WHEREAS, pursuant to §11-67-60 through §11-67-67, Code of Alabama, 1975, as 7
8
amended, the City Council of the City of Prattville adopted resolutions authorizing the Mayor to 9
10
abate the public nuisances cited as weeded lots for 105 Timbermill Court; and 11
12
WHEREAS, the City Council subsequently adopted the costs associated with the 13
14
abatement of the public nuisances and assessed them against the respective parcel of 15
16
property; and 17
18
WHEREAS, the City Council authorized the City Attorney to file weeded liens with the 19
20
Revenue Commissioner of Autauga County, Alabama, under the “Optional Method of Taxation” 21
22
pursuant to Article 1, Division 2, Chapter 51 of Title 11 of the Code of Alabama, 1975, as 23
24
amended, on 105 Timbermill Court for: 25
26
o $396.11 (resolution recorded September 20, 2016) 27
o $393.84 (resolution recorded September 29, 2017); and 28
29
WHEREAS, said weeded liens were paid as reflected by checks issued from 30
31
the Autauga County Revenue Department to the City in the amounts stated above. 32
33
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 34
35
said weeded liens are satisfied and hereby released. 36
37
BE IT FURTHER RESOLVED that the City Attorney shall file with the Autauga County 38
39
Probate Court a lien release letter for 105 Timbermill Court and additionally provide a copy of 40
41
the same to the Revenue Commissioner of Autauga County, Alabama. 42

WHEREAS, the City of Prattville has identified a need to acquire certain real property 9

located at 115 Maple Street as right-of-way acquisition in conjunction with Pedestrian Bridge 11

Improvements at Bridge Street and Maple Street; and 13

WHEREAS, said real property, containing approximately 0.05 acres, is more 15
16
specifically described and shown on the map in Attachment “A”; and 17
18
WHEREAS, said real property is owned by Dr. Tom and Linda Miller; and 19
20
WHEREAS, Dr. Tom and Linda Miller have agreed to donate and convey said real 21
22
property to the City by deed. 23
24
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 25
26
that the donation of said real property located at 115 Maple Street is accepted by the City. 27

BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor 29

of the City of Prattville to execute any and all documents necessary to carry out the intent of 31

WHEREAS, an abundance of overgrown grass or weeds: 8

1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17
18
the City Council of the City of Prattville to declare an abundance of overgrown grass and 19
20
weeds to be a public nuisance; and 21
22
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23
24
the properties at the following addresses and determined the existence of an abundance of 25
26
overgrown grass and weeds: 27

BE IT ORDAINED by the City Council of the City of Prattville, Alabama that Chapter 11
12
38, “Business Licenses and Taxes”, Article V, Section 38-515 is amended as follows: 13
14
Chapter 38 – Business Licenses and Taxes 15
Article V. 16
Sec. 38-515. – Outdoor Alcohol Service 17
(a) Prerequisites. It shall be unlawful in the City to engage in the business of 18
outdoor alcohol service without first complying with the provisions of this section and 19
obtaining an outdoor alcohol service permit. 20
(1) “Outdoor Alcohol Service” is defined as the sale or service of alcoholic 21
beverages which are subject to regulation or control by the state alcoholic beverage 22
control board, in an open-air setting on public or private property. 23
(c) Businesses desiring to conduct outdoor alcohol service must as a 24
prerequisite, be properly licensed to serve alcohol and/or food indoors with the City 25
and through the State ABC Board and be in compliance with the provisions of this 26
Code of Ordinances and with § 28-3A-1, Code of Alabama (1975) et. seq. 27
(b) Process. An Outdoor Alcohol Service Permit may be obtained by a business 28
through the following process: 29
(1) Said business must present plans for approval of a permanent outdoor 30
barrier which is aesthetically pleasing, not readily removable and is constructed with 31
materials, textures and colors which keep with the principle architecture of the 32
existing structure of the business. The permanent outdoor barrier shall be located in 33
such a manner on the business property so it is readily visible and distinguishable, 34
and so that it does not impede the regular flow of vehicular and pedestrian traffic on 35
public rights of way, parking lots, paths of ingress/egress, and/or easements. The 36
outdoor alcohol service is to be conducted only within the confines of this permanent 37
outdoor barrier. 38
(2) The City Planning Department and the Prattville Police Department shall 39
approve of the plans for the permanent outdoor barrier and shall again be permitted 40
to conduct a final inspection and approval after said barrier is complete. An approval 41
by the City Planning Department and/or the Prattville Police Department does not 42
exempt the applicant from any other required approvals or committees which the 43
applicant may be additionally subject to based on the location of the applicant’s 44
business. 45
(3) Upon final inspection and approval of the constructed permanent outdoor barrier, 46
the City may issue to the applying business a permit for Outdoor Alcohol Service. 47
(c) Penalties. 48
(1) Any business or individual found to be in knowing violation of this 49
ordinance is subject to the loss of any of its existing alcohol licenses held by the City. 50
A violation of this article relative to obtaining a permit to conduct outdoor alcohol 51
service shall be punishable by a fine not to exceed $500.00 for each offense, and if 52
the violation is a willful violation, by such fine and imprisonment not to exceed six 53
months, or both fine and imprisonment, at the discretion of the court trying the same. 54
Each day shall constitute a separate offense. 55
(2) Any violation of this section not remedied within thirty (30) days of notice of 1
the violation shall subject the applicant to a revocation of an Outdoor Alcohol Service 2
Permit. 3
THIS Ordinance shall become effective upon its passage and execution as provided 4
5
by law. Each of the provisions of this Ordinance are severable; and if any provision shall be 6
7
declared to be invalid, the remaining provisions shall not be affected but shall remain in full 8
9
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby 10
11
repealed. 12

was provided in The Prattville Progress, by certified mail, and by signage on the subject 27

property; and 29

WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
August 3, 2021, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 3

THAT the zoning ordinance of the City of Prattville, Alabama, adopted on February 10, 5

1950, subsequently amended from time to time, and the zoning map adopted on May 1, 1987, 7
8
are hereby amended to reclassify the property described in Attachment “A” as 9
10
R-3 (Single Family Residential); and 11
12
THAT this proposed Ordinance and a synopsis was advertised for two (2) weeks in the 13
14
Prattville Progress, a newspaper of general circulation within the City Limits of the City of 15
16
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on September 17
18
7, 2021, at 6:00 p.m., considered said proposed Ordinance and that, at such time 19
20
and place, all persons who desired had an opportunity to be heard in favor of or in opposition 21
22
to such Ordinance. 23

THAT this Ordinance is adopted under the authority of §11-52-85 of the Code of 25
26
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to 27

annex property described in Attachment “A” into the City of Prattville no later than 180 days 29

Doster Road from Marlette Drive to SR-3 (US-31).] 6

WHEREAS, transportation funds are available to the City of Prattville; and 10

WHEREAS, the Director of ALDOT is authorized to sub-allocate federal transportation 12
13
funds to the City; and 14

WHEREAS, funds have been allocated for ALDOT Project Number STPMN-0121(___), 16
17
CPMS Reference Number 100073333, for the resurfacing on Doster Road from Marlette Drive 18
19
to SR-3 (US-31). 20
21
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 22
23
that Bill Gillespie, Jr., Mayor, and Gerald “Jerry” Starnes, City Council President, and all other 24
25
necessary and proper representatives of the City are authorized to execute and deliver 26
27
funding agreements from ALDOT, or attest a signature required on any document necessary 28
29
to carry out the intent of this Resolution. 30

Services for ALDOT Resurfacing Project on Lower Kingston Road from 4th Street to Prattville 4
City Limits for the Engineering Department at a Cost Not to Exceed $60,000.00 (Net Cost to 5
City Not to Exceed $12,000.00).] 6

WHEREAS, the City of Prattville has a need for engineering services in conjunction 10

with ALDOT Resurfacing Project STPMN-121 (___), CPMS Reference Number 100072820; 12
13
and 14
15
WHEREAS, said engineering services are available from Civil Southeast LLC at a 16
17
cost not to exceed $60,000.00; and 18
19
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts 20
21
to secure services with engineers possessing a high degree of professional skill to be let 22
23
without competitive bidding; and 24
25
WHEREAS, this is a budgeted expense for the Engineering Department. 26
27
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Prattville, 28
29
that the Mayor is authorized and empowered to enter into an Agreement with Civil Southeast 30
31
LLC for said engineering services. 32

BE IT FURTHER RESOLVED that funds in an amount not to exceed $60,000.00 (net 34
35
cost to City not to exceed $12,000.00) are hereby authorized and approved to be paid to Civil 36
37
Southeast LLC for said engineering services, and said funds are hereby approved and 38
39
appropriated from the FY2021 Budget Line Item Gas Tax Fund/Local Paving. 40
