and 12 13 WHEREAS, the City of Prattville has participated in the preparation of a regional 14 15 multi-hazard mitigation plan, hereby known as the East Alabama Regional Multi-Jurisdictional 16 17 Hazard Mitigation Plan: Phase Two (2020), in accordance with the Disaster Mitigation Act of 18 19 2000; and 20 21 WHEREAS, said Mitigation Plan identifies mitigation goals and actions to reduce or 22 23 eliminate long-term risk to people and property in Prattville from the impacts of future hazards 24 25 and disasters; and 12 13 WHEREAS, §6-8-60, Code of Alabama, 1975, as amended, requires that all 14 15 publications required by any law to be published in a newspaper which has general 16 17 circulation in the county; and 18 19 WHEREAS, §11-67-62(b), Code of Alabama, 1975, as amended, requires that notice 20 21 of weeded lots be given by publication in a newspaper of general circulation published in the 22 23 municipality; and 24 25 WHEREAS, the Prattville Progress and the Montgomery Advertiser are both licensed 26 27 to operate within the City of Prattville; and 28 29 WHEREAS, the Prattville Progress is published under the umbrella of the Montgomery 30 31 Advertiser; with both being operated by Gannett Co., Inc.; and 32 33 WHEREAS, the Prattville Progress does not appear to conduct any operations, 34 35 determine form or content, or perform any publishing activities from a physical location within 36 37 the City of Prattville or Autauga County; and 38 39 WHEREAS, the City of Prattville Planning and City Clerk Departments have had 40 41 numerous issues recently with legal advertisements processed through the Prattville 42 43 Progress; and 44 45 WHEREAS, the City departments that rely on timely and accurate advertising of 46 47 various notices and ordinances required by law have determined that the Prattville Progress 48 49 is no longer able to effectively handle said advertisements; and 18 19 WHEREAS, Civil Southeast has the staff and expertise to prepare said application 20 21 for the City of Prattville. 22 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 24 25 as follows: 26 27 1. The City of Prattville shall submit said TAP application for funding in an amount 28 estimated not to exceed $653,408.33 (net cost to City not to exceed $130,681.67) for 29 sidewalk improvements to East Main Street from Shady Oak Lane to Silver Hills Drive, 30 to include construction and construction engineering services. 31 32 2. The City of Prattville commits an amount not to exceed $65,000.00 for preliminary 33 engineering cost. 34 35 3.
