Main Street, including a 13 14 Pedestrian Bridge. 15 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 17 18 Prattville that: 19 20 1. The City of Prattville shall submit said TAP application for funding in an amount not 21 to exceed $565,000.00 (net cost to City not to exceed $113,000.00) for sidewalk 22 improvements to Bridge Street from Maple Street to W. Main Street, including the 23 pedestrian bridge, to include construction and construction engineering services. 24 2. The City of Prattville commits an amount not to exceed $65,000.00 for preliminary 25 engineering cost 26 3. This amended Public Safety Curfew shall be effective 38 as of May 19, 2020 and shall continue in effect until further notice. 39 40 (a) This curfew shall apply to all persons within the City of Prattville. During such curfew, no 41 persons shall be or remain in public places. Residents of the City of Prattville shall remain in 42 their places of residence, except as further provided in subsection (d) of this Order. 43 44 This curfew shall not apply to: 45 46 1. Public safety or emergency services activities, including but not limited to law 47 enforcement, fire and rescue services, and emergency management agencies. 48 49 2. First responders, crisis intervention workers, public health workers, emergency 50 management personnel, emergency dispatchers, law enforcement personnel, and 51 related contractors. 52 53 3. Persons employed by or contracted to utilities, cable, and telecommunications 54 companies and engaged in activities necessary to maintain or restore utility, cable, or 55 telecommunications services. 56 57 4. Persons providing fire, police, sanitation, wastewater, security, emergency and hospital 58 services, food delivery services and other deliveries of merchandise or mail. 59 60 5. Persons seeking essential services or commodities. However, persons who are 61 vulnerable to the most serious side effects of the COVID-19 disease must remain at 62 home, unless seeking medical treatment. 63 6. Persons supplying or restocking businesses in order to provide essential services or 1 products, i.e. home improvement, groceries, fuel delivery locations, pharmacies or 2 other retailers offering emergency supplies, transportation of fuels, movement of 3 equipment and personnel for the provision of humanitarian support, and movement of 4 equipment necessary for the protection of critical infrastructure or public safety. 5 6 7. Persons employed by the federal, state, county or city government or their agencies 7 working within the course and scope of their public service employment. Such 8 employees shall follow any current or future directives regarding performance of 9 duties, including working from home, issued by their respective employers. 10 11 8. Persons experiencing homelessness within the City. 12 13 (b) All public and private gatherings of any size where a consistent distance of at least six feet 14 cannot be maintained are prohibited, except as to those exempted activities further provided in 15 this Order. 16 17 (c) Subject to exceptions further provided in subsection (d) of this Order, all travel, including, 18 without limitation, travel on foot, bicycle, scooter, motorcycle, automobile, or public transit is 19 prohibited. Transportation in Interstate Commerce is not governed by this Order. 20 21 (d) Exceptions. People may lawfully leave their residence while this Order is in effect only to 22 engage in the following activities: 23 24 1. Essential Activities. To engage in certain essential activities, including, without limitation, 25 visiting a health or veterinary care professional, obtaining medical supplies or 26 medication, obtaining grocery items (including, without limitation, canned food, dry 27 goods, fresh fruits and vegetables, pet supplies, fresh or frozen meats, fish, and poultry, 28 any other household consumer products and products necessary to maintain the safety 29 and sanitation of residences and other buildings) for their household or to deliver to 30 others, or for legally mandated government purposes. Additionally, any travel related to: 31 a. providing care for minors, the elderly, dependents, persons with disabilities, or 32 other vulnerable persons; 33 b. returning to one’s place of residence from outside the City; 34 c. travelling to one’s place of residence located outside the City; 35 d. travelling through the City from one location outside the City to another location 36 outside the City; 37 e. compliance with an order of law enforcement or court shall be exempt from this 38 Order; 39 f. travelling to or from a place of business which provides essential services by 40 owners and employees of such business; 41 g. legally mandated government purposes. Persons engaging in these essential 42 activities shall maintain reasonable social distancing practices. This includes 43 maintaining a distance of at least six feet away from others, frequently washing 44 hands with soap and water for at least twenty seconds or using hand sanitizer, 45 covering coughs and sneezes (into the sleeve or elbow, not hands), regularly 46 cleaning high-touch surfaces, and not shaking hands. These essential activities 47 are subject to change and are not limited to the activities listed in this subsection. 48 Individuals must use reasonable judgement as it relates to the many and various 49 circumstances during this time. 50 51 2. Work in Support of Essential Activities. To perform work providing essential products 52 and services or to otherwise carry out activities specifically permitted in this Order. 53 54 3. To care for or support a friend, family member, or pet in another household. 55 56 4. Providing any services, goods, or work necessary to build, operate, maintain or 57 manufacture essential infrastructure, including with limitation construction of 58 commercial, office and institutional buildings, residential building and housing; airport 59 operations, food supply, concession, and construction; port operations and construction; 60 water, sewer, gas, electrical, oil extraction and refining; roads and highways, public 61 transportation and rail; solid waste collection and removal; flood control and watershed 62 protection; internet and telecommunications systems (including the provision of 63 essential global, national, and local infrastructure for computing services, business 64 infrastructure, communications, and web-based services); and manufacturing and 1 distribution companies deemed essential to the supply chains of the industries 2 referenced in this paragraph, provided that they carry out those services and that work 3 in compliance with social distancing practices as prescribed by the Centers for Disease 4 Control and Prevention and the State Health Officer, to the extent possible. 5 6 BE IT FURTHER RESOLVED that the existing Curfew for Minors in the City of Prattville 7 8 Code of Ordinances, Section 50-3, shall remain in place as adopted. Sale, Purchase, Possession, and 13 14 Explosion of Fireworks and Pyrotechnics is hereby amended to read as follows: 15 16 Sec. 26-165. - Sale, purchase, possession, and explosion of fireworks and pyrotechnics. 17 (a) Definition. When used in this division, the term "fireworks" or "pyrotechnics" means and includes one or 18 more of the following: 19 (1) Sparklers; 20 (2) Squibs; 21 (3) Rockets; 22 (4) Firecrackers; 23 (5) Roman candles; 24 (6) Fire balloons; 25 (7) Signal lights; 26 (8) Torpedoes; 27 (9) Torpedo caps; 28 (10) Railroad and track torpedoes; 29 (11) Flashlight compositions; 30 (12) Firecrackers of all kinds; or 31 (13) Other devices or compositions which are used to obtain visible or audible pyrotechnic displays. 32 (b) Possession. It shall be unlawful for any person to have in possession, keep, store, use, manufacture, sell, 33 offer for sale, give away, or handle any pyrotechnics within the corporate limits of the city; provided, however, 34 nothing in this section shall be held to apply to articles manufactured for use as signaling devices and used 35 as such in the operation of railroads, boats, or airplanes, or other required emergency purposes; and provided 36 further, nothing in this section shall be held to apply to a normal supply of flashlight compositions in the hands 37 of photographers or dealers in photographic supplies.
