CALL TO ORDER:
The regular meeting of the Prattville Board of Zoning Adjustment (BZA) was called to order by
Chairman James Miles at 4:00 p.m. on Tuesday, September 10, 2019.
ROLL CALL:
Present: Chairman James Miles, Vice-Chairman Jerry Crosby, Mr. Charles Knapp, and Ms. Jerry
Schannep. Absent: Mr. Billy Barrett. Also present, alternate member Chief Michael Whaley.

Staff present: Mr. Scott Stephens, City Planner, Mr. Austin Brass, Senior Planner and Ms. Alisa Morgan,
Secretary.
Chairman Miles stated the governing rules for the Prattville Board of Zoning Adjustment according to
the Code of Alabama, 1975 and the procedure of the meeting.
MINUTES:
Mr. Crosby moved to approve the minutes of the August 13, 2019 meeting. Mr. Barrett seconded the
motion. The motion passed unanimously.
OLD BUSINESS:
USE-ON-APPEAL
To allow a church use & a daycare use on property.

R-3 Zoning District (Single Family Residential) & B-2 (General Business)
Messiah Ministries of Alabama, Inc., Petitioner
Mr. Brass introduced the use-on-appeal request to allow a church use and a daycare use on property
located at 334 Old Farm Lane. He stated that the 30 acre parcel is a split zone between R-3 & B-2
which allows for the proposed use. He stated that the developer has a proposal to rezone and
subdivide the entire 30 acre tract to R-5 Patio Garden Homes. The proposed use would not be a
prohibited use within that district. He stated that the church has indicated their capacity in the worship
center to be 275 seats which the city’s ordinance would require 56 parking spaces at minimum. He
stated that the petitioner’s sketch plan proposes 85 parking spaces. He also stated that the site would
require a detailed landscape plan.
Mr. Crosby asked if the existing home on the lot would remain. Mr. Brass stated that the existing
structure would be used as the administrative center for the church. If this single-family residence were
to expand in use, additional parking and landscaping would be required.
Mr. Knapp asked if there would be a crossover to north Old Farm Lane. Mr. Brass stated that earlier
approval of the Old Farm Lane access management plan prohibits cross over of Old Farm Lane. He
stated that the proposed church site will have access off of a new proposed street that will connect with
Old Farm Lane. A future goal of this street is for a connection to the Exchange North stub out. He
stated that this new street connection would offer a direct connection with Cobbs Ford Road & Old
Farm Lane.
Greg Gillian of Larry Speaks & Associates, Inc., petitioner’s representative, presented the use-on-
appeal request to allow a church use and daycare use on property located at 334 Old Farm Lane. He
stated that they would prefer Old Farm Lane crossover, but it is not allowed.

Chairman Miles opened the floor for comments.
Jack Buckner, 318 Old Farm Lane. He stated that he is not opposed to the development, but traffic is a
concern.
Ginger Knight, 5555 Main Street, spoke in favor of the request. She stated that the proposed use will
offer positive growth to the area.
Doug Davis, 812 Sweet Ridge Road, spoke in favor of the request. He stated that he is the Pastor of
the proposed church to be located on the site. He stated that they want to be good neighbors as a
church and be able to provide services to the community by offering daycare services in the area.
After no further comments, Chairman Miles closed the public hearing.
Chairman Miles opened discussion for the board. After their discussion, the vote was called. Chief
Whaley moved to establish the findings of fact stating that 1) the proposed church and day care use is
an allowable use-on-appeal, and is not a prohibited use in a R-3 & B-2 district; 2) development of the
proposed use at 334 Old Farm Lane is in the public interest and meets the spirit of the City of Prattville
Zoning Ordinance; and 3) the proposed use will not cause substantial adverse impact to adjacent or
nearby properties or uses. Mr. Crosby seconded the motion.
The motion to approve the findings of fact passed unanimously.
The vote was called. Mr. Crosby moved to approve the request as submitted based on the approved
findings of fact. Mr. Knapp seconded the motion. The motion to approve passed unanimously.
The BZA voted to approve the use-on-appeal to allow a church use and daycare use on property at 334
Old Farm Lane.
MISCELLANEOUS:
Mr. Stephens discussed with the Board upcoming training classes.
ADJOURN:
After no further comments, questions or discussion the meeting was adjourned at 4:36 p.m.

Analysis. Below is the staff assessment of the three general question applicable to uses-on-appeal:
1. Is the proposed church & day care an allowable use-on-appeal, and not a prohibited use
in an R-3 & B-2 zoning district?
The requested use is an allowable use-on-appeal. It is NOT a prohibited use in an R-3 and
B-2 zoning district.
2. Is development of the proposed church/day care at Old Farm Lane in the public interest?
Does the proposed development meet the spirit of the City of Prattville Zoning Ordinance?
At present, the property is an undeveloped parcel and would require the coordination of an
architect and engineer to develop the site and church/day care under the City of Prattville

development standards. The current 30 +/- acre parcel is a split zone between R-3 & B-2
however, the developer has a proposal to rezone and subdivide the entire 30 acre tract to
R-5 Patio Garden Homes. If the proposed rezoning and subdivision were approved, this
use-on-appeal for a church and day care use would fall under an R-5 residential zoning
classification. A church/day care use would not be a prohibited use within that district.
Moreover, the adequate parking area required per number of seats shall be provided. The
church has stated their capacity in the worship center to be 275 seats. The church has not
completed and submitted the require code analysis to support a 275 seat capacity. However,
assuming the 275 seats, city ordinance requires 56 parking spaces at minimum. 85 parking
spaces are shown within the petitioners sketch plan. Furthermore, the site would require a
detailed landscape plan indicating frontage, perimeter, and foundation landscaping. As the
proposed parking areas will be abutting a residential area, a 20’ landscaped buffer is
required with sufficient plantings to reach 8’ in height within a two year period. Additional
interior lot landscape islands are required for a parking area with 40 or more spaces. The
sketch plan also indicates an existing single-family residence at 334 Old Farm Lane as
housing the administrative center for the church. If this single-family residence were to
expand in use, additional parking and landscaping would be required that the meet the City
of Prattville developmental standards.
3. Does the proposed church/ day-care use cause substantial adverse impact to adjacent or
nearby properties or uses?
The proposed use of a church & day care on the vacant 30 +/- acre site can only be
determined by a detailed engineered site plan for a further analysis of impact to adjacent
properties. A storm water management plan with areas of detention/retention would be
required to mitigate storm water under the City of Prattville’s MS4 storm water
management policies. Moreover, additional traffic generation for a church use would be
based upon the square footage of the worship center. The proposed church site will have
access off of a new proposed street that will connect with Old Farm Lane. A future goal of
this street is for a connection with the Exchange N. stub out located an estimated 1,200 ft.
across an adjacent parcel to the east. In sum, this new street connection would offer a direct
connection with Cobbs Ford Road & Old Farm Lane if the adjacent parcel were to develop.
PLANNING STAFF EVALUATION:
Recommendation: Approval, contingent upon proposed church meeting all the City of Prattville
development regulations & codes for Zoning/Fire/Building/Engineering & Storm
water.
