PUBLIC HEARING MINUTES
TUESDAY MARCH 5, 2013
6:02 P.M.
CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, March 5,
2013 at 6:02 p.m. in the Council Chambers at City Hall. Council President Wood called the
meeting to order. Roll was called and all Councilors were present.
1. APPEAL BY MR. KENNETH REGAN REGARDING DILAPIDATED
STRUCTURE AT 945 NEWTON STREET.
Kenneth Regan spoke in favor of Item #1. Mr. Regan paid the taxes on the home last May.
The home was purchased at a tax sale and is a foreclosure. There is currently a mortgage on
the home. Mr. Regan is not willing to put his own money into the property but feels that it is
too valuable to demolish. Mr. Regan hopes that the mortgage company will repair the home.
City Planner Joel Duke explained that the structure is considered a hazard and public
nuisance and Mr. Regan and the mortgage company have been contacted. The house must be
repaired or demolished. The home also has termite damage.
Councilor Boles has been in contact with the neighbors of this property. The most frequent
complaint is regarding the rodent problem the structure is causing.
Mr. Duke explained the procedure followed when dealing with dilapidated structures. First an
inspection of the property is done. If the property is determined to be dilapidated all
interested parties are notified that the structure must be repaired or demolished within 45
days. The interested parties then have 30 days to request a Public Hearing to ask for an
appeal. The City Council should take action at its next regularly scheduled meeting.
Council President Pro Tempore Striplin asked where the mortgage company was located and
what Mr. Regan’s intent was regarding this property. Mr. Regan paid the taxes on the home in
order to collect 12% interest once the home was brought out of foreclosure. He has no intent
to repair or reside in the home.

There being no further business to come before the council, the public hearing adjourned
at 6:09 p.m.
