WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2020-A, Page 186, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
December 15, 2020, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 50

weeds on the property listed above cut or removed using city forces or private contractors. 52

Any property owner shall have the right to have any weeds removed at his or her own 54
55
expense provided the removal is done prior to the commencement of work by employees or 56
57
agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 58
59
removal of overgrown grass and weeds and report such cost to the City Council following 60
61
their removal. 62

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 9

THAT the Zoning ordinance of the City of Prattville, Alabama adopted on February 10, 11
12
1950, subsequently amended from time to time, and the zoning map adopted on the 1st day 13
14
of May, 1987, are hereby amended to reclassify the property described in Attachment “A” as 15
16
R-3, Single Family Residential; and 17
18
THAT this proposed ordinance was advertised for two (2) weeks in the Prattville 19
20
Progress, a newspaper of general circulation within the City Limits of the City of Prattville, 21
22
and that the City Council of the City of Prattville, at its Public Hearing on the 1st day of 23
24
December, 2020 at 6:00 p.m., considered said proposed ordinance and that at such time and 25
26
place all persons who desired had an opportunity to be heard in favor of or in opposition to 27
28
such ordinance. 29

THAT this ordinance is adopted under the authority of §11-52-85 of the Code of 31
32
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to 33
34
annex property described in Attachment “A” into the City of Prattville no later than 180 days 35

following adoption of the Ordinance. 37

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that the City of 9

Prattville is a city with a population of over 6,000 inhabitants located in the State of Alabama; 11
12
and 13
14
THAT a petition has been presented by all owners of property located and contained 15
16
which are contiguous to the corporate limits of the City of Prattville as they are now situated; 17
18
and 19
20
THAT the property described in the petition sought to be annexed is as described in 21
22
Attachment A; and 23
24
THAT said property does not lie within the Corporate limits of any other municipality; 25
26
and 27
28
THAT all owners as defined by §11-42-20, Code of Alabama, 1975, as amended, have 29

executed said petition requesting the property be annexed into the City of Prattville; and 31

THAT the City of Prattville finds that it is in the best interest of the City of Prattville and 33

WHEREAS, there is growing concern over the City’s capacity to support multi-family 8
9
developments; and 10
11
WHEREAS, the City of Prattville initiated the process to update the comprehensive 12
13
plan and re-write the zoning ordinance on February 4, 2020, which has included 14
15
community meetings, assessments, population projections, and market study; and 16
17
WHEREAS, a first draft of the updated comprehensive plan, Project Prattville 2040, 18
19
was presented to the City Council and Planning Commission for review on November 20
21
19, 2020; and 22
23
WHEREAS, the process to re-write the zoning ordinance will commence after the 24
25
comprehensive plan is adopted; and 26
27
WHEREAS, the City Council desires to halt further construction of multi-family 28
29
developments until the comprehensive plan and new zoning ordinance are both completed 30
31
and adopted. 32
33
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville 34
35
that in order to protect the public health, safety, and welfare, it is in the best interest of the 36
37
City to declare a temporary moratorium on the issuance of building permits or other approval 38
39
for any multi-family or apartment development consisting of three or more dwelling units, in 40
41
order for the City to complete the comprehensive plan and zoning ordinance re-write. 42
43
BE IT FURTHER ORDAINED that this moratorium shall be effective upon passage 44
45
and publication and shall continue through April 30, 2021, unless terminated or extended by 46
47
action of the City Council. Provided however, that multi-family developments that have 48
49
received an approved building permit prior to the effective date of this ordinance may proceed 50
51
as allowed by the terms of the permit and applicable rules and regulations. 52

WHEREAS, the City of Prattville Fire Department has a need for ambulance 8

collection and billing services and the current agreement is due to expire; and 10
11
WHEREAS, the Fire Department let bids for said services; and 12
13
WHEREAS, nine (9) sealed bids were received, opened and read in public on 14
15
November 20, 2020 at 10:00 a.m. and Professional Practice Support, Inc. was the 16
17
lowest responsible bidder with a rate of 4.25% of net collections; and 18
19
WHEREAS, net collections are defined as total cash collections less refunds. 20
21
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 22
23
Prattville hereby awards Bid No. 020-015 for ambulance billing and collection services to 24
25
Professional Practice Support, Inc. 26
27
BE IT FURTHER RESOLVED that the Mayor is hereby authorized and directed to 28
29
enter into an agreement with Professional Practice Support, Inc. under the terms as set 30
31
forth in the bid for a period not to exceed three (3) years. The Mayor is hereby authorized 32
33
to execute any and all documents necessary to carry out the intent of this resolution. 34
35
BE IT FURTHER RESOLVED by the City Council that Professional Practice 36
37
Support, Inc.’s services are to be paid from net collections received for ambulance billing 38
39
and collection services and not as a direct line item expenditure. 40

WHEREAS, the City of Prattville Fire Department has identified a need for one 9

(1) 2021 Chevrolet Tahoe 4WD; and 11

WHEREAS, said vehicle is available through the State Bid Contract No. T191L 13
14
from Donohoo Chevrolet, LLC at a cost not to exceed $36,742.00; and 15
16
WHEREAS, the Finance Director has identified a certain sum of surplus funds 17
18
available for departments that came in under budget in prior fiscal years; and 19
20
WHEREAS, a portion of the Fire Department allocation of said surplus funds shall 21
22
be used for the purchase of said vehicle. 23

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 25
26
that funds in an amount not to exceed $36,742.00 for the purchase of said vehicle are 27
28
hereby authorized and approved to be paid to Donohoo Chevrolet, LLC and said funds are 29
30
approved and appropriated from FY2021 Budget Line Item Fire/Capital Outlay. 31
