[To Declare Various Weeded Lots to be a Public Nuisance, Order Their Abatement and Set a Public Hearing per Title 11, Chapter 67 of the Code of Alabama, 1975, as Amended.] {Sponsored By: Council President Starnes}
WHEREAS, an abundance of overgrown grass or weeds: 1. is injurious to the public health, safety and general welfare by providing a breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; 4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended,
permits the City Council of the City of Prattville to declare an abundance of overgrown grass and weeds to be a public nuisance; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the properties at the following addresses and determined the existence of an
abundance of overgrown grass and weeds:

NOW, THEREFORE, BE IT RESOLVED that: 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at the above-listed addresses to be a public nuisance; and
2. the owners of said property, as they appear in the records of the Autauga County or
Elmore County Revenue Commissioners, are ordered to abate the abundance of overgrown grass and weeds; and 3. the owners of said property are ordered to appear before the City Council of the City of Prattville at a public hearing at 6:00 p.m. on June 15, 2021, in Prattville City Hall; and
4. the notice as required by §11-67-62, Code of Alabama, 1975, as amended, will be
provided in a publication of general circulation in compliance with the law, by certified mail, and by signage on the subject property. ADOPTED THIS 18TH DAY OF MAY, 2021.

RESOLUTION
[To Submit the 2020 Municipal Water Pollution Prevention (MWPP) Annual Reports for the Pine Creek and Autauga Creek Wastewater Treatment Facilities to the Alabama Department of Environmental Management (ADEM).]

WHEREAS, the City of Prattville operates the Pine Creek and Autauga Creek Wastewater Treatment Facilities; and
WHEREAS, the City of Prattville has implemented a Municipal Wastewater Pollution Prevention Program, as directed by law; and
WHEREAS, the Public Works staff has prepared the 2020 Municipal Water Pollution
Prevention (MWPP) Annual Reports for said wastewater treatment facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
does hereby acknowledge that the City Council has reviewed and submits the 2020 MWPP Annual Reports for the City of Prattville to ADEM and that the City of Prattville, through its
employees in the Wastewater Division of the Public Works Department, shall continue to maintain the diligent monitoring of effluent from the Wastewater System and shall continue to treat Wastewater effluent in the same manner as they have in the past, in accordance
with all Federal and State regulations. BE IT FURTHER RESOLVED that the City will continue training programs as
recommended by the Public Works Director and as required by all applicable State or Federal Government regulatory agencies. ADOPTED THIS 18TH DAY OF MAY, 2021.

RESOLUTION
[To Set a Public Hearing to Declare Stagnant Water at 122 Lina Drive to Be Unsafe and a Public Nuisance Pursuant to Section 46-6, City of Prattville Code of Ordinances.] {Sponsored By: Council President Starnes}
WHEREAS, stagnant water is a public nuisance that is injurious to the health, morals, comfort or welfare of the community pursuant to Section 46-6, City of Prattville
Code of Ordinances; and WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the City Council of the City of Prattville to declare a public nuisance and abate
the same; and WHEREAS, the Prattville Police Department Code Enforcement Officer has
inspected the property and determined the existence of stagnant water at 122 Lina Drive; and WHEREAS, Autauga County tax records list the property owner as Barbara Noyes
Boldin, 27 NW 6th Avenue, Dania Beach, FL 33004 to parcel number 19 05 16 4 006 043.00; and
WHEREAS, in compliance with Section 46-31 of the City of Prattville Code of Ordinances, the Prattville Police Department Code Enforcement Officer sent notice to the owner of the above property in writing on April 14, 2021, to correct, remedy or
remove the condition of stagnant water within 10 days; and WHEREAS, the owner of 122 Lina Drive has failed and/or refused to correct,
remedy or remove the condition of stagnant water after the expiration of said notice; and WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes
the City to do such work or make such improvements that are necessary to correct, remedy or remove such condition, and pay therefor and charge the expenses incurred
to the owner of such lot. NOW, THEREFORE, BE IT RESOLVED that:
1. the City Council of the City of Prattville declares the stagnant water at the above-listed
address to be a public nuisance which is due to be abated; and 2. the owners of said property are ordered to appear before the City Council of the City of Prattville at a public hearing at 6:00 p.m. on June 15, 2021, in Prattville City Hall; and 3. the notice of a public hearing on the matter as required by the applicable laws, will be
provided in a publication of general circulation in compliance with the law, by certified
mail, and by signage on the subject property.

ORDINANCE
[Petition for Annexation of Glennbrooke 8 Extension.] {Sponsored By: Councilor Chambers}
BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that
the City of Prattville is a city with a population of over 6,000 inhabitants located in the State of Alabama; and
THAT a petition has been presented by all owners of property located and contained which are contiguous to the corporate limits of the City of Prattville as they are now situated;
and
THAT the property described in the petition sought to be annexed is as described in Attachment “A”; and
THAT said property does not lie within the Corporate limits of any other municipality; and
THAT all owners as defined by § 11-42-20, Code of Alabama, 1975, as amended, have executed said petition requesting the property be annexed into the City of Prattville; and THAT the City of Prattville finds that it is in the best interests of the City of Prattville
and its inhabitants to annex said property; and THAT the City Council of the City of Prattville finds that the petition has met all
requirements of Title 11-42-20 through 11-42-23, Code of Alabama, 1975, as amended. BE IT FURTHER ORDAINED by the City Council of the City of Prattville, Alabama, that the corporate limits of the City of Prattville be extended and rearranged so as to embrace
and include the following property as described in Attachment “A”; and THAT such property shall become a part of the corporate area of Prattville, Alabama
upon passage and publication of this Ordinance as required by law. BE IT FURTHER ORDAINED that a copy of the petition be filed in the office of the Judge of Probate of Autauga County, Alabama, and that this Ordinance be published in the

BE IT ORDAINED by the City Council of the City of Prattville that City of Prattville, Code of Ordinances is hereby Amended to read as follows:
WHEREAS, The City of Prattville Waterworks Board was established pursuant to Ordinance Sec.66-1 (Code 1971, § 19-1; Code 1992, § 13-1); and
WHEREAS, The City of Prattville Waterworks Board exists and serves the City of
Prattville and its citizens by performing necessary and valuable services; and WHEREAS, the City of Prattville Waterworks Board is a quasi-governmental entity and
a related party to the City of Prattville; and WHEREAS, the City of Prattville Waterworks Board, as a quasi-governmental entity,
shall waive the Fire Hydrant rental fee charged to the City; and
WHEREAS, the City Council desires to exempt said City of Prattville Waterworks Board from certain license fees, gross receipt fees, and license requirements.
NOW, THEREFORE, BE IT ORDAINED that the Municipal Code of Ordinances for the City of Prattville are hereby amended as follows:
Sec. 38-326. – Public utilities.
Electric light companies, power companies, gas companies, pipeline companies for transporting gas, oil, gasoline or other commodities, gas distributing companies whether by means of pipelines, drums, cylinders, or otherwise, heating companies or other public utilities, incorporated under the laws of this state or any other state, or whether
incorporated at all, and all water distributing systems, including but not limited to any municipal boards or systems, unless otherwise excepted or exempted in Sec. 38-331 below, shall pay three percent of the gross receipts of the business of such company or system.
Sec. 38-331. - Exemptions.
f) Waterworks Board Exemption. The Waterworks Board of the City of Prattville, Alabama is exempted from the business licensing requirements under this article, including the three percent of gross receipts as articulated in Sec. 38-331. THIS ordinance shall become effective upon its passage and execution as provided by
law. Each of the provisions of this ordinance are severable; and if any provision shall be declared to be invalid, the remaining provisions shall not be affected but shall remain in full
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby repealed.
THIS ordinance shall become effective for the licensing year beginning January 1,
2022, upon its passage and execution as provided by law.
