Chief Johnson recused himself citing a conflict of interest. 42 43 Mr. Brass introduced the rezoning request for property located at the southwest corner of Highway 82 and 44 Washington Ferry Road and Jensen Road. He stated that the property is split zoning of B-1 and R-2 and the 45 petitioner is requesting to rezone all of the property to B-2. 46 47 Mr. Stanfield, petitioner, stated that he is seeking to rezone the property to B-2 to allow for a restaurant business 48 venture. 49 50 Vice-Chairman Gardner opened the floor for public comments. 51 52 Jon Lee Finnegan, 211 Deer Trace, stated that the Department of Transportation informed her that there are 53 future plans for widening that portion of Highway 82. She asked if there are future plans to place a traffic light 54

at the intersection of Washington Ferry Road and Highway 82 after the road widening. She also inquired about 55 the difference in the types of business allowed in the B1 and B2 zoning districts. 56 57 Mr. Stanfield stated that he also owns the property directly across from the proposed lot. He stated that the 58 state is making a proposal for a turn in/turn out lane when the road is widen. 59 60 After no further comments, the public hearing was closed. 61 62
Councilman Cables introduced a resolution recommending the zoning of property located at the southwest 63 corner of Highway 82 and Washington Ferry Road and Jensen Road from R-2 and B-1 to B-2 and moved for 64 its approval. Mr. Mullins seconded the motion. 65 66 Mr. Brass provided the staff report for the proposed rezoning. He stated that the current Comprehensive Plan 67 has a future land use classification of Mixed-Use-Residential for this location. This land use classification is 68
recommended for housing of a variety of densities. He stated that rezoning of this property from B-1 69 (Neighborhood Business) & R-2 (Single-Family Residential) to a more intense business use classification, B-70 2 (General Business), would be contrary to the consistency of the Comprehensive Plan. He stated that in 71 meeting with Mr. Stanfield, they discussed that the B-2 zoning is inconsistent with the Comprehensive Plan 72 and that a restaurant at this location is a permitted use in a B-1 zoning district as a “Use on Appeal.” 73 74 Mr. Stanfield stated that a residence would never be put on the existing R-2 portion of the property. 75 76 After no further comments, the vote was called. Mr. Mullins moved to amend the motion recommending 77 approval of rezoning the R-2 portion to B-1. Mrs. Carpenter seconded the motion. 78 79

This sketch plan consists of a vacant 6 +/- acre vacant parcel currently zoned R-3 & R-2, Single-
Family Residential. The proposal is to subdivide the tract into sixteen (16) single-family
residential lots conforming to all standards of the R-2 & R-3 zoning district as described above for
yard and lot size. Four (4) lots will front Northington St, an existing city street and twelve (12) lots
will front a new proposed public street that will commence off of East 6th street into a cul-de-sac.
Being zoned R-2, lots facing Northington Street will have a proposed width of 75’ at minimum,
as lots two (2) to five (5) will have a minimum width of 60’ at the building line within the R-3
zoned section of the tract. Likewise, lot six (6) to twelve (12) will meet the minimum width
standard of 75’ required for an R-2 zoning district. Furthermore, the five (5) lots facing
Northington Street will have a 30’ private drive easement serving the rear of those lots. This access
easement will serve as a driveway allowing vehicular accessibility from the rear of the proposed
single-family homes that will serve these lots. This proposed sketch plan meets the current Future
Land Use (FLUM) of the City of Prattville Comprehensive Plan recommending a low-density
residential land classification and complies to the underlying zoning designation of R-2 & R-3
single-family residential.

Street Connectivity: A new street right-of-way (Park Lane) will connect with
Ridgewood Road & Magnolia Drive. Also, a new street
connection is being shown connecting with an existing stub
out (Camellia Drive) within Camellia Estates.
Water/Sewer: Water and sanitary sewer are both available in the area.
Staff Comments:
This proposed sketch plan consists of the subdividing an existing 21.16 +/- acre tract of land into
approximately 89 single family lots meeting R-3 standards. The area is currently zoned R-2 & R-
3 (Single-Family Residential) and R-5 (Patio Garden Homes). The petitioner has submitted a
rezoning application requesting to rezone the area to R-3. The rezoning hearing will be on the
January agenda.
