WHEREAS, on August 17, 2021, the City Council of the City of Prattville set a Public 8
9
Hearing to consider the revocation of Bama Lanes Prattville LLC d/b/a Blue Iguana Bar’s 10
11
business license; and 12
13
WHEREAS, said Public Hearing was originally scheduled for 6:00 p.m. on September 14
15
7, 2021, as prescribed by the passage of Resolution Book 2021-A, Page 145; and 16
17
WHEREAS, said resolution was submitted to the Prattville Progress for publication in 18
19
accordance with the Code of Alabama, 1975, as amended, and notice to licensee was made 20
21
ten (10) days before the day set for said hearing pursuant to the City of Prattville Code of 22
23
Ordinances, Chapter 38, Article V, Section 38-318; and 24
25
WHEREAS, the August 13, 2021, Proclamation by Alabama Governor Kay Ivey 26
27
stipulated that any meeting or public hearing scheduled by law to occur during this state public 28
29
health emergency, specifically the spread of COVID-19, may be postponed by the chair or 30
31
other person responsible for setting it; and 32
33
WHEREAS, said Public Hearing must be rescheduled due to concerns for public health, 34
35
safety, welfare and out of an abundance of caution. 36

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 38
39
the Public Hearing for said resolution shall be rescheduled from September 7, 2021, to October 40
41
5, 2021, at 6:00 p.m. 42

BE IT FURTHER RESOLVED that this resolution shall be submitted to the Montgomery 44

Advertiser for publication in accordance with the Code of Alabama, 1975, as amended, and 46

WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17
18
the City Council of the City of Prattville to declare an abundance of overgrown grass and 19
20
weeds to be a public nuisance; and 21
22
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23
24
the property at the following addresses and determined the existence of an abundance of 25
26
overgrown grass and weeds: 27

WHEREAS, §11-67-60 through §11-67-67 Code of Alabama, 1975, as amended, 7
8
details the process for declaring certain weeded lots a public nuisance, ordering their 9
10
abatement and assessing the costs of abatement; and 11
12
WHEREAS, the City Council of the City of Prattville finds that: 13
14
1. the Prattville Police Department Code Enforcement Officer identified several lots as 15
being a public nuisance due to an abundance of overgrown grass and weeds, 16
2. the owners of various weeded lots were properly notified of the public nuisance as 17
required by §11-67-62, Code of Alabama, 1975, as amended, 18
3. a public hearing concerning the lots was conducted as required by §11-67-63, Code of 19
Alabama, 1975, as amended, and 20
4. the City Council adopted resolutions authorizing the Mayor to abate the public 21
nuisances. 22

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 24
25
that the costs of abating these nuisances as listed in “Attachment A” are hereby adopted and 26
27
the costs thereof shall be assessed against the respective parcels of property. 28
29
BE IT FURTHER RESOLVED that the City Attorney shall file said liens with the 30
31
Revenue Commissioner of Autauga and Elmore Counties under the “Optional Method of 32
33
Taxation” pursuant to Article 1, Division 2, Chapter 51 of Title 11 of the Code of Alabama, 34
35
1975, as amended. 36

[To Amend the City’s Capitalization Threshold for Certain Classes of Assets.] 3

WHEREAS, the City of Prattville maintains a listing of capital assets for various classes 7
8
of assets and records said assets at their historical cost or estimated historical cost; and 9
10
WHEREAS, said assets, other than land, are then depreciated using the straight-line 11
12
method over the assets’ estimated useful life; and 13
14
WHEREAS, the Finance Director has identified a need to increase the capitalization 15
16
threshold for certain classes of assets in an effort to eliminate the cost associated with tracking 17
18
a large number of small-value assets. 19
20
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 21
22
the capitalization threshold for the Vehicles asset class is increased from $5,000.00 to 23
24
$10,000.00, and the capitalization threshold for the Office, Nonoffice and Computer Equipment 25
26
asset class is increased from $5,000.00 to $10,000.00, effective beginning October 1, 2021. 27
28
BE IT FURTHER RESOLVED that the Finance Director is hereby authorized to execute 29
30
the necessary changes in the City’s Annual Comprehensive Financial Report to carry out the 31
32
intent of this Resolution. 33

property; and 29

WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
September 7, 2021, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42
Prattville declares that the abundance of overgrown grass and weeds on the properties 43
44
continue to be a public nuisance: 45

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 9

THAT the zoning ordinance of the City of Prattville, Alabama, adopted on February 10, 11
12
1950, subsequently amended from time to time, and the zoning map adopted on May 1, 1987, 13
14
are hereby amended to reclassify the property described in Attachment “A” as R-3 (Single 15
16
Family Residential); and 17
18
THAT this proposed ordinance and a synopsis was advertised for two (2) weeks in the 19
20
Prattville Progress, a newspaper of general circulation within the City Limits of the City of 21
22
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on September 23
24
7, 2021, at 6:00 p.m., considered said proposed ordinance and that, at such time and place, 25
26
all persons who desired had an opportunity to be heard in favor of or in opposition to such 27
28
ordinance. 29

THAT this ordinance is adopted under the authority of §11-52-85 of the Code of 31
32
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to 33
34
annex property described in Attachment “A” into the City of Prattville no later than 180 days 35
36
following adoption of the ordinance. 37

ALL other items and provisions of the zoning ordinance of the City of Prattville not 39

herein specifically amended shall remain in full force and effect. 41

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that the City of 7

Prattville is a city with a population of over 6,000 inhabitants located in the State of Alabama; 9

THAT a petition has been presented by all owners of the property located and 13
14
contained which are contiguous to the Corporate Limits of the City of Prattville as they are 15
16
now situated; and 17

THAT the property described in the petition sought to be annexed is as described in 19
20
Attachment “A”; and 21

THAT said property does not lie within the Corporate Limits of any other municipality; 23

and 25

THAT all owners as defined by §11-42-20, Code of Alabama, 1975, as amended, have 27

WHEREAS, the City of Prattville Code of Ordinances has enacted regulations for the 9
10
treatment and shelter of dogs within the City of Prattville; and 11
12
WHEREAS, the City Council finds there is a need for further development of the Code 13
14
of Ordinances for protection for dogs as it pertains to the treatment and shelter of dogs within 15
16
the City; and 17
18
WHEREAS, said needs include the prohibition of inhumane treatment of dogs, and a 19
20
prohibition on dog chaining or tethering. 21
22
BE IT ORDAINED by the City Council of the City of Prattville that City of Prattville 23
24
Code of Ordinances, is hereby Amended to read as follows: 25
26
Sec. 10-42. – Inhumane treatment of dogs prohibited. 27
It shall be unlawful for the owner or keeper of any dog to keep such dog in any enclosure or on 28
any leash or other restraint unless the restraint shall be so arranged that such dog shall at all 29
times have available water, shade and proper shelter, or to treat any dog in any other inhumane 30
manner. 31
Sec. 10-43 – Dog Tethering. 32
(a) Duty to restrain and contain dogs. 33
(1) It shall be the duty of every owner or person in charge of a dog to keep the animal under 34
effective restraint, while the dog is within the city, whether or not the dog is upon the premises 35
of its owner or away from said premises. It shall be unlawful for the owner or person in charge 36
of any dog to fail to keep the animal under effective restraint. Proof that a dog is not properly 37
restrained off the premises of the owner or person in charge shall be prima facie evidence of a 38
violation. Competent evidence that the failure was due to an unforeseeable and independent 39
act of a third person shall shift the burden on the city to prove otherwise. 40
(2) The methods used to contain a dog while on his premises is within the discretion of the 41
owner provided the conditions do not present a hazard to the dog, a hazard to the general 42
public or otherwise fails to comply with the provisions of this section. Ordinary containment 43
methods include housing the dog inside of a residential structure, or if outside then by the use 44
of a fence and/or pen, provided that the use of such method complies with the requirements 45
herein. 46
(b) Chaining/tethering dogs. 47
(1) Direct point chaining, tethering, and trolley chaining of dogs to any object, stationary or 48
otherwise, is prohibited. 49
(2) Notwithstanding the foregoing, a dog may be tethered while actively participating in or 50
attending an organized show, field trial, agility event, herding contest or other similar exposition 51
or event as long as it is conducted outdoors, is of a limited duration, and involves the judging 52
or evaluation of animals; or, when under the care and supervision of a licensed veterinarian. 53
In all cases, any person who tethers a dog in accordance with this section shall ensure that the 54
animal is tethered in such a manner as to prevent injury, strangulation, entanglement or 1
neglect. 2
(3) No person owning or keeping a dog shall subject the dog to cruel conditions or inhumane 3
tethering at any time. Cruel conditions and inhumane tethering are defined as, but not limited 4
to, the following conditions: 5
(a) Filthy and dirty confinement conditions, including but not limited to exposure to excessive 6
animal waste, garbage, dirty water, noxious odors, dangerous objects that could injure or kill 7
the dog upon contact, or other circumstances that could cause harm to the dog's physical 8
health. 9
(b) Taunting, prodding, hitting, harassing, threatening or otherwise harming a tethered or 10
confined dog. 11
(c) Subjecting the dog to dangerous conditions, including but not limited to attack by other 12
animals. 13
(4) Any dog kept habitually outside which is not constrained in accordance with the provisions 14
of this section must be kept inside a residential structure, or in a fenced area or pen which is 15
suitable for the size of the dog as determined by the animal control officer. 16
(c) Minimum care of dogs living outside. 17
(1) Shelter. 18
(a) Any dog that is habitually kept outside or repeatedly left outside unattended by an adult 19
person, whether contained in a pen or contained in a fenced area, shall be provided with a 20
structurally sound, moisture-proof and wind-proof shelter large enough to keep 21
the dog reasonably clean and dry. A shelter which does not protect the dog from temperature 22
extremes or precipitation, or which does not provide adequate ventilation or drainage, shall not 23
comply with this section. 24
(b) A dog's shelter and bedding and other accessible space shall be maintained in a manner 25
which minimizes the risk of the dog contracting disease, being injured or becoming infested 26
with parasites. 27
(c) During the winter months, the shelter must not only be wind and moisture proof but also of 28
a proportionate size to allow the natural body heat of the dog to be retained in cold weather. 29
(d) A shelter for a dog must be a structure having four sides in addition to a roof and floor with 30
one side having an entrance or an Igloo type structure specifically designed for outdoor housing 31
of a dog. The dog must be able to enter, stand, sit, lie down and turn around in the shelter in a 32
normal manner. Metal drums and transport carriers designed to move a dog from one location 33
to another and which do not have solid walls, are not considered shelter. 34
(e) The shelter floor shall be raised at least two inches above the ground and be free of cracks, 35
holes or protruding nails or rough edges that could cause injury. 36
(f) The shelter shall be maintained and cleaned regularly. The area around the shelter shall be 37
kept clean of accumulated feces, garbage and any other debris. 38
(g) The shelter shall be placed in an area that provides protection from the direct rays of the 39
sun, when sunlight is likely to cause overheating or discomfort. 40
(2) Nutrition. 41
(a) It shall be unlawful for any person keeping or harboring any dog to fail, refuse or neglect to 42
provide such dog with clean, fresh potable water adequate for the dog's size, age, and physical 43
condition. This water supply shall be either free flowing or provided in a removable receptacle 44
that is weighted and secured to prevent tipping. 45
(b) It shall be unlawful for any person keeping or harboring any dog to fail, refuse or neglect to 1
provide such dog with wholesome foodstuff suitable for the dog's physical condition and age 2
and in sufficient quantities to maintain an adequate level of nutrition for the dog. 3
(c) Violations. Violations of this section are declared a misdemeanor. Any person who violates 4
any provisions of this section shall be guilty of a misdemeanor and, unless otherwise provided 5
herein, shall, upon conviction or adjudication of guilt, be punished by a fine of not less than 6
$100.00 and in addition thereto may be punished by imprisonment in the metro jail or a 7
combination thereof, for a period not exceeding six months and costs of court. However, the 8
municipal judge shall have the authority and discretion to order community service for violation 9
of this section and in such an event, the fines and court costs may be adjusted or remitted upon 10
the completion of court ordered community service. 11
(d) Removal of animals. In accordance with Code of Alabama, 1975, § 3-1-13 any duly 12
authorized officer or employee of a recognized humane society shall have the right to take 13
charge of any animal which is sick or disable due to neglect or is being cruelly treated or abused 14
and to provide care for such animal until it is deemed to be in suitable condition to be returned 15
to its owner or the person from whose custody such animal was taken. 16
Therefore, in addition to the actions that may be taken under the Violations section of this 17
section, the animal control officer for the City of Prattville shall have the authority to remove 18
any dog which is being held in violation of this section from its owner or person having custody 19
and deliver it to the Elmore or Autauga County Humane Shelter for care and keeping. The 20
owner or custodian shall have ten days after notice of said removal to remedy the violation or 21
violations under this section and retrieve the dog from the humane shelter. The owner or 22
custodian shall be responsible for the cost of care for the period that it remains at the humane 23
shelter and if the dog is not retrieved at the end of ten days then the humane shelter shall 24
proceed according to Code of Alabama, 1975, § 3-1-13 in handling the animal. 25
THIS ordinance shall become effective upon its passage and execution as provided by 26
27
law. Each of the provisions of this ordinance are severable; and if any provision shall be 28
29
declared to be invalid, the remaining provisions shall not be affected but shall remain in full 30
31
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby 32
33
repealed. 34

Mill Properties LLC, through a Lease and Indemnity Agreement.; and 15

WHEREAS, the City of Prattville has identified said leased land and surrounding 17

property, as described in “Attachment A”, as parcels of interest to purchase; and 19

WHEREAS, the City of Prattville desires to nurture the history of the City and 21
22
supplement the City’s recreational facilities by purchasing said property from Pratt Mill 23
24
Properties LLC for inclusion with other public locales managed by the Parks and Recreation 25
26
Department; and 27

WHEREAS, the City of Prattville has an allocation from the American Rescue Plan Act 29
30
2021 through the Coronavirus State and Local Fiscal Recovery Funds; and 31
32
WHEREAS, since the onset of the COVID-19 pandemic, the citizens of Prattville have 33
34
been under various lockdowns and shelter-in-place guidelines that have made it burdensome 35
36
to participate in the daily exercise desired by many; and 37
38
WHEREAS, the City desires to be responsive to the needs of certain disproportionately 39
40
impacted communities in the City by promoting healthier living environments and outdoor 41
42
recreation and socialization to mitigate the spread of COVID-19 and promote increased mental 43
44
health; and 45

WHEREAS, the Coronavirus State and Local Fiscal Recovery Fund permits the use of 47
48
such funds for investments in parks and outdoor spaces that serve said purpose. 49

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 51

that the Mayor is hereby authorized to enter into an agreement with Pratt Mill Properties LLC 53

extraordinary demands placed on City of Prattville employees to meet the daily needs of the 17

WHEREAS, said payments were permitted and encouraged to be paid with funds from 21

the American Rescue Plan Act through the Coronavirus State and Local Fiscal Recovery 23

Funds; and 25

WHEREAS, on July 9, 2021, said payments were made in the first full pay period after 27

the receipt of said funds; and 29
