CITY OF PRATTVILLE PLANNING COMMISSION MINUTES January 20, 2022 Call to order: Chairman Tim Smith called the regular meeting to order at 3:00 p.m. Roll Call: The secretary called the roll. Members present were Mayor Bill Gillespie, Councilman John Chambers, Chairman Tim Smith, Vice-Chairman Reuben Gardner, Chief Dallis Johnson, Mrs. Paula Carpenter, Mr. Ken Daniel, Mr. Seth Hayden, and Mr. Mugs Mullins. Absent: There were no members absent.
(Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Darrell Rigsby, Senior Planner; Mr. Tommie Williams,
Planner; and Ms. Alisa Morgan, Secretary. Minutes:
Mr. Mullins moved to approve the minutes of the December 16, 2021 regular meeting. Mr. Gardner seconded the motion. The motion passed unanimously. Chief Johnson moved to approve the minutes of the January 6, 2022 public hearing. Mr. Mullins seconded the motion. The motion passed unanimously. Committee Reports: Old Business: 1. Preliminary Plat: HD&D Land Company, LLC Plat 2 Location: Highway 31 and Highway 82 E and McQueen Smith Road Owner: HD&D Land Company, LLC Representative: Goodwyn, Mills & Cawood, Inc.
The action on the preliminary plat was postponed at the December 16th meeting at the petitioner’s request. Mr. Rigsby provided the staff comments for the preliminary plat of HD&D Land Company, LLC Plat 2. He stated that the 3 parcels (12.89 acres) will be subdivided out from a larger 51.49 parcel for commercial development
with the remaining 38.6 acres proposed for residential development (i.e. McClain Landing). He stated that the staff recommends approval with restrictions to Parcel 1 parcel must be accessed from new ROW to south; no direct access to McQueen Smith Rd. and Parcel 3 parcel must be accessed from new ROW to southeast; no direct
access to Highway 31. Judy Jones, Goodwyn, Mills & Cawood, petitioner’s representative, was present at the meeting. Chairman Smith opened the floor for public comments. There were none. The public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of HD&D Land Company, LLC Plat 2 and moved for its approval. Mr. Mullins seconded the motion. Mrs. Carpenter moved to approve contingent upon restrictions recommended by city staff. Mr. Daniels seconded the motion. The motion to amend passed unanimously.
After no further discussion, the vote was called. The amended motion to approve passed unanimously.

Mr. Rigsby introduced the preliminary plat of Prattville Business Park Plat 6. He stated that the proposed preliminary plat proposes to join two existing parcels owned by the same company into one 2.158 acre
parcel. The property fronts Boardroom Drive and has sufficient street connectivity. He stated that by joining these lots, this will eliminate the possibility of a land locked parcel. Chairman Smith opened the floor for public comments. There were none to speak. The public hearing was closed.
Mr. Gardner introduced a resolution recommending approval of the preliminary plat of Prattville Business Park Plat 6 and moved for its approval. Mr. Mullins seconded the motion. The vote was called. The motion to approve passed unanimously.
5. Zoning Map Amendment: Downtown Overlay District Representative: City of Prattville Mr. Stephens provided a brief overview of the proposed Downtown Zoning Overlay District design purpose.
Chairman Smith opened the floor for public comments. There were none to speak. The public hearing was closed. Mr. Mullins introduced a resolution recommending the approval of the Zoning Map Amendment for the Downtown Overlay District and moved for its approval. Mr. Gardner seconded the motion. Mayor Gillespie made a request for the record asking the commission to review the proposal again in the next 24 months for the whole zoning ordinance. Mr. Stephens stated that the proposed rewrite is from the original zoning map from the 1950s. As with the original zoning map that has been amended, this zoning map with be able to be amended.
After no further discussion, the vote was called. The motion to approve passed unanimously. 4. Zoning Text Amendment: New Zoning Ordinance of Prattville, Alabama Representative: City of Prattville
Mr. Stephens provided an overview of the process for the new zoning ordinance. He stated that the Planning Commission adopted Project Prattville 2040, the comprehensive plan, on April 15, 2021, and has been since participating in a series of work sessions to discuss and facilitate the re-write of the Prattville Zoning Ordinance. The full draft is now ready for consideration. He

stated that a public hearing was held on January 6, 2022 for the proposed ordinance. He stated that Jason Fondren with KPS Group was the consultant for this project.
Mr. Stephens also discussed some suggested “grandfathering” clauses the City Council may consider before adopting the new zoning ordinance including allowing temporary sign regulations to remain the
same for the remainder of the year, project currently approved or under review to continue under the provisions when submitted, and that active single family residential developments to continue to develop under existing requirements for a period of five years. The member of the Commission were agreeable to
the proposal. Chairman Smith opened the floor for public comments. There were none. The public hearing was closed. Mr. Hayden introduced a resolution recommending the approval of the Zoning Text Amendment for the new zoning ordinance and moved for its approval. Mr. Mullins seconded the motion. After their discussion, the vote was called. The motion to approve passed unanimously. Miscellaneous:

property (51.49 acres), leaving approximately 38.6 acres for residential development. Lot 1 (~5.80ac) is located on
the southwest corner of U.S. Highway 82 & McQueen Smith Road directly across the street from McClain Landing
Subdivision. Lot 2 (~4.25 ac) is located on the southeast corner of U.S. Hwy 82 & U.S. Hwy31 (S. Memorial) just
north of the Liberty gas station. Parcel 3 (~2.84 ac) is located on U.S. Hwy 31 (S. Memorial) to the southeast of
the Liberty gas station and northwest of the equipment rental business. Lot 3 will border the proposed access road
to the residential neighborhood. These 3 lots are currently zoned B-2 General Business. The remaining 38.6 acres
of this property is a proposed residential development, McClain Landing Phase 7, which received Preliminary
Plat approval by the Planning Commission September 16, 2021.

RE: Request to Consider Zoning Map Amendment – New Downtown Overlay District
This application packet is for the proposed, new Downtown Overlay District.
The Planning Commission adopted Project Prattville 2040, the comprehensive plan, on April 15, 2021, and has been since participating in a series of work sessions to discuss and facilitate the re-write of the Prattville Zoning Ordinance.
Part of the new Zoning Ordinance includes a Downtown Overlay District which will ‘sit on top of’
the underlying zoning districts and impose stricter design standards. The purpose of this overlay district is to assure new development, redevelopment and reinvestment in Downtown Prattville is consistent with its walkable, historic development pattern and to promote a diversity of business, institutional and other compatible uses.
Please review §6.03 of the proposed Zoning Ordinance for full details. The Commission’s actions will be a recommendation to the City Council, who will then schedule their own public hearing prior to voting on the new proposed Downtown Overlay District.

RE: Request to Consider Zoning Text Amendment – New Zoning Ordinance
This application packet is for the zoning ordinance re-write.
The Commission has scheduled public hearings for January 6, 2022, and at their regular meeting on
January 20, 2022.

The Planning Commission adopted Project Prattville 2040, the comprehensive plan, on April 15,
2021, and has been since participating in a series of work sessions to discuss and facilitate the re-write of the Prattville Zoning Ordinance. The full draft is now ready for consideration. The Commission’s actions will be a recommendation to the City Council, who will then schedule
their own public hearing prior to voting on the new Zoning Ordinance.
