7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12 3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17 18 2020-A, Page 109, that the abundance of overgrown grass and weeds at various addresses 19 20 in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22 nuisances; and 23 24 WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25 26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27 28 property; and 29 30 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31

said properties and determined that the public nuisance still exists; and 33 34 WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35 36
September 15, 2020, permitting the owners of said properties to present evidence, 37
38 objections, and protest regarding the proposed removal of weeds. 39 40 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41

WHEREAS, §11-67-60 through §11-67-67 Code of Alabama, 1975, as amended, 7 8 details the process for declaring certain weeded lots a public nuisance, ordering their 9 10 abatement and assessing the costs of abatement; and 11
12 WHEREAS, the City Council of the City of Prattville finds that: 13 14 1. the Prattville Police Department Code Enforcement Officer identified several lots as 15 being a public nuisance due to an abundance of overgrown grass and weeds, 16
2. the owners of various weeded lots were properly notified of the public nuisance as 17 required by §11-67-62, Code of Alabama, 1975, as amended, 18 3. a public hearing concerning the lots was conducted as required by §11-67-63, Code of 19
Alabama, 1975, as amended, and 20 4. the City Council adopted resolutions authorizing the Mayor to abate the public 21
nuisances. 22 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 24 25 that the costs of abating these nuisances as listed in “Attachment A” is hereby adopted and 26
27 the costs thereof shall be assessed against the respective parcels of property. 28 29 BE IT FURTHER RESOLVED that the City Attorney shall file said liens with the 30 31
Revenue Commissioner of Autauga and Elmore Counties under the “Optional Method of 32

12 WHEREAS, said equipment is available through State Contract T222 from Capital Tractor 13 14 at a cost not to exceed $22,469.00; and 15 16
WHEREAS, the Finance Director has identified a certain sum of surplus funds 17 18 available for departments that came in under budget in prior fiscal years; and 19 20 WHEREAS, a portion of the Public Works/Urban Management Division allocation of said 21
22 surplus funds shall be used for the purchase of said equipment. 23

2 [To Authorize the Mayor to Enter into a Planned Service Agreement with Johnson Controls, 3 Inc. to Provide HVAC Preventative Maintenance Services for City Facilities through the NJPA 4 Purchasing Cooperative at an Annual Cost Not to Exceed $76,095.00.] 5 6
{Sponsored By: Councilor Jackson} 7 8 WHEREAS, in Resolution Book 2017, Page 174, adopted on September 5, 2017, the 9 10 City Council approved a Planned Service Agreement with Johnson Control, Inc. to provide 11
12 HVAC preventative maintenance services for the city facilities for a period of three (3) years 13 14 beginning October 1, 2017; and 15 16
WHEREAS, said agreement is set to expire on September 30, 2020; and 17 18 WHEREAS, the Public Works/Facilities Maintenance Division has identified a need to 19 20 continue with a new HVAC preventative maintenance service agreement for city facilities; and 21
22 WHEREAS, Johnson Controls, Inc. has the ability to provide said preventative 23 24 maintenance services through NJPA Contract #02-55; and 25 26
WHEREAS, under said service agreement, Johnson Controls, Inc. shall provide 27 28 premium preventative maintenance service for 26 facilities and provide basic preventative 29 30 maintenance service for 4 facilities; and 31

WHEREAS, said services shall be provided at the following annual cost: 33 34 October 1, 2020 – September 30, 2021 $71,726.78 35 October 1, 2021 – September 30, 2022 $73,879.00 36
October 1, 2022 – September 30, 2023 $76,095.00 37
38 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 39 40 that the Mayor is authorized to enter into a Planned Service Agreement with Johnson 41

Controls, Inc. to provide preventative maintenance services and that the Mayor is hereby 43 44 authorized to sign any and all documents necessary to execute said agreement. 45 46
BE IT FURTHER RESOLVED that funds in an amount listed above are hereby 47
48 authorized and approved to be paid to Johnson Controls, Inc. for said services and funds 49 50 are hereby approved and appropriated to be paid in quarterly payments from Budget Line 51

7 WHEREAS, Alabama Power Company installed lighting at Jasmine Trail Park (now 8 9 known as Miller Park), located at 566 Jasmine Trail, in 2009; and 10 11
WHEREAS, said lighting included twenty-two (22) 16’ black fluted concrete poles with 12 13 acrylic acorn lights and one (1) floodlight; and 14 15 WHEREAS, the City of Prattville has paid a monthly fee to Alabama Power Company 16
17 since said lights were installed; and 18 19 WHEREAS, the City desires to purchase said light fixtures from Alabama Power 20 21
Company “as-is” at a cost not to exceed $66,672.00. 22 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 24 25 that funds in an amount not to exceed $66,672.00 are hereby authorized and approved to be 26
