Staff Comments:
The proposed preliminary plat, Prattville Square Shopping Center Plat No. 1, proposes to combine two parcels that
currently include Prattville Square Shopping Center buildings and three outbuildings. Additionally, this subdivision
proposes to cut out an outparcel that borders North Memorial Drive creating two new parcels, Lot A, approximately
8.11 acres, including Prattville Square Shopping Center and one outbuilding and a smaller parcel, Lot B,
approximately 1.02 acres, bordering North Memorial Drive that includes First Franklin Financial (111 North
Memorial Drive) and the former Fountain City Pharmacy (105 North Memorial Drive) buildings.
All parcels as part of this subdivision have sufficient street connectivity to North Memorial Drive and Wetumpka
Street. All parcels also have access to existing water and sewer facilities.
As drawn, this preliminary plat creates a non-conforming lot due to setbacks in B-3 zoning district. B-3 zoning district
requires setbacks of 35 feet on all sides. Proposed Lot B creates setbacks of approximately 8 feet on the south side
and approximately 10 feet on the west side, which would be in violation of the Prattville Zoning Ordinance and
Subdivision Regulations.
City Staff reviewed the Prattville Square Shopping Center preliminary plat and has provided extensive
comments for developer to address.
Waiver Request:
Applicant is requesting a waiver from the City of Prattville Subdivisions Regulations related to creating a non-
conforming lot. Specifically, the waiver request is a request for relief from the setback requirements for the
district. Please see specific Subdivision regulations in violation below.

Staff Comments: The Smith Property Phase II preliminary plat proposes to subdivide 51.49 acres. 38.75 acres will
be residential comprising of 85 single family parcels. Additionally, tis preliminary plat cuts out
three commercial outparcels, one at the corner of Hwy 82 & 31, one at the corner of Hwy 82 &
McQueen Smith Road, and one on the west of the parcel bordering Hwy 31. Public water and
sewer are available. Street connectivity consists of three outlets. Two outlets are on McQueen
Smith Road and one is located on highway 31. There will be no outlet on to US Hwy 82. The
proposed plat does match the fabric of the surrounding area. Residential neighborhood is located
to the east and parcel zoned R-3 is located to the north.

D. EVALUATION/COMMENTS: Proposed Use: The existing Circle K gas station/convenience store desires to rebuild at the existing site. No
further development has been proposed on other parcels or sites.
Street Connectivity: Parcels have frontage along South Memorial Dr (Hwy 31).
Water/Sewer:
Comments: These parcels were annexed as part of the State’s local legislation in 2018 (Act# 2018-183).
Circle K Stores originally submitted this for rezoning. In order to include adjoining property
(Jarrett property) in the zoning process, City staff decided to become the applicant for this
request.
E. COMPREHENSIVE PLAN:
The subject site has a Future Land Use Map (FLUM) designation of Mixed-Use Commercial.
On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land
Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcels in a Mixed-Use Commercial area. The property is currently incorporated but unzoned. The proposed Zoning Map Amendment to B-2 meets the general fabric and pattern of the area.

CITY OF PRATTVILLE PLANNING COMMISSION 1 MINUTES 2 3 August 19, 2021 4 5 Call to order: 6 Chairman Tim Smith called the meeting to order at 3:03 p.m. 7
8 Roll Call: 9 Members present were Mayor Bill Gillespie, Councilman John Chambers, Chairman Tim Smith, Vice-Chairman 10 Reuben Gardner, Chief Dallis Johnson, Mr. Ken Daniel, and Mr. Mugs Mullins. Absent: Mrs. Paula Carpenter 11 and Mr. Seth Hayden. 12 13

Minutes: 19 Mr. Gardner moved to approve the minutes of the July 15, 2021 meeting and the August 4, 2021 work session. 20 Chief Johnson seconded the motion. The motion passed unanimously. 21
22 Committee Reports: 23 Mr. Stephens provided an update on the progress of the Zoning Ordinance rewrite which was the topic of the 24
August 4th work session. He asked that the Commission would schedule an additional work session to continue 25 the discussion on the zoning revision. The Commission scheduled the next work session for September 1, 2021 26 at lunch time location to be determined. 27 28 Old Business: 29 There was no old business to discuss. 30 31 New Business: 32 1. Preliminary Plat: Prattville Square Shopping Center Plat 1 33 Location: North Memorial Drive 34 Owner: Tanner & Guin 35 Representative: Flowers & White Engineering, LLC 36 37 This agenda item was postponed at the July meeting at the petitioner’s request. The petitioner requested that the 38
preliminary plat of Prattville Square Shopping Center Plat 1 be held until the next meeting (September). (E-letter 39 attached and made a part of the minutes). 40 41

Mr. Rigsby introduced the preliminary plat of Birdsong 2. He stated that the approximately .67 acre lot 47 will be subdivided into two lots on the private street of Birdsong Street. He stated that both lots have 48 frontage on Birdsong and Lower Kingston. Staff have requested that the driveway access be on Birdsong 49 and not Lower Kingston. He stated that the proposed plat meets the requirements of the Subdivision 50 Regulations and Zoning Ordinance and staff recommends approval. 51 52 Chairman Smith opened the floor for public comments. Mary Ann Wingard, asked who is responsible for 53 maintaining the private street, Birdsong Street. 54 55

Ronald Ramos, stated that he is a long time Habitat homebuilder. He stated that Habitat homeowners have always 56
been good neighbors in contributing to their neighborhood. 57 58 The public hearing was closed. 59
60 Mr. Mullins introduced a resolution recommending approval of the preliminary plat of Birdsong Plat 2 and moved 61 for its approval. Mr. Gardner seconded the motion. 62
63 Richard Short, representative for Habitat for Humanity of Autauga and Chilton Counties, addressed comments 64 about street maintenance. He stated that Habitat homeowners are on either side of Birdsong Street at the entrance 65 off Lower Kingston Road. That portion of the road would be considered as home maintenance for the homeowner. 66 He stated that home maintenance is monitored by Habitat administration as required by the homeowners 67 partnering with Habitat. 68 69 Daon Johnson, Executive Director of Habitat for Humanity of Autauga and Chilton Counties, addressed the 70 Commission and explained the process that the organization follow to ensure that property is being maintained 71 by Habitat homeowners. Ms. Johnson stated that current homeowners of Birdsong Street have not maintained 72 the street in years. 73
74 Guthrie Jeffcoat of Jeffcoat Engineers & Surveyors, LLC, petitioner’s representative, stated that the 75 ownership of the private street goes to each homeowner with access to it. 76
77 Mr. Stephens reiterated that the two proposed lots have frontage on Lower Kingston, therefore, they meet 78 the requirements of the subdivision regulations. The staff have requested that the driveway access be on 79
Birdsong and not Lower Kingston to reduce the number of driveway cuts on the main road for traffic 80 safety. Chief Johnson commented that it might be more beneficial for emergency vehicles for those lots 81 to access Lower Kingston Road 82 83 Councilman Chambers asked the petitioner their opinion on the driveway accessing from Lower Kingston 84 Road. Mr. Short stated that they could do either, but is not sure if the driveway access to Lower Kingston 85 is a safety issue. He stated the exit from Birdsong Street was designed by the city’s recommendation. 86 87 After their discussion, the vote was called. Mr. Mullins moved to amend the motion to approve contingent that 88 the access restriction be lifted to allow driveway access fronting on Lower Kingston Road. The motion to approve 89 passed unanimously. 90 91 After no further discussion, the amended motion to approve passed unanimously. 92 93
The Chairman called for a recess at 3:41. The meeting was called back to order at 3:51 with all members present 94 from the initial roll call. 95 96
