[To Authorize the Mayor to Have Various Weeded Lots Abated per Title 11, Chapter 67 of the 3
Code of Alabama, 1975, as Amended.] 4

WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2020-A, Page 125, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
October 20, 2020, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 1

weeds on the property listed above cut or removed using city forces or private contractors. 3
4
Any property owner shall have the right to have any weeds removed at his or her own 5
6
expense provided the removal is done prior to the commencement of work by employees or 7
8
agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 9
10
removal of overgrown grass and weeds and report such cost to the City Council following 11
12
their removal. 13

and weeds at the above listed address to be a public nuisance; and 34
2. the owners of said property, as they appear in the records of the Autauga County 35
Revenue Commissioner, are ordered to abate the abundance of overgrown grass and 36
weeds; and 37
3. the owners of said property are ordered to appear before the City Council of the City of 38
Prattville at a public hearing at 6:00 p.m. on November 17, 2020, in Prattville City Hall. 39
Notice of such hearing shall be sent by certified mail to owners of said property. 40

WHEREAS, the City of Prattville, Alabama, has certain items of personal property 8

which are no longer needed for public or municipal purposes; and 10

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the 12
13
municipal governing body to dispose of unneeded personal property. 14
15
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 16
17
that the following personal property owned by the City of Prattville, Alabama, is no longer 18
19
needed for public or municipal purposes and said property shall be removed from the 20
21
inventory of the Public Works Department: 22
23
Metal Building (formerly used as Superintendent/Foreman Building) 24
located at 530 Doster Road 25

BE IT FURTHER RESOLVED that the City Council of the City of Prattville instructs 27

WHEREAS, City of Prattville City Clerk Cathy Dickerson shall retire from her position 7

effective November 1, 2020; and 9

WHEREAS, the 2020-2024 Quadrennium shall begin on November 2, 2020; and 11

WHEREAS, the City Council appoints the City Clerk in accordance with §11-43-3 of 13
14
the Code of Alabama, 1975, as amended; and 15
16
WHEREAS, the Human Resources Department and City Council are in the process of 17
18
conducting a hiring process for said position; and 19
20
WHEREAS, there is a need to appoint an Interim City Clerk until said hiring process is 21
22
complete and the City Council appoints a City Clerk for the Quadrennium. 23

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 25

that Assistant Clerk Jamie Clayton shall be appointed as Interim City Clerk effective 27

WHEREAS, the City of Prattville, Alabama is interested in applying under Alabama 8

Department of Transportation’s, FY2021 Alabama Transportation Rehabilitation and 10

Improvement Program – II (ATRIP-II) Annual Grant Program for US Highway 31/AL 12
13
Highway 3 Traffic Smoothing Improvements, and 14
15
WHEREAS, Civil Southeast has the staff and expertise to prepare the City of 16
17
Prattville’s application and perform the required engineering design for this project. 18
19
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 20
21
that an ATRIP-II grant application be submitted to ALDOT and that the Council commits to 22
23
covering all costs associated with the design of this project separate from the ATRIP-II 24
25
funds allocated by ALDOT for this project. 26
27
BE IT FURTHER RESOLVED that City Council hereby authorizes the Mayor to 28
29
execute all documents required by the application. 30

WHEREAS, OMSHIV, LLC d/b/a Corner Package Store has applied for a Lounge 8

Retail Liquor –Class II (Package Store) License for a business located at 790 E. Sixth Street, 10

Prattville, Alabama 36067; and 12

WHEREAS, a public hearing was set by Resolution Book 2020-A, Page 126, and held 14
15
October 20, 2020, at 6:00 p.m. and that at such time and place all persons who desired had 16
17
an opportunity to be heard in favor of or in opposition to such Resolution. 18
19
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 20
21
hereby approves the issuance of a Lounge Retail Liquor -Class II (Package Store) License 22
23
for the business located at 790 E. Sixth Street, Prattville, Alabama 36067, to OMSHIV, LLC 24
25
d/b/a Corner Package Store. 26

WHEREAS, the City of Prattville identified the need to relocate a manhole near the 8
9
intersection of U. S. Highway 82 and Washington Ferry Road due to widening of 10
11
U.S. Highway 82; and 12
13
WHEREAS, the City of Prattville Public Works/Wastewater Division had plans and 14
15
specifications drafted for said project; and 16
17
WHEREAS, four (4) sealed bids were received, opened, and read on September 29, 18
19
2020, at 10:00 a.m. and L & K Contracting Company, Inc. was the lowest responsible bidder 20
21
with a cost of $166,936.00. 22
23
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 24
25
that Bid No. 020-008A for said U.S. Highway 82 Utility Relocation Project is hereby awarded 26
27
to L & K Contracting Company, Inc. in the amount of $166,936.00 and said funds are approved 28
29
and appropriated from Wastewater Enterprise Fund/Street-Sewer Line budget line item. 30
31
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and all 32
33
documents necessary to have this work performed for and on behalf of the City of Prattville. 34

Full Weekend of February 2021, as Authorized by Act 2012-256, Generally Referred to as the 4
“State Severe Weather Preparedness Sales Tax Holiday” Legislation.] 5

BE IT ORDAINED by the City Council of Prattville, Alabama, as follows: 9

Section 1. In conformity with the provisions Act 2012-256 enacted by the Alabama 11
12
Legislature during the 2012 Regular Session, providing for a State Severe Weather 13
14
Preparedness Sales Tax Holiday, the City of Prattville, Alabama, exempts “covered items” 15
16
from municipal sales and use tax during the same period, beginning at 12:01 a.m. on Friday, 17
18
February 26, 2021 and ending at twelve midnight on the following Sunday, February 28, 19
20
2021. 21

Section 2. This ordinance shall be subject to all terms, conditions, definitions, time periods, 23
24
and rules as provided by Act 2012-256, except that the time period shall only be as specified 25
26
in Section 1 above and not for all years thereafter. 27
28
Section 3. The City Clerk is hereby authorized and directed to certify a copy of this 29
30
ordinance under the seal of the City of Prattville, Alabama, and to forward said certified copy 31
32
to the Alabama Department of Revenue to be recorded and posted on the Department 33
34
website. 35

Section 4. This ordinance shall become effective upon its passage and publication as 37
38
required by law. 39

BE IT ORDAINED by the City Council of the City of Prattville that City of Prattville 9

Code of Ordinances, Chapter 66-Utilities, Article IV-Solid Waste, Division 2-Municipal 11
12
Collection and Disposal Service, Section 429-Schedule of Service Changes is hereby 13
14
amended to read as follows: 15
16
Sec. 66-429. - Schedule of service changes. 17
For services to be rendered monthly, and on the first day of each month and continuing monthly thereafter, the 18
following charges shall be paid to the city by every household for the collection, hauling, and depositing of 19
garbage and trash: 20
21
(1) Residential charges: 22
(a)$20.00 per unit, effective January 1, 2021 and $21.00 per unit, effective October 1, 2021. 23
(b) There will be an additional $10.00 charge per month, for any occupant placing two containers on the 24
curb or street for pickup. 25
26
(2) Business establishment charges: 27
(a) $20.00 per month effective January 1, 2021 and $21.00 per month effective October 1, 2021 for each 28
business using two approved containers or approved bags, not to exceed a 30-gallon capacity each; and 29
$20.00 per month effective January 1, 2021 and $21.00 per month effective October 1, 2021 for each 30
additional can or approved bag used. 31
(b) Business establishments requiring bulk collection of containers, crates, baskets, etc., shall pay in 32
addition to the charge set forth in subsection (2)(a) of this section $20.00 effective January 1, 2021 and 33
$21.00 effective October 1, 2021 for each 30-gallon capacity container or bag used. 34

This ordinance shall become effective upon its passage and execution as provided by 36
37
law. Each of the provisions of this ordinance are severable; and if any provision shall be 38
39
declared to be invalid, the remaining provisions shall not be affected but shall remain in full 40
41
force. All ordinances, or parts of ordinances, in any manner conflicting here with are hereby 42
43
repealed. 44
