for a variance and felt that granting a variance
would set a negative precedent for this neighborhood.
After discussion from the board, the vote was called. Mr. Parker moved to establish the findings of fact
stating that 1) special conditions and circumstances do not exist which are peculiar to the land,
structure, or building involved and which are not applicable to other lands structures, or buildings in
the same zoning district; 2) that a literal interpretation of the zoning ordinance would not deprive the
applicant of rights commonly enjoyed by other properties in the same district under the terms of the
zoning ordinance; 3) that the special conditions and circumstances do result from actions of the
applicant (self-imposed hardship); and 4) that granting of a variance will confer a special privilege on
the applicant that is denied by this ordinance to other lands, structures, or buildings in the same
district. Mr. Crosby seconded the motion.
The motion to approve the findings of fact passed unanimously.
The vote was called. Mr. Parker moved to deny the request as submitted based on the approved
findings of fact. Mr. Knapp seconded the motion. The motion to approve passed by 4/1/1 vote as
recorded. Favor: Mr. Parker, Mr. Knapp, Mr. Crosby and Chairman Miles. Oppose: Ms. Schannep.
Abstain: Chief Whaley.
The BZA voted to deny the variance to encroach into the required 20’ side yard setback on property at
913 Trotter Trail.

The applicants request for an attached carport is depicted in the attached site plan layout included in the
applicants initial building permit application. The board shall note that the Hollybrooke Subdivision in
which the subject site is located currently has a zoning designation of F.A.R, however this area has a
zoning characteristic that is more similar to an R-2 Zoning district with each parcel currently having a 75’
width or less lot. Within the R-2 Zoning district, a 10’ side yard setback is required, thus having a 10’
difference from the F.A.R. district described above. Nevertheless, a variance would still be required for
the carport addition if the subject property was within the R-2 Zoning district.
