CALL TO ORDER:
The regular meeting of the Prattville Board of Zoning Adjustment (BZA) was called to order by Vice-
Chairman James Miles at 4:00 p.m. on Tuesday, March 13, 2018.
ROLL CALL:
Present: Vice-Chairman James Miles, Mr. Jerry Crosby, and Mrs. Jerry Schannep. Absent: Chairman
Leo Jamieson. Also present were alternate members Chief Michael Whaley and Mr. Neal Parker.
Quorum Present
Staff present: Mr. Joel Duke, City Planner and Ms. Alisa Morgan, Secretary.
Vice-Chairman Miles stated the governing rules for the Prattville Board of Zoning Adjustment according
to the Code of Alabama, 1975 and the procedure of the meeting.
MINUTES:
Mr. Crosby moved to approve the minutes of the February 13, 2018 meeting. Mrs. Schannep seconded
the motion. The motion passed unanimously.
OLD BUSINESS:
There was no old business to discuss.
NEW BUSINESS:
VARIANCE
To allow a mobile home on property.
1501 Northington Road
F.A.R. Zoning District (Forest, Agricultural, Recreation)
David & Sandra Northington, Petitioners
Mr. Duke introduced the request for a variance to allow a mobile home on the property at 1501
Northington Road. He stated the petitioner’s request to install a mobile home as an accessory use on a
lot used for single family residential. He stated that the property is in a FAR zoned district and read
Section 9 of the zoning ordinance “Structures. (General.) It is the intent of this ordinance, that there
shall be but one (1) main structure on any lot zoned or used for single-family residential purposes;
also, accessory structures shall not exceed fifty (50) percent of the total floor area of any main
structure. No accessory structure shall be used as living quarters; however, protective shelters may
provide temporary living quarters in times of danger or emergency.”
Sandra Northington along with David Northington, petitioners, presented the request to place a mobile
home on property at 1501 Northington Road. She stated that the mobile home would be used to house
her mother, Judy Ryals and her husband who provides care giving assistance to her. She stated that
currently there is a pole barn where a recreational vehicle is parked, they plan to move the rv and place
the mobile home in its location.
Mr. Northington stated that they own approximately five acres separated into three parcels. He stated
that it is difficult to combine all three lots into one at this time because of the mortgage agreement. He
stated that there are multiple properties around the area that have mobile homes on them. He stated
that they talked with adjacent property owners who are not opposed to their request.
Vice-Chair Miles asked Mr. Duke about the split properties with one address. Mr. Duke replied that
there is one main dwelling located at 1501 Northington Road. He stated that it is recommended that

the lots be platted into one. He stated that the request is being treated as an accessory structure. He
stated that replatting is not required since no structure is proposed to cross between property lines.
Vice-Chairman Miles opened the public hearing. There were none to speak. The public hearing was
closed.
Vice-Chairman Miles opened discussion for the board. The Board’s discussion concentrated on
whether the use should be restricted to a specific occupant.
The Nothingtons stated that they would remove the mobile home once the assistance is no longer
required.
There being no further discussion, Mr. Parker moved to establish the findings of fact stating that 1)
that special conditions and circumstances exist which are peculiar to the land, structure, or building
involved and which are not applicable to other lands structures, or buildings in the same zoning
district; 2) that a literal interpretation of the zoning ordinance would deprive the applicant of rights
commonly enjoyed by other properties in the same district under the terms of the zoning ordinance; 3)
that granting of a variance is in harmony with the intent and purposes of the zoning ordinance; and 4)
that a variance will not adversely affect the surrounding property, the general neighborhood, or the
community as a whole. Mrs. Schannep seconded the motion.
The motion to approve the findings of fact passed unanimously.
The vote was called. Mr. Parker moved to approve the request as submitted based on the approved
findings of fact contingent that occupancy of the structure is restricted to Harold and Judy Ryals, and
said approval expires when the Ryals no longer occupy the unit or when David & Sandra Northington
no longer owns the property. An annual report from the Northingtons is required to be submitted to
the Planning Department on the anniversary date of this approval. Mr. Crosby seconded the motion.
The motion to approve passed unanimously.
The BZA voted to approve the variance to allow a mobile home on property at 1501 Northington Road
with contingencies.
VARIANCE
To allow an awning forward the 35’ front yard setback.

R-2 Zoning District (Single Family Residential)

Mr. Duke introduced the request for a variance to allow a 13’x8’ carport awning forward the 35’ front
building line.
Elizabeth Young, petitioner, along with her son, John Young, presented the request to place a carport
over the driveway. The carport was enclosed years ago to accommodate their large family. Ms.
Young stated that there is a canopy over the door.
Mr. Parker asked if the carport could be reopened. Ms. Young stated that it would very costly to
reopen the carport. Mr. Young stated that that inclement weather makes it difficult for his mother to
maneuver in and out of her vehicle. He stated that an existing temporary canopy over the driveway is
subject to be blown away.
Vice-Chairman Miles opened the public hearing.
Josh Moore, 105 Till Street, spoke in favor of the request. He stated that he has seen Ms. Young
struggle to get in and out on rainy days. He stated that he had no problems with the request.

Mary Jane Spivey, 101 Till Street, spoke in favor of the request.
After no further public comments, the public hearing was closed.
Vice-Chairman Miles opened discussion for the board. The Board discussed that if approval is granted
that the use should be restricted.
After no further discussion, Mr. Parker moved to establish the findings of fact stating that 1) that
granting of a variance is in harmony with the intent and purposes of the zoning ordinance; and 2) that a
variance will not adversely affect the surrounding property, the general neighborhood, or the
community as a whole. Mr. Crosby seconded the motion.
The motion to approve the findings of fact passed unanimously.
The vote was called. Mr. Parker moved to approve the request as submitted based on the approved
findings of fact contingent that the variance expires with future replacement or removal of the carport.
Chief Whaley seconded the motion.
The motion to approve passed unanimously.
The BZA voted to approve the variance to allow an awning forward the 35’ front yard setback on
property at 103 Till Street with contingencies.

playgrounds, play fields, general recreation facilities, golf courses and
clubhouses. Single-family detached dwellings. Accessory structures or
use customarily incidental to any of the aforementioned permitted uses.
Home occupations only in accordance with the previsions specified in
Article 6.
USES PERMITTED ON APPEAL:
Churches and other places of worship, schools offering general
education courses, clubs not conducted for profit, outdoor advertising
signs and structures, plant nurseries and greenhouses, hospitals,
sanitariums, nursing homes and orphanages, resorts, campgrounds,
riding academies and stables, airports, sanitary landfills, quarries,
railroad rights-of-way, cemeteries, and essential community facilities.
Accessory structures or uses customarily incidental in any of the
aforementioned conditional uses.
USES PROHIBITED:
All uses not permitted or permitted on appeal are prohibited.
