WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 15

WHEREAS, an abundance of overgrown grass or weeds: 8

1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17
18
the City Council of the City of Prattville to declare an abundance of overgrown grass and 19
20
weeds to be a public nuisance; and 21
22
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23
24
the property at the following addresses and determined the existence of an abundance of 25
26
overgrown grass and weeds: 27

weeds at the above-listed addresses to be a public nuisance; and 37
2. the owners of said property, as they appear in the records of the Autauga County or 38
Elmore County Revenue Commissioners, are ordered to abate the abundance of 39
overgrown grass and weeds; and 40
3. the owners of said property are ordered to appear before the City Council of the City of 41
Prattville at a public hearing on November 2, 2021, at 6:00 p.m., in Prattville City Hall; 42

BE IT ORDAINED by the City Council of the City of Prattville, Alabama that Chapter 38, 10
11
“Business Licenses and Taxes”, Article V, Section 38-515 is amended as follows: 12
13
Chapter 38 – Business Licenses and Taxes 14
Article V. 15
Sec. 38-515. – Outdoor Alcohol Service 16
(a) Prerequisites. It shall be unlawful in the City to engage in the business of 17
outdoor alcohol service without first complying with the provisions of this section and 18
obtaining an outdoor alcohol service permit. 19
(1) “Outdoor Alcohol Service” is defined as the sale or service of alcoholic 20
beverages which are subject to regulation or control by the state alcoholic beverage 21
control board, in an open-air setting on public or private property. 22
(c) Businesses desiring to conduct outdoor alcohol service must as a 23
prerequisite, be properly licensed to serve alcohol and/or food indoors with the City 24
and through the State ABC Board and be in compliance with the provisions of this 25
Code of Ordinances and with § 28-3A-1, Code of Alabama (1975) et. seq. 26
(b) Process. An Outdoor Alcohol Service Permit may be obtained by a business 27
through the following process: 28
(1) Said business must present plans for approval of a permanent outdoor 29
barrier which is aesthetically pleasing, not readily removable and is constructed with 30
materials, textures and colors which keep with the principle architecture of the 31
existing structure of the business. The permanent outdoor barrier shall be located in 32
such a manner on the business property so it is readily visible and distinguishable, 33
and so that it does not impede the regular flow of vehicular and pedestrian traffic on 34
public rights of way, parking lots, paths of ingress/egress, and/or easements. The 35
outdoor alcohol service is to be conducted only within the confines of this permanent 36
outdoor barrier. 37
(2) The City Planning Department and the Prattville Police Department shall 38
approve of the plans for the permanent outdoor barrier and shall again be permitted 39
to conduct a final inspection and approval after said barrier is complete. An approval 40
by the City Planning Department and/or the Prattville Police Department does not 41
exempt the applicant from any other required approvals or committees which the 42
applicant may be additionally subject to based on the location of the applicant’s 43
business. 44
(3) Upon final inspection and approval of the constructed permanent outdoor barrier, 45
the City may issue to the applying business a permit for Outdoor Alcohol Service. 46
(c) Penalties. 47
(1) Any business or individual found to be in knowing violation of this 48
ordinance is subject to the loss of any of its existing alcohol licenses held by the City. 49
A violation of this article relative to obtaining a permit to conduct outdoor alcohol 50
service shall be punishable by a fine not to exceed $500.00 for each offense, and if 51
the violation is a willful violation, by such fine and imprisonment not to exceed six 52
months, or both fine and imprisonment, at the discretion of the court trying the same. 53
Each day shall constitute a separate offense. 54
(2) Any violation of this section not remedied within thirty (30) days of notice of 1
the violation shall subject the applicant to a revocation of an Outdoor Alcohol Service 2
Permit. 3

THIS Ordinance shall become effective on December 1, 2021, and upon its passage 5
6
and execution as provided by law. Each of the provisions of this Ordinance are severable; 7
8
and if any provision shall be declared to be invalid, the remaining provisions shall not be 9
10
affected but shall remain in full force. All ordinances, or parts of ordinances, in any manner 11
12
conflicting herewith are hereby repealed. 13

WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
October 5, 2021, permitting the owners of said properties to present evidence, objections, and 37
38
protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 41
42
declares that the abundance of overgrown grass and weeds on the properties continue to be 43
44
a public nuisance: 45

Any property owner shall have the right to have any weeds removed at his or her own 1

WHEREAS, the City of Prattville has an opportunity to purchase real estate in the 10

corporate limits of the City of Prattville through Project Katz; and 12

WHEREAS, the City of Prattville has determined acquiring said real estate would 14
15
serve as an economic development opportunity for the City of Prattville; and 16
17
WHEREAS, §9-15-100, Code of Alabama, 1975, as amended, states that a 18
19
municipality shall disclose information concerning the purchase of any real property with public 20
21
funds within sixty (60) days following the purchase. 22
23
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 24
25
that the FY2021 Budget is hereby amended as follows: 26
27
Increase Executive/ Capital Outlay $1,300,000.00 28
Increase General Fund/ Sales Tax Revenue $1,300,000.00 29

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to enter into an 31

agreement to purchase said property at a net cost not to exceed $1,300,000.00, plus closing 33
34
costs, and said purchase is hereby approved and appropriated to be paid from FY2021 Budget 35

Line Item Executive/ Capital Outlay. 37

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 39

all documents necessary to carry out the intent of this Resolution. 41

WHEREAS, §11-40-10, Code of Alabama, 1975, as amended, sets out the legal 8
9
requisites for the police jurisdiction for municipalities having 6,000 or more inhabitants, 10
11
particularly designating the police jurisdiction as all adjoining territory within three miles of the 12
13
corporate limits; and 14
15
WHEREAS, §11-40-10, Code of Alabama, 1975, as amended, was recently amended 16
17
to allow a municipality, by ordinance, to reduce its police jurisdiction outside the corporate limits 18
19
of the municipality by any number of half-mile increments, in addition to allowing the 20
21
municipality to cease to provide any service to its police jurisdiction outside its corporate limits; 22
23
and 24
25
WHEREAS, the City of Prattville has provided certain municipal services to certain 26
27
areas of its police jurisdiction, and there is a need to determine the best course of action should 28
29
the City decide to reduce its police jurisdiction or cease providing services therein. 30
31
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Prattville 32
33
hereby authorizes Andrew Odom, City Attorney, to request the Honorable Steve Marshall, 34
35
Attorney General for the State of Alabama, to give his opinion on how the City’s services in the 36
37
Police Jurisdiction, in light of the provisions of the recently amended §11-40-10, Code of 38
39
Alabama, 1975, as amended, should operate and/or continue. 40

WHEREAS, the City Council makes the appointment for the City Clerk in accordance 16

with §11-43-3 of the Code of Alabama, 1975, as amended; and 18

WHEREAS, §11-43-3 states that the City Clerk shall hold office until the next general 20

election or until their successors are elected and qualified. 22

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 24

hereby appoints Paula G. Barlow to the position of City Clerk effective October 6, 2021, at Pay 26

Grade 23-A, and said appointment shall be for the remainder of the 2020-2024 Quadrennium 28

calculates, reviews and offers incentives and other assistance to businesses who are 13
14
interested in locating within the City of Prattville; and 15

WHEREAS, the team has met and recommended incentives for Project Mayfield for 17
18
the purpose of economic development in the City of Prattville. 19

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 21
22
concurs that an incentive package be offered and hereby approves the recommendations of 23
24
the Prattville Economic Development Team. 25

BE IT FURTHER RESOLVED that the City Council of the City of Prattville hereby 27
28
authorizes the Mayor of the City of Prattville to execute for and on behalf of the City any and 29
30
all documents and agreements necessary to effectuate the grant and provision of said 31
