WHEREAS, an abundance of overgrown grass or weeds: 8
9
1. is injurious to the public health, safety and general welfare by providing a breeding 10
ground and shelter for rats, mice, snakes, mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13
such property; and 14
4. may also pose a fire hazard and respiratory hazard; and 15
16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17
18
2021-A, Page 197, that the abundance of overgrown grass and weeds at various addresses 19
20
in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22
nuisances; and 23
24
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25
26
was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject 27
28
property; and 29
30
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32
said properties and determined that the public nuisance still exists; and 33
34
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35
36
December 7, 2021, permitting the owners of said properties to present evidence, objections, 37
38
and protest regarding the proposed removal of weeds. 39
40
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 41
42
declares that the abundance of overgrown grass and weeds on the properties continue to be 43
44
a public nuisance: 45

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and 57

weeds on the property listed above cut or removed using city forces or private contractors. 59

Any property owner shall have the right to have any weeds removed at his or her own 61

expense provided the removal is done prior to the commencement of work by employees or 63
agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to the 1

removal of overgrown grass and weeds and report such cost to the City Council following 3
4
their removal. 5

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 9

THAT the zoning ordinance of the City of Prattville, Alabama, adopted on February 10, 11

1950, subsequently amended from time to time, and the zoning map adopted on May 1, 1987, 13
14
are hereby amended to reclassify the property described in Attachment “A” from FAR (Forest, 15
16
Agricultural, Recreation) to R-5 (Patio Garden Homes); and 17
18
THAT this proposed ordinance and a synopsis was advertised for two (2) weeks in the 19
20
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of 21
22
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on December 23
24
7, 2021, at 6:00 p.m., considered said proposed ordinance and that at such time and place all 25
26
persons who desired had an opportunity to be heard in favor of or in opposition to such 27
28
ordinance. 29

ALL other items and provisions of the zoning ordinance of the City of Prattville not herein 31

specifically amended shall remain in full force and effect. 33

THE amendments herein contained were considered and recommended by the City of 35

of the City of Prattville authorized the Mayor to enter into a one-year lease agreement with 10

Fountain City BMX, Inc. to operate a BMX Park on City property located on County Road 4; 12
13
and 14

WHEREAS, said lease agreement will expire on December 31, 2021; and 16
17
WHEREAS, Fountain City BMX, Inc., a non-profit organization, has expressed a desire 18
19
to continue to operate said BMX Park and possesses the degree of expertise necessary to 20
21
operate the course. 22
23
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Prattville 24
25
hereby authorizes the Mayor to enter into a Lease Agreement between the City of Prattville 26
27
and Fountain City BMX, Inc. for the continuing use of said City property to operate a BMX Park 28
29
for a one-year period from January 1, 2022, through December 31, 2022. 30

WHEREAS, Alabama Bass Trail desires to conduct and promote an Alabama Bass Trail 9

Tournament Series Divisional with a tournament date of May 21, 2022; and 11

WHEREAS, the host fee for said event shall be $7,500.00; and 15

WHEREAS, this is a budgeted expense of the Parks and Recreation Department. 17

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Prattville, 19

that the Mayor is hereby authorized to enter into an agreement with Alabama Bass Trail to host 21

said tournament on May 21, 2022. 23

Council of the City of Prattville authorized the release of funds for updated equipment and 13

licenses for the Police Department through the NPPGov Purchasing Cooperative from Axon 15

Enterprise, Inc.; and 17
18
WHEREAS, the Mayor signed a Statement of Work / Purchase Agreement for said 19
20
equipment and licenses on November 18, 2019; and 21
22
WHEREAS, the Police Department has identified a need for additional body-worn 23
24
cameras, in-vehicle camera systems and licensing for sworn law enforcement personnel; and 25
26
WHEREAS, said additional hardware and licenses are available through the NPPGov 27
28
Purchasing Cooperative, Contract Number VH11629, from Axon Enterprise, Inc., at a net cost 29
30
not to exceed $82,710.00 (FY2022 Annual Cost Not to Exceed $26,700.00); and 31
32
WHEREAS, payments for said additional hardware and licenses shall be equally divided 33
34
over the remaining three years of the life of the purchase agreement; and 35
36
WHEREAS, the annual cost for FY 2022 is a budgeted expense for the Police 37
38
Department. 39

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Prattville, 41

WHEREAS, the Engineering Department had specifications drafted for the new Street 12

Department facility as evidenced by Resolution Book 2021, Page 091, on June 1, 2021; and 14

WHEREAS, two (2) sealed bids were received, opened, and read on November 22, 16
17
2021, at 10:00 a.m., in the City Council Chambers; and 18
19
WHEREAS, all bids received were in excess of funds available for said project; and 20
21
WHEREAS, the City of Prattville reserved the right to reject all bids. 22

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 24
25
hereby rejects all bids received for Bid No. 021-007 for a new Street Department facility. 26

WHEREAS, the City of Prattville has identified the need to widen McQueen Smith Road 10

from Cobbs Ford Road to U.S. Highway 31; and 12

WHEREAS, additional right-of-way is required from YMCA of Prattville for said project; 14
15
and 16

WHEREAS, the City of Prattville has entered into an Agreement with the Alabama 18
19
Department of Transportation, Project No. DEMO-STPAA-A203, to acquire the needed right- 20
21
of-way; and 22
23
WHEREAS, said right-of-way is valued at a cost not to exceed $197,325.00; and 24
25
WHEREAS, the Alabama Department of Transportation shall reimburse the City of 26
27
Prattville for 100% of said cost. 28

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 30

hereby authorizes the Mayor to enter into an Agreement with YMCA of Prattville to acquire said 32
33
right-of-way (Tract 9) for the widening of McQueen Smith Road from Cobbs Ford Road to U.S. 34
35
Highway 31 in an amount not to exceed $197,325.00 (zero cost to the City), and said funds are 36
37
approved and appropriated from FY 2022 Budget Line Item Capital Projects Fund/ McQueen 38

BE IT FURTHER RESOLVED that the City Council of the City of Prattville does hereby 42

authorize the Mayor to execute any and all documents necessary to have this work performed 44
45
for and on behalf of the City of Prattville. 46

Rights-of-Way for the Widening of McQueen Smith Road from Cobbs Ford Road to U.S. 4
Highway 31 for Project No. DEMO-STPAA-A203 in an Amount Not to Exceed $89,418.00 5

WHEREAS, the City of Prattville has identified the need to widen McQueen Smith Road 10
11
from Cobbs Ford Road to U.S. Highway 31; and 12
13
WHEREAS, additional rights-of-way are required from various property owners for said 14
15
project; and 16
17
WHEREAS, the City of Prattville has entered into an Agreement with the Alabama 18
19
Department of Transportation, Project No. DEMO-STPAA-A203, to acquire the needed rights- 20
21
of-way; and 22
23
WHEREAS, said rights-of-way are valued at a total cost not to exceed $89,418.00; and 24
25
WHEREAS, the Alabama Department of Transportation shall reimburse the City of 26
27
Prattville for 100% of said cost. 28

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 30
31
hereby authorizes the Mayor to enter into an Agreement with various property owners 32
33
to acquire said rights-of-way for the widening of McQueen Smith Road from Cobbs Ford Road 34
35
to U.S. Highway 31 in a total amount not to exceed $89,418.00 (zero cost to the City), and said 36
37
funds are approved and appropriated from FY 2022 Budget Line Item Capital Projects Fund/ 38
39
McQueen Smith Road. 40

BE IT FURTHER RESOLVED that the City Council of the City of Prattville does hereby 42
43
authorize the Mayor to execute any and all documents necessary to have this work performed 44
45
for and on behalf of the City of Prattville. 46
