RESOLUTION
[To Authorize the Mayor to have Various Weeded Lots Abated per Title 11, Chapter 67 of the
Code of Alabama, 1975, as Amended.] {Sponsored By: Council President Starnes}
WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property; and 4. may also pose a fire hazard and respiratory hazard; and WHEREAS, the City Council of the City of Prattville declared in Resolution Book
2021, Page 036, that the abundance of overgrown grass and weeds at various addresses in the City of Prattville constituted a public nuisance and set a public hearing to discuss said
nuisances; and
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, was provided in The Prattville Progress, by certified mail, and by signage on the subject
property; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
said properties and determined that the public nuisance still exists; and WHEREAS, the City Council held the required public hearing at 6:00 p.m. on March 16, 2021, permitting the owners of said properties to present evidence, objections,
and protest regarding the proposed removal of weeds. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Prattville declares that the abundance of overgrown grass and weeds on the properties continue to be a public nuisance:
• 609 Allenville Road - Allen, Anthony c/o Walter Dolan, 609 Allenville Road, Prattville
AL 36067 (19-03-07-4-001-011.000)
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds on the property listed above cut or removed using city forces or private contractors.
Any property owner shall have the right to have any weeds removed at his or her own expense provided the removal is done prior to the commencement of work by employees or agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the
removal of overgrown grass and weeds and report such cost to the City Council following their removal.

exceed $9,309.99; and WHEREAS, this is a budgeted expense for the Parks and Recreation
Department. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Prattville that funds in an amount not to exceed $9,309.99 for the purchase of said Toro
Grand Stand 25HP Koh Command Pro 60” with Recycler Kit GM 3300 are hereby authorized to be paid to Prattville Outdoors, and said funds are approved and

WHEREAS, the City desires to retain Local Government Services, LLC to assist with preparing correspondence associated with negotiating for a new Gas Franchise
Agreement between the City of Prattville and Spire Alabama; and
WHEREAS, said services are available from Local Government Services, LLC at an anticipated cost of $5,000.00; and
WHEREAS, said agreement cost is a budgeted expense of the Finance Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Prattville that funds in an amount not to exceed $5,000.00 are hereby authorized and approved to be paid to Local Government Services, LLC for said services and said

WHEREAS, the City of Prattville sponsors the July 4th Fireworks Display
Program on an annual basis; and WHEREAS, bids were let for the Parks and Recreation/Performing and Creative
Arts Division for the July 4, 2021 Fireworks Display Program; and WHEREAS, one (1) bid was received, opened, and read in public on March 4,
2021 at 10:00 a.m. and J & M Displays, Inc. was the lowest responsible bidder at a cost
of $23,500.00; and WHEREAS, said program is a budgeted expense of the Performing and Creative
Arts Division. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Prattville hereby awards Bid No.021-004 at a cost of $23,500.00 to J & M Displays, Inc.,
for the July 4, 2021 Fireworks Display Program and said funds are approved and appropriated from FY2021 Budget Line Item Performing and Creative Arts/
Independence Day Parade & Fireworks. BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and

[To Set a Public Hearing to Rezone Property Located at Old Farm Lane and Rocky Mount
Road, north of High Point Town Center from FAR (Forest, Agricultural and Recreation) to R-3 (Single Family Residential); (Owner/Petitioner: Anna Thrash).] {Sponsored By: Councilor Gornto}
WHEREAS, Anna Thrash is the owner of the property described in Attachment “A”; and
WHEREAS, the property to be rezoned is located inside the city limits at Old Farm
Lane and Rocky Mount Road, north of High Point Town Center; and WHEREAS, the petitioner wishes to rezone the property from FAR (Forest,
Agricultural and Recreation) to R-3 (Single Family Residential); and WHEREAS, a public hearing on the proposed rezoning was held by the Prattville
Planning Commission on February 18, 2021; and
WHEREAS, the City of Prattville Planning Commission did recommend the rezoning of said property be amended as described in Attachment “A” from FAR (Forest, Agricultural
and Recreation) to R-3 (Single Family Residential). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Prattville that a Public Hearing is set for April 20, 2021 at 6:00 p.m. in the Council Chambers at City Hall. STOP AND VOTE TO ADOPT THE RESOLUTION, THEN READ THE ORDINANCE ON THE NEXT PAGE PROPOSED ORDINANCE Pursuant to the requirements of Title 11-52-77, Code of Alabama, 1975, as amended. Notice

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: THAT the zoning ordinance of the City of Prattville, Alabama adopted on February 10,
1950, subsequently amended from time to time, and the zoning map adopted on the 1st day of May, 1987, are hereby amended to reclassify the property described in Attachment “A” from FAR (Forest, Agricultural and Recreation) to R-3 (Single Family Residential); and
THAT this proposed ordinance and a synopsis was advertised for two (2) weeks in the Prattville Progress, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on the 20th day of April, 2021 at 6:00 p.m., considered said proposed ordinance and that at such time and place all persons who desired had an opportunity to be heard in favor of or in
opposition to such ordinance. ALL other items and provisions of the zoning ordinance of the City of Prattville not
herein specifically amended shall remain in full force and effect. THE amendments herein contained were considered and recommended by the City of Prattville Planning Commission on February 18, 2021.
THIS ordinance shall become effective upon its passage and execution as provided by law.

WHEREAS, said engineering services are available from Larry E. Speaks & Associates, Inc. at a cost not to exceed $75,000.00; and
WHEREAS, 41-16-51(a)(3) Code of Alabama, 1975, as amended, allows
contracts to secure services with engineers possessing a high degree of professional skill to be let without competitive bidding; and
WHEREAS, said project is a budgeted expense for the Capital Projects
Fund.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Prattville that the Mayor is authorized and empowered to enter into an Agreement with
Larry E. Speaks & Associates, Inc. for said engineering services. BE IT FURTHER RESOLVED that funds in an amount not to exceed $75,000.00 are hereby authorized and approved to be paid to Larry E. Speaks & Associates, Inc. for

WHEREAS, the City of Prattville did legally advertise the bid opening date of
Thursday, March 4, 2021, in accordance with Alabama State Law, and on that date opened all bids in public and read them aloud, and
WHEREAS, two bids were received, and the lowest responsible bidder was McDonald Construction at a cost not to exceed $2,184,884.60; and
WHEREAS, said project is a budgeted expense. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Prattville that the FY2021 Budget is hereby amended as follows:

WHEREAS, the City Council authorized the Mayor to enter into an Economic
Development Agreement between the City of Prattville, Autauga County, the Water Works Board of the City of Prattville, and James Hardie Building Products, Inc. in Resolution
2017, Page 088, adopted on June 6, 2017; and WHEREAS, the City Council authorized the Mayor to enter into a “First Addendum
and Amendment to Project Incentives and Development Agreement” between the City of Prattville, Autauga County, the Water Works Board of the City of Prattville, and James Hardie Building Products, Inc. in Resolution 2018-A, Page 124, adopted on September 4, 2018; and
WHEREAS, a “Second Amendment to Project Incentives and Development Agreement” shall amend and clarify certain provisions of said Economic Development
Agreement; and WHEREAS, a “First Amendment to City of Prattville Tax Abatement Agreement” shall amend and clarify certain provisions of said Economic Development Agreement; and
WHEREAS, only those provisions outlined in the “Second Amendment to Project Incentives and Development Agreement” and “First Amendment to City of Prattville
Tax Abatement Agreement” shall be modified, with all other terms remaining in effect as set forth in the original Development Agreement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes Mayor Bill Gillespie, Jr. to negotiate and execute said “Second Amendment to Project Incentives and Development Agreement” and “First Amendment to
City of Prattville Tax Abatement Agreement”, as well as any and all other documents and agreements necessary to carry out the purposes and intent of this Resolution.
