2 [To Authorize the Mayor to have Various Weeded Lots Abated per Title 11, Chapter 67 of the 3

7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12 3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2020, 17 18 Page 068, that the abundance of overgrown grass and weeds at various addresses in the 19 20 City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22 nuisances; and 23 24 WHEREAS, notice, as required by §11-67-62 of the Code of Alabama, 1975, as 25 26
amended, was provided in The Prattville Progress, by certified mail, and by signage on the 27 28 subject property; and 29 30 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32 the properties listed in Resolution Book 2020, Page 068, adopted on June 16, 2020, and 33 34 determined that the public nuisance still exists; and 35 36
WHEREAS, the City Council of the City of Prattville held the required public hearing 37 38 at 6:00 p.m. on July 21, 2020, permitting the owners of same properties listed in Resolution 39 40 Book 2020, Page 068, to present evidence, objections and protest regarding the proposed 41
42 removal of weeds. 43 44 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 45 46

removed using city forces or private contractors. Any property owner shall have the right to 27 28 have any weeds removed at his or her own expense provided the removal is done prior to the 29 30 commencement of work by employees or agents of the City of Prattville. The Mayor shall 31

22 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23 24 the property at the following address and determined the existence of an abundance of 25 26

7 WHEREAS, the quadrennial Municipal Election of the City of Prattville, Alabama, 8 9 shall take place on Tuesday, August 25, 2020, and the Run-Off Election, if necessary, shall 10 11
be held on Tuesday, October 6, 2020, pursuant to §11-46-22 Code of Alabama, 1975, as 12 13 amended; and 14 15 WHEREAS, in Resolution Book 2020, Page 069, on June 16, 2020, City Clerk Cathy 16
17 Dickerson was appointed as the Municipal Election Official for the 2020 Quadrennial Prattville 18 19 Municipal Election; and 20 21
WHEREAS, due to the COVID-19 Pandemic, the Alabama League of Municipalities 22 23 has recommended that cities and towns appoint a backup Absentee Elections Manager in 24 25 order to efficiently handle election duties in the absence of the Municipal Election Official; 26

WHEREAS, the Engineering Department of the City of Prattville had specifications 12 13 drafted and let bids for said project; and 14 15 WHEREAS, two (2) bids were received, opened, and read on July 16, 2020 at 11:00 16
17 a.m. in City Council chambers; and 18 19 WHEREAS, Mid-South Paving, Inc. was the lowest responsible bidder at a cost not to 20 21
exceed $554,324.00; and 22 23 WHEREAS, said paving project is a budgeted expense for the Gas Tax Fund. 24 25 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 26
27 hereby awards Bid No. 020-009 at a cost not exceed $554,324.00 for said paving 28 29 improvements to Mid-South Paving, Inc. and said funds are approved and appropriated from 30 31
the FY2020 Budget Line Item Gas Tax Fund/Local Paving. 32 33 BE IT FURTHER RESOLVED that the City Council does hereby authorize and empower 34 35 the Mayor of the City of Prattville to execute any and all documents necessary to have this work 36

services in conjunction with the FY2020 Various Street Resurfacing Project and the FY2020 12 13 Various Street Microsurfacing Project; and 14 15 WHEREAS, said engineering services are available from Civil Southeast, LLC at a 16
17 cost not to exceed $40,000.00; and 18 19 WHEREAS, §41-16-51(a)(3) Code of Alabama, 1975, as amended, allows contracts to 20 21
secure services with engineers possessing a high degree of professional skill to be let without 22 23 competitive bidding; and 24 25 WHEREAS, said project is a budgeted expense for the Gas Tax Fund. 26
27 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 28 29 that the Mayor is authorized and empowered to enter into an Agreement with Civil Southeast, 30 31
LLC for said construction engineering inspection services. 32 33 BE IT FURTHER RESOLVED that funds in an amount not to exceed $40,000.00 34 35 are hereby authorized and approved to be paid to Civil Southeast, LLC for said engineering 36
