WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2020-A, Page 148, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
November 3, 2020, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 57

Any property owner shall have the right to have any weeds removed at his or her own 61

expense provided the removal is done prior to the commencement of work by employees or 1

agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 3
4
removal of overgrown grass and weeds and report such cost to the City Council following 5
6
their removal. 7

WHEREAS, the City of Prattville City Council and the Autauga County Commission 7

appoint a one-year rotating term on the Autauga-Prattville Public Library Board; and 9

WHEREAS, a vacancy currently exists on the Library Board due to the term expiration 11
12
of Steve Burton as the county appointee for a one-year term on November 30, 2020; and 13
14
WHEREAS, it is the desire of the Prattville City Council to ensure the continuity of 15
16
the Board’s operation. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 19
20
that Steve Burton is hereby re-appointed for a one-year term to the Autauga-Prattville Public 21

WHEREAS, the City of Prattville, Alabama is interested in applying under Alabama 8

Department of Transportation’s Rebuild Alabama Act (RAA) Annual Grant Program for 10

roadway improvements along various roadways, and 12

WHEREAS, Civil Southeast, LLC has the staff and expertise to prepare said 14
15
application for the City of Prattville. 16

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 18
19
that an application be submitted to ALDOT and that the Council commits to all matching 20
21
funds and engineering cost and authorizes the Mayor to execute all documents required by 22
23

WHEREAS, the Certified Local Government Program was established by the National 8

Park Service to help communities save the irreplaceable historic character of places; and 10

WHEREAS, the Alabama Historical Commission is the state administrator of the 12
13
Certified Local Government program; and 14

WHEREAS, the City of Prattville desires to participate in the program in order to 16
17
identify, evaluate, and protect cultural resources; and 18
19
WHEREAS, the City has submitted an application and request for certification to the 20
21
Alabama Historical Commission; and 22
23
WHEREAS, the Alabama Historical Commission has reviewed the application and 24
25
evaluated the City and determined the City satisfies the requirements of the program. 26
27
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 28

that the Mayor is hereby authorized to enter into an agreement with the Alabama Historical 30
31
Commission to become a member of the Certified Local Government program. 32

WHEREAS, the Declaration of Independence affirms that all people are created equal 9
10
and have been endowed by the Creator with unalienable rights, chief among them the right to 11
12
life, and that the protection of these rights is an affirmative duty of federal, state and local 13
14
governments; and 15
16
WHEREAS, the Fifth and Fourteenth Amendments to the United States Constitution 17
18
provide for the protection of human life and liberty; and 19
20
WHEREAS, the Supreme Court of the United States in Poelker v. Doe (432 US 519, 21
22
1977) concluded that ''the Constitution does not forbid a state or city, pursuant to democratic 23
24
processes, from expressing a preference for normal childbirth" instead of abortion; and 25
26
WHEREAS, state police power derives from the Tenth Amendment to the United 27
28
States Constitution, which gives states the powers "not delegated to the United States," and 29
30
WHEREAS, the power to establish and enforce laws protecting the welfare, safety, 31
32
and health of the public is a core function of the state's police power; and 33
34
WHEREAS, this City desires to express its deep concern that all human beings, at 35
36
every stage of development, including before birth, in the City of Prattville should be afforded 37
38
protection from acts of cruelty, and be treated humanely and with dignity. 39

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Prattville 41

1. the City of Prattville hereby recognizes and declares the humanity of the pre-born child and 45
urges the citizens of Prattville to encourage the humane treatment of all human beings, 46
including the preborn child, as well as to promote and defend the dignity of all human life. 47

2. Based upon the desire to be recognized as a safe city for pre-born children, the City 49
Council hereby declares the City of Prattville to be a "Safe City for Preborn Children." 50

WHEREAS, six (6) sealed bids were received, opened, and read on October 27, 2020, 17

at 2:00 p.m. and Clements Dean Building Company, LLC was the lowest responsible bidder 19

with total cost not to exceed: 21

funds are approved and appropriated from budget line item Capital Projects Fund/Mac Gray 33

WHEREAS, the Governmental Accounting Standards Board (“GASB”) sets 9
10
accounting standards for state and local governments and issues statements setting forth 11
12
such standards; and 13
14
WHEREAS, GASB Statement 75 requires state and local governments providing 15
16
other post-employment benefits (“OPEB”) to account for and report such benefits in 17
18
accordance with GASB guidelines; and 19
20
WHEREAS, an actuarial valuation is required to comply with GASB Statement 75; 21
22
and 23
24
WHEREAS, the City of Prattville provides OPEB in the form of retiree participation in 25
26
the City’s health insurance plan; and 27
28
WHEREAS, the City is thereby required to have an actuarial valuation of its OPEB 29
30
liability in order to comply with the requirements of GASB Statement 75; and 31
32
WHEREAS, Fontenot Benefits & Actuarial Consulting (FBAC) has the expertise to 33
34
perform said services at a cost not to exceed $6,000.00 to be billed over a two-year period; 35
36
and 37
38
WHEREAS, this is a budgeted expense for the Finance Department. 39
40
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of 41
42
Prattville that funds in an amount not to exceed $6,000.00 are hereby authorized and 43
44
approved to be paid to FBAC and said funds in the amount of $3,000.00 are hereby approved 45
46
and appropriated from FY2021 Budget Line Item Finance Department/Accounting. 47

THAT the Zoning ordinance of the City of Prattville, Alabama adopted on February 10, 5

1950, subsequently amended from time to time, and the zoning map adopted on the 1st day 7
8
of May, 1987, are hereby amended to reclassify the property described in Attachment “A” as 9
10
R-3, Single Family Residential; and 11
12
THAT this proposed ordinance was advertised for two (2) weeks in the Prattville 13
14
Progress, a newspaper of general circulation within the City Limits of the City of Prattville, 15
16
and that the City Council of the City of Prattville, at its Public Hearing on the 1st day of 17
18
December, 2020 at 6:00 p.m., considered said proposed ordinance and that at such time and 19
20
place all persons who desired had an opportunity to be heard in favor of or in opposition to 21
22
such ordinance. 23

THAT this ordinance is adopted under the authority of §11-52-85 of the Code of 25
26
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to 27

annex property described in Attachment “A” into the City of Prattville no later than 180 days 29

WHEREAS, the City of Prattville owns property on Challenge Avenue, Prattville, AL 10

36067 as described in “Attachment A” and located within the City of Prattville Industrial 12
13
Development Park; and 14

WHEREAS, Verizon Wireless of the East d/b/a Verizon Wireless desires to lease said 16
17
property for the purpose of installing, maintaining and operating communications equipment; 18
19
and 20
21
WHEREAS, the City of Prattville desires to enter into an agreement to lease said 22
23
property to Verizon Wireless; and 24
25
WHEREAS, City of Prattville Ordinance Book 5, Page 404, adopted September 2, 26
27
1986, established certain covenants and restrictions for the use of the land within the 28
29
Industrial Development Park; and 30
31
WHEREAS, Ordinance Book 5, Page 404 authorized the City to waive said covenants 32
33
and restrictions when it is determined that such waiver or variances will not be detrimental to 34
35
the Industrial Development Park concept; and 36
37
WHEREAS, the City of Prattville has determined that waiving said covenants and 38
39
restrictions will not be detrimental to the Industrial Development Park concept. 40

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 42
43
that the covenants and restrictions are hereby waived for this project as provided by 44
45
Ordinance Book 5, Page 404. 46

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to enter into said 48
49
Land Lease Agreement with the Verizon Wireless of the East d/b/a Verizon Wireless for the 50
51
installation, maintenance and operation of communications equipment at the property located 52
53
on Challenge Avenue. 54

BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor 56

to execute any and all documents necessary to carry out the intent of this Resolution. 58
