Lovvorn, Petitioner District 6 Miscellaneous: Adjourn Approved 5/8/18 Prattville Board of Zoning Adjustment April 10, 2018 Minutes Page 1 of 2 City of Prattville Board of Zoning Adjustment Minutes April 10, 2018 CALL TO ORDER: The regular meeting of the Prattville Board of Zoning Adjustment (BZA) was called to order by Chairman Leo Jamieson at 4:01 p.m. on Tuesday, April 10, 2018. ROLL CALL: Present: Chairman Leo Jamieson, Mr. Jerry Crosby, and Mrs. Jerry Schannep. Absent: Vice-Chairman James Miles. Also present were alternate members Chief Michael Whaley and Mr. Neal Parker. Quorum Present Staff present: Mr. Joel Duke, City Planner and Ms. Alisa Morgan, Secretary. Chairman Jamieson stated the governing rules for the Prattville Board of Zoning Adjustment according to the Code of Alabama, 1975 and the procedure of the meeting. MINUTES: Chief Whaley moved to approve the minutes of the March 13, 2018 meeting. Mrs. Schannep seconded the motion. The motion passed unanimously. OLD BUSINESS: There was no old business to discuss. NEW BUSINESS: To allow a carport to encroach 3’ into the required 10’ side yard setback. 818 Deramus Street R-2 Zoning District (Single Family Residential) Nancy J. Lovvorn, Petitioner Mr. Duke introduced the request for a variance to add an attached carport cover on the property at 818 Deramus Street. He stated the property is zoned R-2 and requires a 10 foot side yard setback. He stated that the proposed 18 feet wide carport, as proposed in the applicant’s drawing, would require a 6 foot variance instead of a 3 foot variance, but regardless of the amount needed a variance is required for the carport to be placed. Nancy Lovvorn, petitioner, presented the request to place a carport over the driveway on property at 818 Deramus Street. She stated that she inquired with the contractor about building the proposed carport and found that the structure would violate zoning code setback requirements. She stated that the concrete is slippery when it gets wet. She also stated that she has special needs and the carport would assist in her getting in and out of her vehicle during inclement weather. Ben Stotlzfus of Aluminum Fabricators, petitioner’s representative, stated that he measured the property line by the existing fence. He stated that the proposed carport will be 14 feet wide (14’x18’). He also stated that the water would drain as it currently does. Chairman Jamieson opened the public hearing. The following comments were in favor of the request. Jeanette Hollon, 819 Deramus Street and James Stewart, 900 Deramus Street. After no further comments, the public hearing was closed. Chairman Jamieson opened discussion for the board. There being no further discussion from the Approved 5/8/18 Prattville Board of Zoning Adjustment April 10, 2018 Minutes Page 2 of 2 board, the vote was called. Mr. Crosby moved to establish the findings of fact stating that 1) that granting of a variance is in harmony with the intent and purposes of the zoning ordinance and 2) that a variance will not adversely affect the surrounding property, the general neighborhood, or the community as a whole. Mrs. Schannep seconded the motion. The motion to approve the findings of fact passed unanimously. The vote was called. Mr. Parker moved to approve the request as submitted based on the approved findings of fact. Mr. Crosby seconded the motion. The motion to approve passed unanimously. The BZA voted to approve the variance to allow a carport to encroach 3’ into the required 10’ side yard setback on property at 818 Deramus Street.
