WHEREAS, the City Council of the City of Prattville intends to appoint a qualified 11

person to fill this vacancy and serve the remainder of the unexpired term. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 15
16
that a vacancy is hereby declared in City Council District 3. 17

BE IT FURTHER RESOLVED that the City Council shall consider an appointment to 19
20
fill the vacancy following the certification of the Municipal Election to be held on August 25, 21

WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2020-A, Page 080, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said property and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
August 18, 2020, permitting the owner of said property to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the property 43
44
continue to be a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 50

weeds on the property listed above cut or removed using city forces or private contractors. 52

Any property owner shall have the right to have any weeds removed at his or her own 54
55
expense provided the removal is done prior to the commencement of work by employees or 56
57
agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 58
59
removal of overgrown grass and weeds and report such cost to the City Council following 60
61
their removal. 62

Elmore County Revenue Commissioners, are ordered to abate the abundance of 44

3. the owners of said property are ordered to appear before the City Council of the City of 46
Prattville at a public hearing at 6:00 p.m. on September 15, 2020, in Prattville City Hall. 47
Notice of such hearing shall be sent by certified mail to owners of said property. 48

WHEREAS, the City of Prattville, Alabama, has certain items of personal property 7

which are no longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the 11
12
municipal governing body to dispose of unneeded personal property. 13
14
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 15
16
that the following personal property owned by the City of Prattville, Alabama, is no longer 17
18
needed for public or municipal purposes and said property shall be removed from the 19
20
inventory of the Parks & Recreation Department: 21

no value, the Mayor has authority to scrap or dispose of said items for and on behalf of the 30

WHEREAS, a vacancy currently exists on the Board of Zoning Adjustment 7

due to the term expiration of Jerry Schannep on June 15, 2018; and 9
10
WHEREAS, Ms. Schannep has continued to serve in this role and now desires to 11
12
step down from the Board of Zoning Adjustment; and 13
14
WHEREAS, it is the desire of the Prattville City Council to fill that vacancy to ensure 15
16
the continuity of the Board’s operation. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 19
20
Sarah Ann Johnson is hereby appointed to fill the vacancy effective immediately and said term 21
22
will expire on June 15, 2021, or until her successor is duly qualified and appointed. 23

[To Adopt a Transportation Plan for FY2021 as Required by Act 2019-2 for the 3
Rebuild Alabama Fund.] 4

WHEREAS, Act 2019-2, also known as the Rebuild Alabama Act, was adopted by the 8
9
Alabama Legislature to levy an additional tax on gasoline and diesel fuel; and 10
11
WHEREAS, the City of Prattville shall receive a portion of said tax; and 12
13
WHEREAS, Act 2019-2 requires that said monies be deposited into a separate fund 14
15
maintained by the municipality and expended for the maintenance, improvement, 16
17
replacement and construction of roads and bridges, and as mandated by the Act; and 18
19
WHEREAS, Act 2019-2 requires that the City of Prattville adopt an annual 20
21
Transportation Plan no later than August 31 for the next fiscal year to be approved by the 22
23
municipal governing body; and 24
25
WHEREAS, said Transportation Plan shall provide a detailed list of projects for which 26
27
expenditures are intended to be made in the next fiscal year; and 28
29
WHEREAS, the City of Prattville Transportation Plan for FY2021 includes pavement 30
31
of the following roads: 32

• Lawrence Street from Patrick Street to Hargis Drive 34
• Cargill Street from Durden to Mockingbird Street 35
• Oregon Court from Cargill Street to End 36
• Utah Court (Cul-de-sac) from Cargill Street to End 37
• West Drive from Mockingbird Street to Mockingbird 38
• Marlyn Drive from Mockingbird Street to Waverly Lane 39
• Waverly Court (Cul-de-sac) from Waverly Lane to End 40
• Hickory Lane from Sycamore Drive to Shadow Lane 41
