Mr. Mullins moved to approve the minutes of the December 16, 2021 regular meeting. Mr. Gardner seconded 20 the motion. The motion passed unanimously. 21 22 Chief Johnson moved to approve the minutes of the January 6, 2022 public hearing. Mr. Mullins seconded the 23 motion. The motion passed unanimously. 24 25 Committee Reports: 26 27 Old Business: 28 1. Preliminary Plat: HD&D Land Company, LLC Plat 2 29 Location: Highway 31 and Highway 82 E and McQueen Smith Road 30 Owner: HD&D Land Company, LLC 31 Representative: Goodwyn, Mills & Cawood, Inc. 32 33
The action on the preliminary plat was postponed at the December 16th meeting at the petitioner’s request. Mr. 34 Rigsby provided the staff comments for the preliminary plat of HD&D Land Company, LLC Plat 2. He stated 35 that the 3 parcels (12.89 acres) will be subdivided out from a larger 51.49 parcel for commercial development 36
with the remaining 38.6 acres proposed for residential development (i.e. McClain Landing). He stated that the 37 staff recommends approval with restrictions to Parcel 1 parcel must be accessed from new ROW to south; no 38 direct access to McQueen Smith Rd. and Parcel 3 parcel must be accessed from new ROW to southeast; no direct 39
access to Highway 31. 40 41 Judy Jones, Goodwyn, Mills & Cawood, petitioner’s representative, was present at the meeting. 42 43 Chairman Smith opened the floor for public comments. There were none. The public hearing was closed. 44 45 Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of HD&D Land Company, 46 LLC Plat 2 and moved for its approval. Mr. Mullins seconded the motion. 47 48 Mrs. Carpenter moved to approve contingent upon restrictions recommended by city staff. Mr. Daniels seconded 49 the motion. The motion to amend passed unanimously. 50

Mr. Rigsby introduced the preliminary plat of Prattville Business Park Plat 6. He stated that the proposed 71 preliminary plat proposes to join two existing parcels owned by the same company into one 2.158 acre 72
parcel. The property fronts Boardroom Drive and has sufficient street connectivity. He stated that by 73 joining these lots, this will eliminate the possibility of a land locked parcel. 74 75 Chairman Smith opened the floor for public comments. There were none to speak. Mr. Gardner introduced a resolution recommending approval of the preliminary plat of Prattville Business Park 79 Plat 6 and moved for its approval. Mr. Mullins seconded the motion. 80 81 The vote was called. The motion to approve passed unanimously. 82 83 5. Zoning Map Amendment: Downtown Overlay District 84 Representative: City of Prattville 85 86 Mr. Stephens provided a brief overview of the proposed Downtown Zoning Overlay District design 87 purpose. 88 89
Chairman Smith opened the floor for public comments. There were none to speak. The public hearing 90 was closed. 91 92
Mr. Mullins introduced a resolution recommending the approval of the Zoning Map Amendment for the 93 Downtown Overlay District and moved for its approval. Mr. Gardner seconded the motion. 94 95
Mayor Gillespie made a request for the record asking the commission to review the proposal again in the 96 next 24 months for the whole zoning ordinance. 97 98 Mr. Stephens stated that the proposed rewrite is from the original zoning map from the 1950s. As with 99 the original zoning map that has been amended, this zoning map with be able to be amended. 100 101 After no further discussion, the vote was called. 4. Zoning Text Amendment: New Zoning Ordinance of Prattville, Alabama 104 Representative: City of Prattville 105 106 Mr. Stephens provided an overview of the process for the new zoning ordinance. He stated that 107 the Planning Commission adopted Project Prattville 2040, the comprehensive plan, on April 15, 108 2021, and has been since participating in a series of work sessions to discuss and facilitate the re-109 write of the Prattville Zoning Ordinance. stated that a public hearing was held on January 6, 2022 for the proposed ordinance. He stated 111 that Jason Fondren with KPS Group was the consultant for this project. 112
113 Mr. Stephens also discussed some suggested “grandfathering” clauses the City Council may consider 114 before adopting the new zoning ordinance including allowing temporary sign regulations to remain the 115
same for the remainder of the year, project currently approved or under review to continue under the 116 provisions when submitted, and that active single family residential developments to continue to develop 117 under existing requirements for a period of five years. The member of the Commission were agreeable to 118
the proposal. 119 120 Chairman Smith opened the floor for public comments. There were none. The public hearing was closed. 121 122 Mr. Hayden introduced a resolution recommending the approval of the Zoning Text Amendment for the 123 new zoning ordinance and moved for its approval. Proposed Use: The applicant is requesting to rezone a 5.1 +/- acre parcel located on the east side of Old
Highway 31, partially behind Pigg Enterprises, from split zoning of B-2 (General Business)
and R-2 (Single Family Residential) to B-2 (General Business).
Street Connectivity: Parcel has frontage on Old Highway 31.
Water/Sewer: Public water and sewer are available to this site.
E. COMPREHENSIVE PLAN:
The subject site has a Future Land Use Map (FLUM) designation of Low-Density Residential.
On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land
Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in Mixed-
Use Residential and Medium-Density Residential FLUM zones and surrounded by Medium Density Residential and
Mixed-Use Residential to the North and East and Commercial to the West and South. The proposed Zoning Map
Amendment to B-2 General Business meets the general fabric of the area.
PLANNING STAFF EVALUATION
This property has a split zoning designation due to its proximity to South Memorial Drive. It appears an
approximately 300 ft buffer was established creating B-2 General Business zoning along S. Memorial Drive. The
remaining back portion of the parcel (~60%) is zoned R-2 Single Family Residential. The FLUM zone for this parcel
is also split between Mixed-Use Residential and Medium-Density Residential, however, borders Commercial. The
S. Memorial / Hwy 31 Corridor, including this parcel, is made up primarily of commercial land uses and the proposed
zoning of this parcel will maintain that general fabric of the area. The proposed zoning map amendment will eliminate
the current split commercial/residential zoning of this parcel and will create a uniform parcel zoned B-2 General
Business.
