Code of Alabama, 1975, as Amended.] 4

WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2019- 17
18
A, Page 177, that the abundance of overgrown grass and weeds at various addresses in the 19
20
City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62 of the Code of Alabama, 1975, as 25
26
amended, was provided in The Prattville Progress, by certified mail, and by signage on the 27
28
subject property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
the property listed in Resolution Book 2019-A, Page 177, adopted on November 19, 2019, 33
34
and determined that the public nuisance still exists; and 35
36
WHEREAS, the City Council of the City of Prattville held the required public hearing 37
38
at 6:00 p.m. on December 17, 2019, permitting the owner of same property listed in 39
40
Resolution Book 2019, Page 177, to present evidence, objections and protest regarding the 41
42
proposed removal of weeds. 43
44
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 45
46
Prattville declares that the abundance of overgrown grass and weeds on the property 47
48
continue to be a public nuisance: 49

BE IT FURTHER RESOLVED that: 53

The Mayor shall have the overgrown grass and weeds on the property listed above cut or 55

removed using city forces or private contractors. Any property owner shall have the right to 57
58
have any weeds removed at his or her own expense provided the removal is done prior to the 59
60
commencement of work by employees or agents of the City of Prattville. The Mayor shall 61
62
keep an accounting of all costs related to the removal of overgrown grass and weeds and 63
report such cost to the City Council following their removal. 1

[To Provide Tier I Retirement Benefits to Tier II Plan Members Pursuant to the Provisions of 3
Act 2019-132.] 4

WHEREAS, under the provisions of Act 2019-132, employers who participate in the 8
Employees’ Retirement System pursuant to §36-27-6, Code of Alabama, 1975, as amended, 9
may elect to provide Tier I retirements benefits to Tier II plan members; and 10
WHEREAS, the City of Prattville participates in the Employees’ Retirement System 11
pursuant to §36-27-6, Code of Alabama, 1975, as amended, and wishes to improve 12
retirement benefits for its Tier II plan members. 13
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 14
elects to provide Tier I retirement benefits to its Tier II plan members, subject to approval by 15
the Employees’ Retirement Systems Board of Control; that, if approved, such election shall 16
be effective the following fiscal year and is irrevocable. 17
BE IT FURTHER RESOLVED that the City of Prattville has reviewed the actuarial cost 18
estimates provided by the Employees’ Retirement System for such election and agrees to 19
pay any resulting increases in the employer contribution rate. 20
BE IT FURTHER RESOLVED that beginning in the month that such election is 21
effective, the City of Prattville’s Tier II plan members shall contribute 7.5% of their earnable 22
compensation to the Employee’s Retirement System, and the City of Prattville’s Tier II plan 23
members who are firefighters or law enforcement officers, as defined in §36-27-6.5(a), Code 24
of Alabama, 1975, as amended, shall contribute 8.5% of their earnable compensation to the 25
Employees’ Retirement System, as required by Act 2019-132. 26
BE IT FURTHER RESOLVED that the City of Prattville has not increased the member 27
contribution rates for its Tier I members as provided by Act 2011-676 and, as required by 28
§36-27-6.5(a), Code of Alabama, 1975, as amended, the City of Prattville has submitted to 29
the Employee’s Retirement System a plan to increase such rates. 30

WHEREAS, the City of Prattville Information Technology Department has a need for 9

six (6) Dell Latitude 5424 Rugged laptop computers; and 11

WHEREAS, said computers are available from CDW-G, LLC at a total cost not to exceed 13
14
$6,516.00; and 15

WHEREAS, said computers are a budgeted expense. 17
18
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 19
20
that funds in an amount not to exceed $6,516.00 for the purchase of said computers are 21
22
hereby authorized and approved to be paid to CDW-G, LLC and said funds are approved and 23
24
appropriated from FY2020 Budget Line Item I.T./Equipment Maintenance. 25

WHEREAS, the City of Prattville has identified the need to replace the vertical platform 9
10
lift at the Prattaugan Museum in order to meet the standards of a commercial lift; and 11
12
WHEREAS, said lift is available from Alabama Elevator & Accessibility, Inc. at a cost 13
14
not to exceed $13,626.00; and 15
16
WHEREAS, the Finance Director has identified a certain sum of surplus funds 17
18
available for departments that came in under budget for Fiscal Year 2018; and 19
20
WHEREAS, a portion of the Public Works/Vehicle Maintenance Division allocation of 21
22
said surplus funds shall be used for the purchase and installation of said lift. 23
24
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 25
26
that the FY2020 Budget is amended as follows: 27
28
Decrease Vehicle Maintenance/Departmental Reserves $13,626.00 29
Increase Facility Maintenance/Capital Outlay $13,626.00 30

BE IT FURTHER RESOLVED that funds in an amount not to exceed $13,626.00 are 32
33
hereby authorized and approved to be paid to Alabama Elevator & Accessibility, Inc. for the 34
35
purchase and installation of said lift and said funds are hereby approved and appropriated to 36
37
be paid from FY2020 Budget Line Item Facility Maintenance/Capital Outlay. 38
