8 WHEREAS, the final subdivision plats were recorded for Glennbrooke Plat 4-A on

10 November 12, 2015 , Plat 4-B on February 16, 2016, Plat 4-C on August 23, 2016 , Plat 5-A on
11
12 July 24, 2017, and Plat 5-B on January 25, 2018; and
13
14 WHEREAS, the developer of said subdivision must maintain the public utilities, rights-
15
16 of-way, and easements in the subdivision until accepted by the City Council of the City of
17
18 Prattville ; and
19
20 WHEREAS, the owner of said subdivision has maintained the public utilities, rights-of-
21
22 way, and easements in the subdivision for the minimum period required by the Prattville
23
24 Subdivision Regulations and has corrected all deficiencies presented by the C ity of Prattville
25
26 Engineering Department; and
27
28 WHEREAS, all public utilities, rights-of-way, and easements in said subdivision were
29
30 inspected and approved by the City of Prattville Engineering, Planning and Development, and

9 BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that Chapter 50
10
11 -Offenses and Miscellaneous Provisions , Article Ill. -Offenses Involving Public Peace and
12
13 Order, Division 1 . -Generally, Sec. 51-54-Loitering is adopted as follows :
14
15 Sec. 50-51. -Loitering -Definitions
16 The following definitions shall apply i n t he interpretation and enforcement of this article:
17
18 Loitering shall mean remaining idle in essentially one (1) location and shall include the
19 concept of spending t ime idly, to be dilatory, to linger, to stay, to saunter, to delay, to stand
20 around shall also include the colloquial ex pression "hanging around."
21
22 Public place shall mean any place to which the general public has access and a right to
23 do business, enterta inment, or other lawful purpose , but does not necessarily mean a place
24 devoted solely to the uses of the publi c . It shall also include front or immediate areas of any
25 store , shop , restaurant, tavern or any other place of business and also public grounds, parking
26 lots, areas or parks , which are not on private property.
27
28 Pri vate property shall mean any property owned by a private individual(s) or entity(s),
29 including parking lots.

31 Sec. 50-52. -Loitering in a Public Place
32 It shall be unlawful for any person to loiter , enter, remain , prowl or wander about, whether in a
33 moto r vehicle or on foot , or engage in any disorderly conduct, loud, boisterous , threatening ,
34 abusive , insulting or indecent language , or engage in any behavior tending to a breach of the
35 publi c peace in a public place or parking lot; including a public park for any unlawful purpose
36 other than the intended use of the facility or public place in which the person is located.

38 Sec. 50-53. -Loitering on Private Property
39 It shall be unlawful for any person to loiter, enter, remain , prowl or wander about, whether in a
40 motor vehicle or on foot, upon or around any private premises, or in any enclosed lot, any
4 1 parking lot, or in and around any dwelling , without the permission , consent or knowledge of the
4 2 owner or lessee of the premises, lot or dwelling .

44 Sec. 50-54. -Penalties
45 Any person found in violation of Secs. 50-52 or 50-53 shall be gu ilty of an offense . Upon first
46 convi ction , a person may be assessed a fine in the amount of $125 .00 and/or up to five (5 )
4 7 days in jail. Any person determined by an Officer of the City who has been convicted for
48 violation of Secs. 50-52 or 50-53 on mo re than one prior occasion at a particular place , shall
49 be trespassed from said property, in addition to the penalties above.

8 WHEREAS , 2650 LLC d/b/a Adrienne's Bar has applied for an amended Lounge Retail

10 Liquor -Class I License for a business located at 121 West Main Street, Prattville, AL 36067,
11
12 which is a lounge; and
13
14 WHEREAS, the applicant has requested an extension of the approved area whereby
15
16 outdoor alcohol sales may occur; and
17
18 WHEREAS, the proposed extended outdoor space is located on a City public access
19
20 easement and will require an executed usage agreement; and
21
22 WHEREAS, a public hearing was set by Resolution Book 2022 , Page 033 , and held at
23
24 6:00 p.m. on April 19, 2022 , and that at such time and place all persons who desired had an
25
26 opportunity to be heard in favor of or in opposition to such resolution .
27
28 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
29
30 hereby approves the issuance of an amended Lounge Retail Liquor -Class I License to 2650
31
32 LLC d/b/a Adrienne's Bar, for the business located at 121 West Main Street, Prattville, AL
33
34 36067.

36 BE IT FURTHER RESOLVED that the Mayor is hereby authorized to negotiate and
37
38 enter into a usage agreement with 2650 LLC d/b/a Adrienne's Bar to mitigate ingress and
39
40 egress for said proposed extended outdoor space.

8 WHEREAS, keeping garbage and rubbish is a public nuisance that is injurious to the
9
10 public health , safety and general welfare of the community pursuant to Sec. 46-4 , City of
11
12 Prattville Code of Ordinances; and
13
14 WHEREAS, §6-5-122 et seq., of the Code of Alabama , 1975 , as amended, permits the
15
16 City Council of the City of Prattville to declare a public nuisance and abate the same; and
17
18 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
19
20 the property and determined the existence of garbage and rubbish at 133 Sycamore Drive ,
21
22 Prattville , AL 36066; and
23
24 WHEREAS, the Autauga County tax records list the property owner as Rodgers Roger
25
26 D, with an address of 133 Sycamore Drive, Prattville, AL 36066 to parcel number 19 02 03 3
27
28 011 012 .000; and
29
30 WHEREAS, in compliance with Sec. 46-31 of the City of Prattville Code of Ordinances,
31
32 the Prattville Police Department Code Enforcement Officer sent notice to the owner of said
33
34 property, in writing, on February 1, 2022 , to correct, remedy or remove the garbage and rubbish
35
36 within ten (10) days; and
37
38 WHEREAS, the owner of 133 Sycamore Drive, Prattville, AL 36066 has failed and/or
39
40 refused to correct, remedy or remove the garbage and rubbish after the expiration of said
41
42 notice; and
43
44 WHEREAS, Sec. 46-32 of the City of Prattville Code of Ordinances authorizes the City
45
46 to do such work or make such improvements that are necessary to correct, remedy or remove
47
48 such condition, pay therefore and charge the expenses incurred to the owner of such lot.

50 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
51
52 declares that the garbage and rubbish at 133 Sycamore Drive, Prattville , AL 36066 continues
53
54 to be a nuisance.
55
56 BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 133
57
58 Sycamore Drive , Prattville, AL 36066 removed using City forces or private contractors . The
59
60 property owner shall have the right to remove the garbage and rubbish at his or her own
61
62 expense provided that the removal is done prior to the commencement of work by employees
63
64 or agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to
1 this request and report such cost to the City Council following its removal.

10 BE IT ORDAINED by the City Council of the City of Prattville , Alabama , as follows:

12 Section 1. In conformity with the provisions of §40-23-210 through §40-23-213 , Code of
13 Alabama , 1975, as amended, providing for a State Sales Tax Holiday, the City of Prattville ,
14 Alabama , exempts "covered items" from municipal sales and use tax during the same period ,
1 5 beginning at 12:01 a .m . on the third Friday in July (July 15, 2022) and ending at twelve midnight
16 the following Sunday (July 17 , 2022 ).

18 Section 2 . This Ordinance shall be subject to all terms, conditions, definitions , time periods ,
19 and rules as provided by §40-23-210 through §40-23-213 , Code of Alabama , 1975, as
20 amended , except that the time period shall only be as specified in Section 1 above and not for
21 all years thereafter.

2 3 Section 3. The City Clerk is hereby authorized and directed to certify a copy of this ordinance
24 under the seal of the City of Prattville , Alabama, and to forward said certified copy to the
25 Alabama Department of Revenue to be recorded and posted on the department website.

27 Section 4 . This ordinance shall become effective upon its passage and publication as required
28 by law.

9 WHEREAS, the City of Prattville Police Department has a need to up-fit seventeen (17)

11 new SUVs with police fleet emergency light equipment; and

13 WHEREAS, two (2) sealed bid were received , opened and read on April 4 , 2022, at
14
15 10:00 a.m., and Prologic ITS was the lowest responsible bidder with a cost of $134 ,821.08 for
16
17 said emergency light equipment and related installation ; and
18
19 WHEREAS, a portion of this expenditure is budgeted in the Police Department; and
20
21 WHEREAS, the Finance Director has identified a certain sum of surplus funds available
22
23 for departments that came in under budget in prior fiscal years; and
24
25 WHEREAS, a portion of the Police Department allocation of said surplus funds shall be

27 used for said emergency light equipment and related installation.

29 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that

WHEREAS, the existing lease agreement between the City of Prattville and the
10 American Legion Post No . 122 for the property located at 498 Doster Road and described in
11
12 "Attachment A", shall expire effective June 1, 2022 ; and
13
14 WHEREAS, the City of Prattville and the American Legion Post No. 122 desire to enter
15
16 into a new lease agreement for said property; and
17
18 WHEREAS, the lease term for said lease agreement shall commence on June 1 , 2022
19
20 and end on June 1, 2025; and
21
22 WHEREAS, the lease amount for said lease agreement shall be $1 ,000 .00 per year;
23
24 and
25
26 WHEREAS, said lease agreement provides for the option to renew the lease at the end
27
28 of the term for one ( 1) additional three-year term.

30 NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Prattville , that

32 the Mayor is hereby authorized to enter into said lease agreement between the City of Prattville
33
34 and the American Legion Post No . 122 for the property located at 498 Doster Road and

17 WHEREAS, grant funds are available for use towards said purchase from the

19 Department of Justice (DOJ) Office of Juvenile Justice and Delinquency Prevention (OJJDP)

8 WHEREAS, under the authority of Title 11 , Chapter 53B of the Code of Alabama, 1975 ,
9
10 as amended, on November 18, 2021 , the City of Prattville Chief Building Official declared an
11
12 accessory structure located at 1039 Gipson Street to be an unsafe structure ; and
13
14 WHEREAS, on February 15, 2022, the City of Prattville Code Enforcement Officer sent
15
16 notice ordering the repair or demolition of the accessory structure at 1039 Gipson Street within
17
18 45 days of said notice; and
19
20 WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3 ,
21
22 Code of Alabama , 1975, as amended ; and
23
24 WHEREAS , Title 11 , Chapter 53B allows the property owner or other interested parties
25
26 to file an appeal within t h irty (30) days of the date of notice with the City Clerk requesting a
27
28 hearing before the City Council of the City of Prattville; and
29
30 WHEREAS, no hearing was requested within thirty (30) days of the date of notice; and
31
32 WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended , authorizes the City
33
34 Council to determine whether or not the building or structure is unsafe to the e xtent that it is a
35
36 publi c nuisance after the expiration of thirty (30) days from the date of said notice ; and
37
38 WHEREAS, no repairs have been made to the accessory structure located at 1039

40 Gipson Street, and the accessory structure remains unsafe and a public nuisance.

42 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville , that

44 the accessory structure located at 1039 G ipson Street continues to be unsafe and a public
4 5
46 nuisance that must be repaired or demolished .

48 BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement
49
so Officer to provide a repo rt of the cost to repair or demolish the accessory structure located at
51
5 2 1039 G ipson Street to the City Council.

9 WHEREAS, the City of Prattville has a need for stormwater and sanitary sewer

11 improvements on Thomas Avenue and Selma Highway, CWSRF Project No . CS010254-14;

13 and

15 WHEREAS, the City of Prattville Engineering Department had specifications drafted for
16
17 said stormwater and sanitary sewer improvements; and
18
19 WHEREAS, two (2) sealed bids were received , opened and read at 10:00 a.m . on April
20
2 1 7 , 2022, and David Bulger Inc. was the lowest responsible bidder with a cost of $2 ,648,947 .00
22
23 for said stormwater and sanitary sewer improvements; and
24
2 5 WHEREAS, a portion of this expenditure is budgeted in the Capital Projects Fund and
2 6
27 Wastewater Enterprise Fund ; and
28
29 WHEREAS, the remaining funding for said project is anticipated to be awarded from the
30
3 1 CWSRF Loan Program upon review and approval by the Alabama Department of
32
33 Environmental Management.

35 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville , that

37 the FY2022 Budget is hereby amended as follows:

8 WHEREAS, the City of Prattville has a need to purchase and install security cameras in

10 the Vehicle Maintenance Building; and

12 WHEREAS , said equipment and installation are currently available from Security 101 at

14 a net cost not to exceed $30,806.98; and

16 WHEREAS , required wiring services are available from PCI Technologies at a net cost
17
18 not to exceed $5,195.42 ; and
19
20 WHEREAS, §41-16-51(a)(15), Code of Alabama, 1975, as amended , allows for

22 contractual services and the purchase of products related to the security of facilities to be let

24 without competitive bid ; and

2 6 WHEREAS, said project is a budgeted expense for the Vehicle Maintenance Division of
