WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2020-A, Page 118, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
October 6, 2020, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 56

weeds on the property listed above cut or removed using city forces or private contractors. 58

Any property owner shall have the right to have any weeds removed at his or her own 60

expense provided the removal is done prior to the commencement of work by employees or 62
63
agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 64
removal of overgrown grass and weeds and report such cost to the City Council following 1

Ordinances a public hearing shall be set to allow public comment for licenses including 10

WHEREAS, Healthy Me, LLC d/b/a Bella Vista by the Creek, located at 153 West 14

WHEREAS, in Resolution Book 2019, Page 012, on February 5, 2019, the City 10
11
Council authorized the Mayor to negotiate and enter into a Lease Agreement with the 12
13
Community Development Institute (CDI) Head Start for the facility located at 869 Jensen 14
15
Road; and 16
17
WHEREAS, said Lease Agreement was fully executed on August 1, 2019, for an 18
19
initial fifteen-year term, with two five-year extensions; and 20
21
WHEREAS, said Lease Agreement allowed CDI Head Start to lease and renovate the 22
23
facility as the interim grantee for the Head Start Program as funded by the Administration for 24
25
Children and Families (ACF); and 26
27
WHEREAS, said Lease Agreement provided that CDI Head Start could assign its 28
29
rights, duties, and obligations under the Lease at any time to a replacement grantee selected 30
31
by ACF to operate the Head Start/Early Head Start Program at said facility; and 32
33
WHEREAS, ACF has selected the Family Guidance Center of Alabama, Inc. as the 34
35
replacement grantee for said facility. 36

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 38
39
that the Mayor is hereby authorized to enter into said Assignment and Assumption of Lease 40
41
Agreement between the Community Development Institute Head Start, the Family Guidance 42
43
Center of Alabama, Inc., and the City of Prattville for the facility located at 869 Jensen Road. 44

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 46
47
all documents necessary to carry out the intent of this Resolution. 48

account, by contract, or both, a section of road included in the City of Prattville road system 13

Avenue from SR-3 (US-31) to Jasmine Trail; and 18

WHEREAS, transportation funds are available to the City through the Montgomery 20
21
MPO; and 22

WHEREAS, the Director of ALDOT is authorized to sub-allocate federal transportation 24
25
funds to the City. 26

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 28

WHEREAS, the City of Prattville Public Works/Sanitation Division has a need to 9

continue single stream recycling of solid waste; and 11
12
WHEREAS, the existing agreement with RePower South Montgomery, LLC has expired 13
14
due to a rate change; and 15
16
WHEREAS, the Public Works/Sanitation Division drafted specifications and let bids 17
18
for said project; and 19
20
WHEREAS, one (1) sealed bid was received, opened, and read on September 28, 2020 21
22
at 10:00 a.m. and RePower South Montgomery, LLC was the lowest responsible bidder with a 23
24
unit cost of $40.00 per ton; and 25
26
WHEREAS, this is a budgeted expense of the Public Works/Sanitation Division. 27
28
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 29
30
Bid No. 020-012 is hereby awarded to RePower South Montgomery, LLC for single stream 31
32
recycling of solid waste at a unit cost of $40.00 per ton and said funds are approved and 33
34
appropriated from Budget Line Item Sanitation Enterprise Fund/Tipping Fees. 35
36
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to enter into a Solid 37
Waste Supply Agreement with RePower South Montgomery, LLC under the terms as set 38
forth in the bid for a three-year period, with the ability to renew the agreement if there are no 39
material changes to the agreement. 40
BE IT FURTHER RESOLVED that the Mayor and City representatives are authorized 41
to execute and deliver, or attest, any document necessary to carry the intent of this 42
Resolution. 43

WHEREAS, §11-43-85, Code of Alabama, 1975, as amended, requires the City to 8

conduct an annual audit of the City’s finances; and 10
11
WHEREAS, Jackson Thornton & Co., P.C. will best serve as auditors to provide the 12
13
City with the necessary expertise; and 14
15
WHEREAS, §41-16-51(a)(3) Code of Alabama, 1975, as amended, allows contracts to 16
17
secure services with consultants possessing a high degree of professional skill, including 18
19
certified public accountants, to be let without competitive bidding; and 20
21
WHEREAS, the City of Prattville desires that the City’s Fiscal Year 2020 audit service 22
23
be awarded to the firm of Jackson Thornton & Co., P.C. 24
25
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 26
27

BE IT ORDAINED by the City Council of the City of Prattville that Chapter 26 9
10
Fire\ Prevention and Protection, Article II – Fire Prevention Code, Section 26-42. Code 11
12
Adopted; Penalty, of the Code of Ordinances of the City of Prattville is hereby amended 13
14
to read as follows: 15
16
Sec. 26-42. - Code adopted; penalty. 17
The International Fire Code, 2015 edition as revised, consisting of chapters 1—67 and Appendices A—I, K 18
and L published by the International Code Council, Inc., at least one copy of which is on file in the city clerk's 19
office, which provides rules and regulations for fire prevention standards be and the same is hereby adopted 20
and incorporated herein by reference. When a provision of the International Fire Code is in conflict with a 21
provision of the National Fire Protection Association (NFPA) standards, and the conflict relates to life and 22
building safety performance requirements, the fire chief shall have the discretion to determine which provision 23
shall apply. 24
Amendments to the International Fire Code are as follows: 25
506.1.3 All devices shall be installed and maintain at the owner/occupant’s expense. 26
507.5.1.1.1 Hydrant for fire sprinkler systems. Buildings equipped with a FDC (Fire Department 27
Connection) for a fire sprinkler system installed in accordance with Section 903 shall have a fire hydrant 28
within 150 feet of the FDC. 29
Exception: The distance shall be permitted to exceed 150 feet where approved by the fire code official. 30
903.3.7.1 Where sprinkler systems are installed and are required by code to have an (FDC) Fire 31
Department Connection, all F.D.C.'s shall be 2½ inch national Standard Threads. 32
903.3.8 Fire Department Connections. Where sprinkler systems are installed and are required by code to 33
have an (FDC) Fire Department Connection, all F.D.C.'s shall be 2½ inch national Standard Threads. 34
903.4.2 Alarms. An approved audible and visual device, located on the exterior of the building in an 35
approved location, shall be connected to each automatic sprinkler system. Such sprinkler water-flow alarm 36
devices shall be activated by water flow equivalent to the flow of a single sprinkler of the smallest orifice 37
size installed in the system. Where a fire alarm system is installed, actuation of the automatic sprinkler 38
system shall actuate the building fire alarm system. 39
904.11.6.4 Commercial Hoods with Fire Suppression Systems. All systems shall be installed and 40
maintained in accordance with applicable codes and standards. All new installations, annual and semi-41
annual services (and when required by code or manufacturer recommendations) shall install new fusible 42
links and CO2 cartridges with devices dated and stamped by the manufacture, with the same year date as 43
the installation or service is taking place. 44
2306.2.2 Above-ground tanks located inside buildings. Above-ground tanks for the storage of class I, II, IIIA 45
liquid fuels are prohibited within the entire city. 46
2306.2.3 Above-ground tanks located outside buildings. Above-ground tanks for the storage of class I, II, 47
IIIA liquid fuels outside of buildings are prohibited except in the following locations. Aboveground storage 48
tanks shall be allowed at the Prattville Airport and in properties zoned M2 and such storage is used in 49
conjunction with those facilities and is necessary for manufacturing and/or processing for those facilities. In 50
M2 properties, aboveground storage shall be allowed only in Protected above Ground Tanks as defined in 51
NFPA 30. 52
The applicant shall provide to the City Planning/Building Department, City Engineer, Fire Chief, and 53
Director of the Autauga County Emergency Management detailed plans and specifications showing compliance 54
to the most current edition of NFPA 30 and compliance with the currently adopted International Fire Code as 55
well as any other state and/or federal laws that may apply. Inspections by the above stated departments shall be 56
conducted to verify code compliance before storage tanks may be filled with any product. 57
Appendix B is amended as follows: 58
Section B105 - FIRE-FLOW REQUIREMENTS FOR BUILDINGS 59
B105.1 One- and two-family dwellings, Group R-3 and R-4 buildings and townhouses. The minimum fire-60
flow and flow duration requirements for one- and two-family dwellings, Group R-3 and R-4 buildings and 61
townhouses shall be specified in Chapter 26 - FIRE PREVENTION AND PROTECTION, Sec. 26-100. - 1
Installation requirements of the city ordinance. 2
Delete Table B105.1(1). 3
Appendix D is amended as follows: 4
Section - D107 ONE- OR TWO-FAMILY RESIDENTIAL DEVELOPMENTS 5
D107.2 Remoteness. Where two fire apparatus access roads are required, they shall be placed a distance 6
apart equal to not less than one-half of the length of the maximum overall diagonal dimension of the 7
property or area to be served, measured in a straight line between accesses. 8
Exception: Where a condition exists that the remoteness requirements in D107.2 cannot be met, approval 9
will be at the discretion of the Planning Commission. 10

ALL other provisions of these Chapters of the Code of Ordinances not herein amended 12
13
shall remain in full force and effect. 14

This Ordinance shall become effective upon its passage and execution as 16
17
provided by law. 18
