7 WHEREAS, on January 30, 2020, the World Health Organization declared COVID-19 8 9 (Coronavirus) a pandemic and declared the outbreak a “public health emergency of 10 11
international concern”; and 12
13 WHEREAS, on March 13, 2020, the President of the United States of America 14 15 declared a National State of Emergency due to COVID-19; and 16
17 WHEREAS, on March 13, 2020, the Governor of Alabama issued an Executive Order 18 19 and declared a Statewide State of Emergency in Alabama due to COVID-19; and 20 21
WHEREAS, the Autauga County Commission and the Elmore County Commission 22 23 have declared a State of Emergency in their respective counties; and 24 25 WHEREAS, all of the above could adversely affect the health, safety, and economy of 26
27 the citizens of the City of Prattville. 28 29 WHEREAS, §31-9-10 of the Code of Alabama, 1975, as amended, provides the 30 31
power and authority for a political subdivision such as the City of Prattville to declare a State 32 33 of Local Emergency and to waive the procedures and formalities otherwise required of a 34 35 political subdivision by law, including but not limited to: 36

1. The performance of public work and taking whatever prudent action is necessary to ensure 38 the health, safety, and welfare of the community. 39 2. The appropriation and expenditure of public funds, including entering into contracts and 40 incurring obligations. 41 3. The employment of temporary workers and the utilization of volunteer workers. 42 4. The rental of equipment and the acquisition and distribution, with or without compensation, 43 of supplies, material, and facilities. 44 5. The assignment and availability for duty of employees, property, or equipment for emergency 45
management purposes. 46 47 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 48

that the COVID-19 (Coronavirus) does hereby pose a serious threat to the lives and welfare 50 51 of residents of the City of Prattville, Alabama, and that a State of Local Emergency has 52 53
hereby been declared for the City of Prattville. 54 55 BE IT FURTHER RESOLVED that the Mayor and City of Prattville Departments are 56 57 requested and authorized to record the additional expenses incurred in the past and future as 58

a result of the COVID-19 impacts; and seek reimbursement to the extent provided and 60 61 authorized by Federal and State Laws. 62 63

[To Authorize Additional Emergency Sick Leave and Benefits to City Employees in 3 Compliance with the Emergency Paid Sick Leave Act and the 4 Emergency Family and Medical Leave Expansion Act.] 5 6

8 WHEREAS, on January 30, 2020, the World Health Organization declared COVID-19 9 10 (Coronavirus) a pandemic and declared the outbreak a “public health emergency of 11

international concern”; and 13 14 WHEREAS, a State of Emergency has been declared at the National, State, County 15 16
and Local level due to COVID-19; and 17
18 WHEREAS, the Center for Disease Control Employer Infection Control Guidelines 19 20 recommended that employers ensure that sick leave policies are flexible and consistent with 21
22 public health guidelines; and 23 24 WHEREAS, the Emergency Paid Sick Leave Act authorizes employers to provide 25 26
additional emergency sick leave to full-time and part-time employees to be utilized for certain 27 28 events relating to COVID-19; and 29 30 WHEREAS, the City of Prattville desires to be proactive in providing said emergency 31
32 sick leave to City employees in compliance with said Act for the dual purpose of assuring 33 34 the City Workforce that they are our most important asset, as well as assisting in efforts to 35 36
stabilize the local economy; and 37 38 WHEREAS, immediate action shall be taken and revisited as necessary to provide 39 40 continuation of benefits and pay to City employees during this unprecedented time; and 41
42 WHEREAS, the City shall follow all Federal Laws and Guidelines in the Emergency 43 44 Family and Medical Leave Expansion Act. 45 46
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 47 48 that an additional 10-shifts of emergency sick leave based on the shift assignment of the 49 50 employee (8,12, or 24) shall be added to the sick leave balance of all Full-Time City 51
52 employees, and said emergency sick leave shall remain in the employee’s sick 53 54 leave balance with or without a COVID-19 event or until utilized by the employee. 55
56 BE IT FURTHER RESOLVED that all Part-Time Employees shall be eligible for 57 58 emergency sick leave under said Act for the average number of hours that they work over a 59 60
two-week period for COVID-19 qualifying events. Said Emergency Sick Leave shall expire on 61
62 December 31, 2020. 63 64
BE IT FURTHER RESOLVED that due to program shutdowns, temporary seasonal 1

employees shall be awarded Emergency Sick Leave based the number of hours that they 3 4 work on average over a two-week period in compliance with the Act, for the duration of their 5 6
current temporary position. 7
