CITY OF PRATTVILLE PLANNING COMMISSION MINUTES August 19, 2021 Call to order: Chairman Tim Smith called the meeting to order at 3:03 p.m.
Roll Call: Members present were Mayor Bill Gillespie, Councilman John Chambers, Chairman Tim Smith, Vice-Chairman Reuben Gardner, Chief Dallis Johnson, Mr. Ken Daniel, and Mr. Mugs Mullins. Absent: Mrs. Paula Carpenter and Mr. Seth Hayden.
(Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Darrell Rigsby, Senior Planner; Mr. Tommie Williams, Planner; and Ms. Alisa Morgan, Secretary.
Minutes: Mr. Gardner moved to approve the minutes of the July 15, 2021 meeting and the August 4, 2021 work session. Chief Johnson seconded the motion. The motion passed unanimously.
Committee Reports: Mr. Stephens provided an update on the progress of the Zoning Ordinance rewrite which was the topic of the
August 4th work session. He asked that the Commission would schedule an additional work session to continue the discussion on the zoning revision. The Commission scheduled the next work session for September 1, 2021 at lunch time location to be determined. Old Business: There was no old business to discuss. New Business: 1. Preliminary Plat: Prattville Square Shopping Center Plat 1 Location: North Memorial Drive Owner: Tanner & Guin Representative: Flowers & White Engineering, LLC This agenda item was postponed at the July meeting at the petitioner’s request. The petitioner requested that the
preliminary plat of Prattville Square Shopping Center Plat 1 be held until the next meeting (September). (E-letter attached and made a part of the minutes).
2. Preliminary Plat: Birdsong 2
Location: Lower Kingston Road & Birdsong Street
Petitioner: Habitat for Humanity of Autauga & Chilton Counties, Inc.
Representative: Jeffcoat Engineers & Surveyors, LLC
Mr. Rigsby introduced the preliminary plat of Birdsong 2. He stated that the approximately .67 acre lot will be subdivided into two lots on the private street of Birdsong Street. He stated that both lots have frontage on Birdsong and Lower Kingston. Staff have requested that the driveway access be on Birdsong and not Lower Kingston. He stated that the proposed plat meets the requirements of the Subdivision Regulations and Zoning Ordinance and staff recommends approval. Chairman Smith opened the floor for public comments. Mary Ann Wingard, asked who is responsible for maintaining the private street, Birdsong Street.

Ronald Ramos, stated that he is a long time Habitat homebuilder. He stated that Habitat homeowners have always
been good neighbors in contributing to their neighborhood. The public hearing was closed.
Mr. Mullins introduced a resolution recommending approval of the preliminary plat of Birdsong Plat 2 and moved for its approval. Mr. Gardner seconded the motion.
Richard Short, representative for Habitat for Humanity of Autauga and Chilton Counties, addressed comments about street maintenance. He stated that Habitat homeowners are on either side of Birdsong Street at the entrance off Lower Kingston Road. That portion of the road would be considered as home maintenance for the homeowner. He stated that home maintenance is monitored by Habitat administration as required by the homeowners partnering with Habitat. Daon Johnson, Executive Director of Habitat for Humanity of Autauga and Chilton Counties, addressed the Commission and explained the process that the organization follow to ensure that property is being maintained by Habitat homeowners. Ms. Johnson stated that current homeowners of Birdsong Street have not maintained the street in years.
Guthrie Jeffcoat of Jeffcoat Engineers & Surveyors, LLC, petitioner’s representative, stated that the ownership of the private street goes to each homeowner with access to it.
Mr. Stephens reiterated that the two proposed lots have frontage on Lower Kingston, therefore, they meet the requirements of the subdivision regulations. The staff have requested that the driveway access be on
Birdsong and not Lower Kingston to reduce the number of driveway cuts on the main road for traffic safety. Chief Johnson commented that it might be more beneficial for emergency vehicles for those lots to access Lower Kingston Road Councilman Chambers asked the petitioner their opinion on the driveway accessing from Lower Kingston Road. Mr. Short stated that they could do either, but is not sure if the driveway access to Lower Kingston is a safety issue. He stated the exit from Birdsong Street was designed by the city’s recommendation. After their discussion, the vote was called. Mr. Mullins moved to amend the motion to approve contingent that the access restriction be lifted to allow driveway access fronting on Lower Kingston Road. The motion to approve passed unanimously.
After no further discussion, the amended motion to approve passed unanimously. The Chairman called for a recess at 3:41. The meeting was called back to order at 3:51 with all members present from the initial roll call.
Miscellaneous Business:
Mr. Stephens introduced Jason Fondren, consultant with KPS Group, who presented for discussion the proposed revisions of the Zoning Ordinance, Articles 8 and Article 9. Adjourn: There being no other business, the meeting was adjourned at 4:24 p.m. Respectfully submitted,

Staff Comments:
This proposed preliminary plat, Birdsong 2, is proposing to subdivide a single 0.673 acre parcel at the northern corner
of Birdsong Street (a private street) and Lower Kingston Road into two single family parcels. Lot 1, totaling 0.308
acres will be at the corner of the intersection and extend back along Birdsong Street and Lot 2, totaling 0.365 acres
will have a 30’ drive access to Birdsong Street. Both lots have frontage on Birdsong and Lower Kingston. Staff have
requested that the driveway access be on Birdsong and not Lower Kingston. This proposed plat meets the
requirements of the Subdivision Regulations and Zoning Ordinance and staff recommend approval.
