WHEREAS, the City of Prattville has certain items of personal property which are no 7

longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11
12
governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 15
16
the following personal property owned by the City of Prattville is no longer needed for public or 17
18
municipal purposes, and said property shall be removed from the inventory of Performing and 19
20

WHEREAS, a vacancy currently exists on the Autauga-Prattville Public Library Board of 8

Trustees due to the death of Mr. Willis Bradford on November 29, 2021; and 10

WHEREAS, it is the desire of the City Council of the City of Prattville to ensure the 12

continuity of the Board’s operation. 14

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 16
17
Samuel Wayne Lambert is hereby appointed to fill the vacancy on the Autauga -Prattville Public 18
19
Library Board of Trustees effective immediately and said term shall expire on November 30, 20

WHEREAS, the City of Prattville is a historic community that attracts thousands of 8
9
visitors each year; and 10
11
WHEREAS, tourism is an important part of the local economy, including short -term 12
13
rentals at hotels, and increasingly, in residential neighborhoods; and 14
15
WHEREAS, in recent years, the density and frequency of rentals of less than 30 days, 16
17
or short-term rentals, in residential neighborhoods has increased, due in large part to the 18
19
web-based marketing tools such as Airbnb, Vacation Rental by Owner, and the like; and 20
21
WHEREAS, the increase in transient occupancy has had an adverse impact on 22
23
residential neighborhoods subsequently generating excess noise, traffic and trash; and 24
25
WHEREAS, the City of Prattville Police Department has reported that calls to short- 26
27
term rentals in residential neighborhoods have increased and similar detrimental effects have 28
29
been documented in numerous studies in cities around Alabama and the United Sta tes; and 30
31
WHEREAS the City of Prattville is in the process of studying the issue in order to 32
33
make recommendations to the Council on the best approach for the City, including 34
35
conducting work session(s), other studies, and proposing an ordinance regarding the 36
37
regulation of short-term rentals. 38
39
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville, 40
41
that in order to protect the public health, safety and welfare, it is in the best interest of the 42
43
City to declare a temporary moratorium on issuing business licenses on short-term rentals. 44
45
BE IT FURTHER ORDAINED by the City Council of the City of Prattville, that: 46
47
1. Beginning with the effective date of this Ordinance, no new short-term rental licenses 48
shall be approved or issued for a period of six months from the date of this ordinance, 49
except as provided below: 50
51
a. annual renewals of existing short-term rental licenses shall be permitted as allowed by 52
Chapter 38, Article V-Business Licenses and Taxes of the City of Prattville Code of 53
Ordinances; and 54
55
b. new business licenses for short-term rentals shall be issued only to operators who 56
submit to the Finance Department clear and convincing evidence that as of the effective 57
date of this ordinance: 58
59
1) the operator had made a substantial investment in expectation of operating a short- 60
term rental at the residential dwelling for which the license is sought; and 61
62
2) operations related to short-term rentals will not be in violation of any other laws 63
governing the use of the property. 64
c. no new licenses shall be issued pursuant to the exceptions listed above unless the 1
applicant: 2
3
1) pays any fines and/or taxes owed for any operation of a short-term rental license; 4
and 5
6
2) certifies that the operation of a short-term rental in the residential dwelling will not 7
be in violation of law or other valid restrictions governing the use of the property and 8
that any Home Owners Association (HOA) to which the property belongs has been 9
notified of the application for a short-term rental permit, a copy of which notification 10
shall be included with the application. 11
12
d. the Finance Director shall evaluate the evidence submitted by an applicant, and may 13
ask for additional information deemed appropriate and shall make a final decision as to 14
the issuance of the license. 15
16
2. Requests for appeal may be made to the City Council. 17
18
THIS ordinance shall become effective on March 1, 2022, upon its passage and execution 19
20
as provided by law. Each of the provisions of this ordinance are severable; if any provision 21
22
shall be declared to be invalid, the remaining provisions shall not be affected but shall remain 23
24
in full force. All ordinances, or parts of ordinances, in any manner conflicting herewith are 25
26
hereby repealed. 27

as amended, the City Council is authorized to direct the disposal of any real property not 10

needed for public or municipal services; and 12

WHEREAS, the City Council of the City of Prattville has identified a parcel of real 14
15
property, particularly described as Parcel # 19 02 09 3 013 005.000 (Attachment A), which is 16
17
not needed for public or municipal services. 18

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRATTVILLE, 20

WHEREAS, said sewer cleaner is available through the Sourcewell Purchasing 14

Cooperative, Contract Number 122017-AMI-VAC, from VAC-CON, Inc. at a net cost not to 16

WHEREAS, this is a budgeted expense for the Wastewater Division of the Public Works 20

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 24

funds in an amount not to exceed $443,792.00 for said sewer cleaner are hereby authorized and 26

approved to be paid to VAC-CON, Inc., and said funds are hereby approved and appropriated 28

WHEREAS, Pratt Cotton Gin Mill LLC has announced plans for a new project, located 8
9
within the jurisdiction of the City of Prattville; and 10
11
WHEREAS, pursuant to §40-9C-1 et seq., Code of Alabama, 1975, as amended, the 12
13
Brownfield Development Tax Abatement Act (the Act), Pratt Cotton Gin Mill LLC has 14
15
requested from the City of Prattville an Abatement of : 16
17
• All state, county and city non-educational property taxes; 18
• All city and county construction-related transaction taxes, except those local 19
construction-related transaction taxes levied for educational purposes or for capital 20
improvements for education; and/or 21
• All mortgage and recording taxes; and 22
23
WHEREAS, Pratt Cotton Gin Mill LLC has requested that the abatement of state and 24
25
local non-educational property taxes be extended for a period of 20-years, in accordance with 26
27
the Act; and 28
29
WHEREAS, the City of Prattville has considered the request of Pratt Cotton Gin Mill 30
31
LLC and the completed application(s) filed with the City of Prattville by Pratt Cotton Gin Mill 32
33
LLC in connection with its request; and 34
35
WHEREAS, the City of Prattville has the authority to grant the abatement of the county 36
37
non-educational sales and use taxes and non-educational property taxes, subject to Autauga 38
39
County’s resolution of consent; and 40
41
WHEREAS, the City of Prattville has found the information contained in Pratt Cotton 42
43
Gin Mill LLC’s application to be sufficient to permit the City of Prattville to make a reasonable 44
45
cost/benefit analysis of the proposed project and to determine the economic benefits to the 46
47
city and county; and 48
49
WHEREAS, the construction of the project will involve a capital investment of 50
51
$27,313,193.00; and 52
53
WHEREAS, Pratt Cotton Gin Mill LLC is duly qualified to do business in the State of 54
55
Alabama and has powers to enter into, perform and observe the agreements and covenants 56
57
on its part contained in the Tax Abatement Agreement; and 58
59
WHEREAS, the City of Prattville represents and warrants to Pratt Cotton Gin Mill LLC 60
61
that it has power under the constitution and laws of the State of Alabama (including 62
63
particularly the provisions of the Act) to carry out the provisions of the Tax Abatement 64
Agreement. 1

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 3
4
that approval is hereby given to the application of Pratt Cotton Gin Mill LLC and abatement is 5
6
hereby granted of: 7
8
• All state, county and city non-educational property taxes; 9
• All city and county construction-related transaction taxes, except those local 10
construction-related transaction taxes levied for educational purposes or for capital 11
improvements for education; and/or 12
• All mortgage and recording taxes 13
14
as the same may apply to the fullest extent permitted by the Act. The period of abatement for 15
16
the non-educational property taxes shall extend for a period of 20 -years measured as 17
18
provided in §40-9C-1 through §40-9C-8 of the Act. 19
20
BE IT FURTHER RESOLVED that the Mayor is authorized to enter into an abatement 21
22
agreement with Pratt Cotton Gin Mill LLC to provide for the abatement granted above. 23
24
BE IT FURTHER RESOLVED that a certified copy of this resolution, with the 25
26
application and abatement agreement shall be forwarded to Pratt Cotton Gin Mill LLC to 27
28
deliver to the appropriate local taxing authorities and to the Alabama Department of Revenue 29
30
in accordance with the Act. 31

BE IT FURTHER RESOLVED, that the City Council does hereby authorize the Mayor 33
34
to execute any and all documents necessary to carry out the purpose and intent of this 35
36
resolution. 37

WHEREAS, said vehicle is available through State Contract T191 at a total cost not to 13

exceed $33,702.00; and 15

WHEREAS, said vehicle shall be paid for with Federal Drug Proceeds. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, 19
20
that funds in an amount not to exceed $33,702.00 for said vehicle are hereby authorized and 21

approved, and said funds are hereby approved and appropriated from the Federal Drug 23

Proceeds Account 6701-11-604. 25

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that Chapter 8

Section(s) 62-77 through 62-84 are hereby amended as shown below: 12

62-77 - Fifty-five miles-per-hour zones. No person shall operate a motor vehicle at a greater 14
speed than 55 miles-per-hour in the following listed zones: 15
(1) On U.S. 82 from Cobbs Ford Road to west city limits; 16
(2) On U.S. 31 from U.S. 82 to south city limits; 17
(3) On AL Hwy 14 from Echlin Blvd to west city limits. 18

62-78 - Fifty miles-per-hour zones. No person shall operate a motor vehicle at a greater 20
