Minutes 2018-02-27 Special Meeting 1 PRATTVILLE CITY COUNCIL SPECIAL CALLED MEETING TUESDAY, FEBRUARY 27, 2018 6:00 P.M. The Prattville City Council met in a special called meeting on Tuesday, February 27, 2018, at 6:00 p.m. in the Council Chambers at City Hall. Roll was called and all Councilors were present. Council President Striplin stated that at 4:58 p.m. he received notification that Mayor Gillespie had terminated the services of City Attorney David McDowell and had asked Attorney Rob Riddle to be the Interim City Attorney filling the vacancy. Council President Striplin noted there may be some question as to the legality of the action. Council President Striplin noted that if the Council voted to enter Executive Session, it may be that an attorney will not be present in the session. Council President Striplin asked if the Council wished to consider a motion to adjourn or a motion to enter Executive Session. Councilor Starnes made a motion to enter Executive Session with both attorneys and Councilor Cables seconded the motion. David McDowell stated that it was his opinion that the Council would need to take affirmative action with a Resolution from the Floor to allow Mr. Riddle to meet with Council in the Executive Session. Council President Striplin asked if the motion stands or if there were amendments. There was no comment from the Council. The Council voted to enter Executive Session with both attorneys with the following vote: AYES : JACKSON, BROWN, STARNES STRICHIK, BOONE 5 NAYS : STRIPLIN, CABLES 2 ABSTAINED : NONE 0 ABSENT : NONE David McDowell had provided the City Clerk with a letter of explanation for the Executive Session. That letter is made part of the official record. RESOLUTION FROM THE FLOOR: To Authorize Attorney Rob Riddle to Consult with the City Council Regarding the Mac Gray Project, Phase 1 Matter. (Sponsored By: Council President Striplin) RESOLUTION BOOK 2018, PAGE 022 Councilor Starnes made a motion to adopt a Resolution from the Floor and Councilor Boone seconded the motion. By point of order, the council rules must be suspended if immediate action is to be considered. Councilor Cables made a motion to suspend the rules and Councilor Strichik seconded the motion. The rules were unanimously suspended (7-0). There being no discussion, the Resolution was adopted with the following results: AYES : STRIPLIN, JACKSON, BROWN, STARNES, CABLES, STRICHIK, BOONE 7 NAYS : NONE 0 2 ABSTAINED : NONE 0 ABSENT : NONE Councilor Starnes made a motion to enter into Executive Session and Councilor Cables seconded the motion. With a vote of (7-0), the Council entered Executive Session at 6:09 p.m. Council President Striplin announced that the Executive Session should last approximately one hour and it was unknown if action would be taken at the conclusion of the Executive Session. The Council exited the Executive Session and reconvened the Regular Session at 7:18 p.m. ADJOURN: There being no further business to come before the council, Council President Pro Tempore Brown made a motion to adjourn and Councilor Jackson seconded the motion.
