[To Accept and Endorse Project Prattville 2040 as the Comprehensive Master Plan of the
City of Prattville.]

WHEREAS, the Prattville Planning Commission, acting under the authority of § 11-52-8 of
the Code of Alabama, 1975, as amended, undertook a process to update the Comprehensive
Master Plan, Project Prattville, that was adopted by the Planning Commission on January 10,
2010; and
WHEREAS, the Planning Commission engaged in surveys, interviews and public
meetings of the community, including residents, educators, civic and religious leaders,
local business and industry leaders, and studied the present conditions and future growth of
the City; and
WHEREAS, the Planning Commission created an updated Comprehensive Master
Plan entitled Project Prattville 2040, which is made with the general purpose of guiding and
accomplishing a coordinated, adjusted and harmonious development of the City, in order to
best promote the health, safety, morals, order, convenience, prosperity, or general welfare; and
WHEREAS, the Planning Commission adopted Project Prattville 2040 as the
Comprehensive Master Plan for the City of Prattville on April 15, 2021.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
Accepts and Endorses Project Prattville 2040 as the Comprehensive Master Plan of the City and
recognizes it as the guide for the future development of the City of Prattville.

municipal governing body to dispose of unneeded personal property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes and mosquitoes and other vermin;

WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as
amended, was provided in The Prattville Progress, by certified mail, and by signage on
the subject property; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has
inspected said properties and determined that the public nuisance still exists; and
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on
July 6, 2021, permitting the owners of said properties to present evidence, objections,
and protest regarding the proposed removal of weeds.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Prattville declares that the abundance of overgrown grass and weeds on the properties

the City Council following their removal.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama adopted on February 10,
1950, subsequently amended from time to time, and the zoning map adopted on the 1st day
of May, 1987, are hereby amended to reclassify the property described in Attachment “A”
to FAR (Forest, Agriculture, Recreation); and
THAT this proposed ordinance and a synopsis was advertised for two (2) weeks in the
Prattville Progress, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on the 6th
day of July, 2021, at 6:00 p.m., considered said proposed ordinance and that, at such time
and place, all persons who desired had an opportunity to be heard in favor of or in opposition
to such ordinance; and
THAT this ordinance is adopted under the authority of §11-52-85 of the Code of
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to
annex property described in Attachment “A” into the City of Prattville no later than 180 days
following adoption of the Ordinance.
ALL other items and provisions of the zoning ordinance of the City of Prattville not
herein specifically amended shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on May 20, 2021.

Sec. 50-74. - Loud and unnecessary noises—Prohibited
(17) Pickup, delivery of waste containers. The pickup or delivery of solid waste and
construction waste containers or the pickup of waste collected in said containers other
than between the hours of 7:00 a.m. and 9:00 p.m., except on those properties
classified as M-1 or M-2 in appendix A, Zoning.
THIS ordinance shall become effective upon its passage and execution as provided by
law. Each of the provisions of this ordinance are severable; and if any provision shall be
declared to be invalid, the remaining provisions shall not be affected but shall remain in full
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby
repealed.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama that Chapter
38, “Business Licenses and Taxes”, Article V, Section 38-515 is amended as follows:
Chapter 38 – Business Licenses and Taxes
Ar ticle V.
Sec. 38-515. – Outdoor Alcohol Service
(a) Prerequisites. It shall be unlawful in the City to engage in the business of
outdoor alcohol service without first complying with the provisions of this section and
obtaining an outdoor alcohol service permit.
(1) “Outdoor Alcohol Service” is defined as the sale or service of alcoholic
beverages which are subject to regulation or control by the state alcoholic beverage
control board, in an open-air setting on public or private property.
(c) Businesses desiring to conduct outdoor alcohol service must as a
prerequisite, be properly licensed to serve alcohol and/or food indoors with the City
and through the State ABC Board and be in compliance with the provisions of this
Code of Ordinances and with § 28-3A-1, Code of Alabama (1975) et. seq.
(b) Process. An Outdoor Alcohol Service Permit may be obtained by a business
through the following process:
(1) Said business must present plans for approval of a permanent outdoor
barrier which is aesthetically pleasing, not readily removable and is constructed with
materials, textures and colors which keep with the principle architecture of the
existing structure of the business. The permanent outdoor barrier shall be located in
such a manner on the business property so it is readily visible and distinguishable,
and so that it does not impede the regular flow of vehicular and pedestrian traffic on
public rights of way, parking lots, paths of ingress/egress, and/or easements. The
outdoor alcohol service is to be conducted only within the confines of this permanent
outdoor barrier.
(2) The City Planning Department and the Prattville Police Department shall
approve of the plans for the permanent outdoor barrier and shall again be permitted
to conduct a final inspection and approval after said barrier is complete. An approval
by the City Planning Department and/or the Prattville Police Department does not
exempt the applicant from any other required approvals or committees which the
applicant may be additionally subject to based on the location of the applicant’s
business.
(3) Upon final inspection and approval of the constructed permanent outdoor
barrier, the City may issue to the applying business a permit for Outdoor Alcohol
Service.
(c) Penalties.
(1) Any business or individual found to be in knowing violation of this
ordinance is subject to the loss of any of its existing alcohol licenses held by the City.
A violation of this article relative to obtaining a permit to conduct outdoor alcohol
service shall be punishable by a fine not to exceed $500.00 for each offense, and if
the violation is a willful violation, by such fine and imprisonment not to exceed six
months, or both fine and imprisonment, at the discretion of the court trying the same.
Each day shall constitute a separate offense.
(2) Any violation of this section not remedied within thirty (30) days of notice of
the violation shall subject the applicant to a revocation of an Outdoor Alcohol Service
Permit.
THIS ordinance shall become effective upon its passage and execution as provided by
law. Each of the provisions of this ordinance are severable; and if any provision shall be
declared to be invalid, the remaining provisions shall not be affected but shall remain in full
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby
repealed.

BE IT ORDAINED that City Code Division 2. Sales Tax, Section 38-92 is hereby
amended as follows:
Sec. 38-92. – Imposition of Additional Tax.
(a) In addition to the taxes set forth in Section 38-91, there shall be an additional one (1)
percent (%) tax levied under Section 38-91(1), (2), and (6) commencing on July 1, 2021.
(b) The tax collected under this section herein, after deduction for expenses of collection,
shall be expended in the following manner:
1. One hundred (100) percent (%) of each month’s collections of the one (1)
percent (%) tax shall be deposited into a General Fund Reserves bank account
maintained in accordance with the City’s General Fund Reserve Policy.
2. Reserved.
This Ordinance shall become effective upon its passage and execution as provided by law.

[To Amend City Code Division 2. Sales Tax, Section 38-92 Imposition of Certain Sales and
Use Taxes.]

BE IT ORDAINED that City Code Division 2. Sales Tax, Section 38-92 is hereby
amended as follows:
Sec. 38-92. – Imposition of Additional Tax.
(a) In addition to the taxes set forth in Section 38-91, there shall be an additional one
(1) percent (%) tax levied under Section 38-91(1), (2), and (6) commencing on July 1,
2021.
(b) The tax collected under this section herein, after deduction for expenses of
collection, shall be expended in the following manner:
1. Ten (10) percent (%) of each month’s collections of the one (1) percent (%) tax
shall be deposited into a General Fund Reserves bank account maintained in
accordance with the City’s General Fund Reserve Policy.
a. Once the provisions of the City’s General Fund Reserve Policy have
been satisfied, this ten (10) percent (%) of the one (1) percent (%) tax
shall be deposited into an Economic Development Reserves bank
account. Such funds may be expended only on economic development
projects approved by the City Council of the City of Prattville.
b. If the provisions of the City’s General Fund Reserve Policy are not in
compliance at the conclusion of any fiscal year ending September 30th
following the effective date of this Ordinance, then the Finance Director
shall move the necessary funds from the Economic Development
Reserves bank account to the General Fund Reserves bank account to
satisfy the City’s General Fund Reserve Policy.
2. The remaining ninety (90) percent (%) of each month’s collections of the one (1)
percent (%) tax shall be committed as follows:
a. Fifty (50) percent (%) shall be deposited into an Education Reserves
bank account and used only for education-related expenses within the
corporate limits of the City of Prattville.
b. Twenty-five (25) percent (%) shall be deposited into a Parks and
Recreation Reserves bank account and used only for Parks and
Recreation facilities within the corporate limits of the City of Prattville.
c. Twenty-five (25) percent (%) shall be deposited into an Infrastructure
Reserves bank account and used only for infrastructure-related
expenses within the corporate limits of the City of Prattville.
This Ordinance shall become effective upon its passage and execution as provided by law.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that
the City of Prattville is a city with a population of over 6,000 inhabitants located in the
State of Alabama; and
THAT a petition has been presented by all owners of property located and contained
which are contiguous to the corporate limits of the City of Prattville as they are now situated;
and
THAT the property described in the petition sought to be annexed is as described in
Attachment A; and
THAT said property does not lie within the Corporate limits of any other municipality;
and
THAT all owners as defined by §11-42-20, Code of Alabama, 1975, as amended,
have executed said petition requesting the property be annexed into the City of Prattville; and
THAT the City of Prattville finds that it is to the best interest of the City of Prattville
and its inhabitants to annex said property; and
THAT the City Council of the City of Prattville finds that the petition has met all
requirements of §11-42-20 through §11-42-23, Code of Alabama, 1975, as amended.
BE IT FURTHER ORDAINED by the City Council of the City of Prattville, Alabama,
that the corporate limits of the City of Prattville be extended and rearranged to embrace
and include the following property as described in Attachment A; and
THAT such property shall become a part of the corporate area of Prattville, Alabama
upon passage and publication of this Ordinance as required by law.
BE IT FURTHER ORDAINED that a copy of the petition be filed in the office of the
Judge of Probate of Autauga County, Alabama, and that this Ordinance be published in the
Prattville Progress of Autauga County, Alabama.

WHEREAS, the City of Prattville, Alabama, has identified a need for park surfacing
improvements at various City owned parks; and
WHEREAS, the City is interested in applying under the Alabama Department of
Environmental Management’s (ADEM) Scrap Tire Marketing Program for said park surfacing
improvements; and
WHEREAS, the City desires to retain engineering services for said projects in the
event said applications are approved; and
WHEREAS, §41-16-51(a)(3) of the Code of Alabama, 1975, as amended, allows
contracts to secure services with engineers possessing a high degree of professional skill to
be let without competitive bidding; and
WHEREAS, the City shall pay for all necessary engineering fees to the extent that said
applications are approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville
as follows:
1. That Mayor Bill Gillespie, Jr., is hereby authorized to file applications for funding in
an amount not to exceed $1,104,000.00 (net cost to City not to exceed $90,000.00)
for surfacing improvements to:
• Lorenzo “Lo” Pickett Park ($79,962.00),
• Miller Park ($272,626.00),
• Overlook Park ($179,065.00),
• Upper Kingston Park ($352,945.00), and
• Pratt Park ($219,402.00),
to include construction and engineering services.
2. That the City of Prattville commits an amount not to exceed $90,000.00 for said
engineering costs.
3. That the Mayor is authorized to execute any and all documents required to
complete said applications.
4. That Civil Southeast, LLC be retained to provide the necessary engineering
services.

WHEREAS, the City of Prattville, Alabama, has identified a need for improvements to
the McQueen Smith Road Corridor; and
WHEREAS, the City is eligible to submit an application for funding assistance made
available under the Rebuilding American Infrastructure with Sustainability and Equity (RAISE)
Program, through the United States Department of Transportation (USDOT); and
WHEREAS, the RAISE Grant Program can provide grant funding of up to seventy
(70) percent (%) of eligible project costs from the USDOT, with the remaining balance of not
less than thirty (30) percent (%) of eligible project costs required to be paid by the City of
Prattville.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville
as follows:
1. That Mayor Bill Gillespie, Jr., is hereby authorized to submit FY 2021 RAISE Grant
Application to USDOT for funding assistance to increase safety, provide
accommodations for safe pedestrian and non-motorized access, improve quality of life,
relieve traffic congestion, and reduce travel time in the McQueen Smith Road Corridor.
2. That the City of Prattville commits cash matching funds for the project in the amount
of $5,250,000.00 from the General Fund, should the grant be awarded by the USDOT
and implemented.
3. That the Mayor is authorized to execute any and all documents required to complete
said application.

ORDINANCE
[To Establish a New General Fund Reserves Policy for the City of Prattville.]

WHEREAS, in Resolution Book 2006-A, Page 024, on September 19, 2006, the City
Council “established a general fund balance policy to achieve a fifteen (15) percent (%)
general fund reserve balance by the end of fiscal year 2010”; and
WHEREAS, in Resolution Book 2010, Page 075, on October 5, 2010, the City Council
“established a general fund balance policy to build and maintain a general fund reserve
balance of at least fifteen (15) percent (%)”; and
WHEREAS, the City Council of the City of Prattville desires to establish a General
Fund Reserves Policy for the City of Prattville to identify the parameters and calculations
required to maintain an adequate balance in the General Fund Reserves bank account.
BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
Section 1. The policy described herein shall lay out the City of Prattville’s guidelines for
obtaining and maintaining a General Fund Reserves bank account and shall become
effective upon its adoption by the City Council.
Section 2. The balance in the General Fund Reserves Account shall meet the following
requirements:
1. General Fund Cash Reserves equal to or exceeding the greater of:
a. $10,000,000.00; or
b. Twenty (20) percent (%) of the previous year’s audited General Fund
revenue.
2. Unrestricted General Fund balance equal to or exceeding twenty-five (25)
percent (%) of the previous year’s audited General Fund revenue.
Unrestricted General Fund balance shall include the General Fund
“assigned” and “unassigned” fund balance categories, as well as any
“committed” fund balance amounts attributable specifically to the General
Fund Reserves.
Section 3. Analysis and calculation of the status of the General Fund Reserves’ adherence to
said policy shall be done at least on an annual basis by the City’s Finance Director. If the
calculations reveal a shortfall or noncompliance with said policy, the Finance Director shall draft
a recommended corrective action plan to bring the reserve balance into compliance. Said
corrective plan shall be provided to the Mayor and City Council.
Section 4. All previous ordinances or parts of ordinances and resolutions or part of resolutions
in conflict with this General Fund Reserves Policy are hereby superseded and repealed.
This ordinance shall become effective upon passage, approval and publication or as otherwise
provided by law.
