CITY OF PRATTVILLE PLANNING COMMISSION MINUTES January 21, 2021 Call to order: Chairman Tim Smith called the meeting to order at 3:00 p.m.
Roll Call: Members present were Mayor Bill Gillespie, Councilman Chambers, Chairman Tim Smith, Vice-Chairman Reuben Gardner, Chief Dallis Johnson, Mrs. Paula Carpenter, and Mr. Ken Daniel. Absent: Mr. Seth Hayden and Mr. Mugs Mullins.
(Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Darrell Rigsby, Senior Planner; Mr. Tommie Williams, Planner; and Ms. Alisa Morgan, Secretary.
Minutes: Mr. Gardner moved to approve the minutes of the December 17, 2020 meeting. Councilman Chambers seconded the motion. The motion passed unanimously.
Committee Reports: Mr. Stephens provided an update on the progress of the Comprehensive Plan. Information can be found at
Project Prattville.com. He also introduced the newly appointed Commissioner, Mr. Ken Daniel. He stated that Midtown Oaks Plat 6 sketch plan was postponed at the previous meeting (12/17). The Commission wanted to see additional green space that was not storm water related. The developer has presented a new sketch plan which is on the agenda for discussion. Old Business: 1. Sketch Plan and Zoning Amendment: Henderson Property Location: Henderson Lane & US Highway 31 N Petitioner: William Henderson Representative: Flowers and White Engineering, LLC The petitioner requested that the sketch plan and zoning amendment (agenda items 1 and 2) be withdrawn from the agenda.
Chief Johnson moved to withdraw the sketch plan and rezoning amendment at the petitioner’s request. Mr. Daniel seconded the motion. The motion to withdraw the request passed unanimously.
3. Sketch Plan: Midtown Oaks Plat 6 Location: South of Sunset Drive & Honeysuckle Drive Petitioner: Goodwyn Building Company, Inc. Representative: Goodwyn, Mills, and Cawood, Inc. Mr. Williams provided the staff report for the sketch plan of Midtown Oaks Plat 6. He stated that the developer presented an updated master plan providing green space that can be utilized by the residents. George Goodwyn, petitioner’s representative, presented the sketch plan for Midtown Oaks Plat 6. He discussed the revisions made providing additional greenspace that will include walking trails and gazeebos. He also addressed that the stub out stating that they have no plans to cross the railroad but it is provided to accommodate for future crossing.
After their discussion, the vote was called. The motion to approve passed unanimously.

New Business: 4. Sketch Plan: Thrash Property Sketch Plan Location: Old Farm Lane & Rocky Mountain Road (north of High Pointe shopping center) Owner: Betty Thrash Petitioner: Flowers and White Engineering, LLC. Representative: Flowers and White Engineering, LLC. The petitioner requested that the sketch plan of the Thrash Property be withdrawn. Chief Johnson moved to withdraw at the petitioner’s request. Councilman Chambers seconded the motion. The motion to withdraw passed unanimously. 5. Sketch Plan: Redfield Road Property Location: Eastwood Blvd and Redfield Road Petitioner: Aliant Bank Representative: Flowers & White Engineering, LLC The petitioner requested that the sketch plan of the Redfield Road Property be held until the next meeting.
Mr. Gardner moved to hold until the next meeting at the petitioner’s request. Chief Johnson seconded the motion. The motion to hold passed unanimously. 6. Preliminary Plat: Hightower Plat 1 Location: East side of Upper Kingston Rd north of Upper Kingston & Bridge Creek Rd Split Petitioner: Hightower, LLC Representative: Derek Scott Svejda
Mr. Rigsby provided the staff report for the preliminary plat of Hightower Plat 1. He stated that the plat
proposes to dissolve property lines between two adjoining parcels currently owned by Hightower, LLC, to create a single parcel and also dedicate four (4) feet of the northwestern portions to adjoining property owner to the north.
Derek Svejda, petitioner, presented the preliminary plat for the Hightower Plat 1.
Mark Newman representative of Hightower, LLC also spoke on the preliminary plat providing background information and discussing the need for the 4’ access to be granted for access to rear property.
Chairman Smith opened the floor for public comments. There were none. The public hearing was closed.
Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Hightower
Plat 1 and moved for its approval. Mr. Gardner seconded the motion. The motion to approve passed unanimously. 7. Zoning Amendment: R-4 (Multi-Family Residential) to B-2 (General Business) BVCV Property Location: Old Farm Lane S & Vista Point Blvd. Petitioner: City of Prattville Mr. Stephens presented the zoning amendment for the BVCV Property to be rezoned from R-4, Multi- Family to B-2, General Business. He provided the staff report and background information on the property that was zoned from B-2 to R-4 in July 2019. He stated that the discussion stipulated that the two out parcels would be rezoned back to B-2 and the larger parcel would remain R-4. He stated that

since that approval no action has been made to correct the intended zoning therefore the City is pursuing
to change the zoning to B-2 for all three parcels. Doug Lacey of Clearview Investments, and Justin Pearson of Ball Ventures, LLC, property owner’s
representative, presented their appeal for the property to remain as R-4, explaining that the developer who originally sought approval for the current zoning is no longer involved with developing the property. He stated that they currently have plans to develop the property and it is a good opportunity to benefit
existing business in the adjacent shopping center. Mayor Gillespie expressed his concerns for the undeveloped property at its current R-4 zoning. He encouraged the petitioners to reapply for rezoning of R-4 at the time it will be developed. Chairman Smith opened the floor for public comments. There were none. The public hearing was closed. Councilman Chambers introduced a resolution recommending the approval of the zoning amendment of the BVCV Property Lots A, B, and C from R-4 to B-2 and moved for its approval. Mr. Gardner seconded the motion.
The property owners (Eric Isom) and developers (Joseph Holt) expressed their desire to develop the property and their willingness to correct that which was left undone by the initial developers. They presented a portfolio of designs they have completed in other cities.
In their discussion, the Commission wishes to hold and send to committee for further review and Chairman Smith would like a legal opinion from the city’s attorney on its position of rezoning the
property without the property owner’s consent. Councilman Chambers moved to hold. Chief Johnson seconded the motion. The motion passed by 6/1 vote as recorded. Favor: Councilman Chambers, Chairman Smith, Vice-Chairman Gardner, Chief Johnson, Mrs. Carpenter, and Mr. Daniel. Oppose: Mayor Gillespie. The Planning Commission scheduled a work session for the BVCV Property rezoning for February 4, 2021 at 3:00. Miscellaneous Business:
Mr. Stephens provided an update on the progress of the Project Prattville (Comprehensive Plan).
Congratulations to Commissioners Chief Johnson and Mugs Mullins on their reappointment to the Commission. Adjourn: There being no other business, the meeting was adjourned at 4:42 p.m.

Staff Comments:
This sketch plan proposes to subdivide 18.01 acres into a residential subdivision with a 46 lots. Street connectivity

UPDATE
On November 19, 2020 The Planning Commission held their monthly meeting. Midtown Oaks 6 sketch plan
was on the agenda. This sketch plan proposes to subdivide 18.01 acres into a residential subdivision. The sketch
plan did not possess adequate green space/open space that was not stormwater related, so the commission
recommended adding more green space that could be utilized by the residents of that neighborhood. The Chairman
recommended a work session for a committee of the Planning Commission and Goodwyn, Mills, and Cawood.
The work session occurred on December 9, 2020, where Greg Gillian (Larry Speaks and associates) presented a
updated master plan and the committee stated their concerns with the original sketch plan. The conclusion of the
work session was that Goodwyn, Mills, and Cawood would try to have more green space that is not stormwater and
that can be utilized by the residents of Midtown Oaks.

B. DEVELOPMENT STATUS & HISTORY
Previous Requests/Approval: 3/7/2006: Rezoned by Council from FAR to B-2
7/2/2019: Rezoned by Council from B-2 to R-4
A developer, on behalf of the property owner, appeared before the Planning Commission at its
4/19/2019 meeting requesting the rezoning from B-2 to R-4. His stated intention was to rezone
the eastern 30+/- acres to R-4 and leave two outparcels along Old Farm as B-2. During the
meeting, it was presented that plans were for approximately 180 units. The Commission voted to
recommend the rezoning to R-4, however the submitted legal description and map included the
entire 38+/- acre parcel to be included in the R-4 request. The ordinance presented to the
Council included the legal description of the whole parcel, and was voted on and approved to
rezone to R-4 at the 7/2/2019 Council meeting.
At the 8/15/2019 Commission meeting, a preliminary plat was presented to the Commission that
would subdivide the 38+/- acre parcel into three parcels (two parcels along Old Farm Lane and
one 30+/- acre parcel for the proposed apartments). It was stated that the intention was to request
rezoning of the two Old Farm Ln lots to be rezoned back to B-2. The Commission voted to
approve the plat. No further rezoning requests for this property have been received.

On January 21, 2010, the Planning Commission adopted an updated Prattville Comprehensive Plan.
The Future Land Use Plan and Map in Section 2.2 of the document shows the subject parcel as
“Mixed-Use Transitional”.
Mixed-Use Transitional is “designed specifically to support a broad range of redevelopment types
while limiting additional retail that might soften the existing market,” and “is geared towards
creating a model of development and redevelopment that augments and supports the existing retail
corridor on Cobbs Ford Road.” Suggested uses are “office, housing (of a variety of densities),
hospitality, institutional, light industrial, flex office and greenspace, among others. Retail might be
accommodated, but at a very limited scale, and of a purely local-serving variety.”

Recommendation: Approval with Conditions. Staff recommendation is to rezone
Lot A and Lot B to B-2 which will allow uses to support the retail
corridor. Allow Lot C to remain R-4 or consider rezoning to O-1
or B-1.
