NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville hereby supports the submission of the FY2022 LWCF Grant application. Code Adopted; 11 12 Penalty, of the Code of Ordinances of the City of Prattville, is hereby amended to read as 13 14 follows: 15 16 ARTICLE II. FIRE PREVENTION CODE 17 DIVISION 1. GENERALLY 18 19 Sec. 26-41. Purposes. 20 The purposes of this chapter are to extinguish and prevent fires and to compel citizens to 21 render assistance to the fire department through training and public relations in case of need 22 and to establish, regulate the size, materials and construction of buildings, fences and other 23 structures hereafter erected, and to require the same to be done in such manner as public 24 safety and convenience may require, to remove or require to be removed, any building or 25 structure or addition thereto which by reason of dilapidation, defect of structure or other 26 cause, may have become dangerous to life or property or which may be erected contrary to 27 law, to establish and designate from time to time fire limits within which limits, wooden 28 buildings shall not be constructed, removed, added to or enlarged and to direct that any 29 future buildings within such limits shall be constructed as required in the codes and 3o regulations herein adopted by the city. 31 32 Sec. 26-42. Code adopted; penalty. 33 The International Fire Code, 2021 edition as revised, consisting of chapters 1-67 and 34 Appendices A —I, and K published by the International Code Council, Inc., at least one copy 35 of which is on file in the city clerk's office, which provides rules and regulations for fire 36 prevention standards and the same is hereby adopted and incorporated herein by reference. 37 When a provision of the International Fire Code is in conflict with a provision of the National 38 Fire Protection Association (NFPA) standards, and the conflict relates to life and building 39 safety performance requirements, the Fire Chief shall have the discretion to determine which 40 provision shall apply. 41 42 Amendments to the International Fire Code are as follows: 43 506.2.1 All devices shall be installed and maintain at the owner/occupant's expense. 44 507.5.1.1.1 Hydrant for fire sprinkler systems. Buildings equipped with an FDC (Fire 45 Department Connection) for a fire sprinkler system installed in accordance with Section 46 903 shall have a fire hydrant within 150 feet of the FDC. 47 Exception: The distance shall be permitted to exceed 150 feet where approved by the 48 fire code official. 49 903.3.7.1 Where sprinkler systems are installed and are required by code to have an 50 (FDC) Fire Department Connection, all F.D.C.'s shall be 2Y2 inch national Standard 51 Threads. 52 903.3.8 Fire Department Connections. Where sprinkler systems are installed and are 53 required by code to have an (FDC) Fire Department Connection, all F.D.C.'s shall be 2Y2 54 inch national Standard Threads. 55 903.4.2 Alarms. An approved audible and visual device, located on the exterior of the 56 building in an approved location, shall be connected to each automatic sprinkler system. 57 Such sprinkler water -flow alarm devices shall be activated by water flow equivalent to the 58 flow of a single sprinkler of the smallest orifice size installed in the system. Where a fire 59 alarm system is installed, actuation of the automatic sprinkler system shall actuate the 60 building fire alarm system. 61 904.13.5.3.1 Commercial Hoods with Fire Suppression Systems. All systems shall be 62 installed and maintained in accordance with applicable codes and standards. All new 63 installations and annual services (and when required by code or manufacturer 64 recommendations) shall install new fusible links and CO2 cartridges with devices dated 1 and stamped by the manufacturer, with the same year date as the installation or service 2 is taking place. 3 2306.2.2 Above -ground tanks located inside buildings. Above -ground tanks for the 4 storage of class I, II, IIIA liquid fuels are prohibited within the entire City. 5 2306.2.3 Above -ground tanks located outside buildings. Above -ground tanks for the 6 storage of class I, II, IIIA liquid fuels outside of buildings are prohibited except in the 7 following locations. Above -ground storage tanks shall be allowed at the Prattville Airport 8 and in properties zoned M2 and such storage is used in conjunction with those facilities 9 and is necessary for manufacturing and/or processing for those facilities. In M2 10 properties, aboveground storage shall be allowed only in Protected above Ground Tanks 11 as defined in NFPA 30 and in accordance with 2.306.2.3 and 2306.2.4. 12 13 The applicant shall provide to the City Planning/Building Department, City Engineer, Fire 14 Chief, and Director of County Emergency Management Agency detailed plans and 15 specifications showing compliance to the most current edition of NFPA 30 and compliance 16 with the currently adopted International Fire Code as well as any other state and/or federal 17 laws that may apply. Inspections by the above stated departments shall be conducted to 18 verify code compliance before storage tanks may be filled with any product. 19 20 Appendix B is amended as follows: 21 Section B105 FIRE -FLOW REQUIREMENTS FOR BUILDINGS 22 B105.1 One- and two-family dwellings, Group R-3 and R-4 buildings and townhouses. 23 The minimum fire -flow and flow duration requirements for one- and two-family dwellings, 24 Group R-3 and R-4 buildings and townhouses shall be specified in Chapter 26 - FIRE 25 PREVENTION AND PROTECTION, Sec. 26-100. - Installation requirements of the City 26 ordinance. 27 Delete TableB105.1(1). 28 Appendix D is amended as follows: 29 Table D103.4 — REQUIREMENTS FOR DEAD-END FIRE APPARATUS ACCESS 30 ROADS and FIGURE D103.1 — DEAD-END FIRE APPARATUS ACCESS ROAD 31 TURNAROUND 32 Table D103.4 and Figure D103.1 —The minimum diameter of a cul-de-sac shall be not 33 less than 80 feet. 34 Section D107 ONE- OR TWO-FAMILY RESIDENTIAL DEVELOPMENTS 35 D107.2 Remoteness. Where two fire apparatus access roads are required, they shall be 36 placed a distance apart equal to not less than one-half of the length of the maximum 37 overall diagonal dimension of the property or area to be served, measured in a straight 38 line between accesses. 39 Exception: Where a condition exists that the remoteness requirements in D107.2 cannot 40 be met, approval will be at the discretion of the Planning Commission. 41 42 Sec. 26-43. Modifications. 43 The Fire Chief shall have power to modify any of the provisions of the fire prevention 44 code adopted by this article upon application in writing by the owner or lessee, or duly 45 authorized agent of the owner or lessee, when there are practical difficulties in the way of 46 carrying out the strict letter of the code; provided that the spirit of the code shall be observed, 47 public safety secured, and substantial justice done. The particulars of such modification, 48 when granted or allowed, and the decision of the Fire Chief thereon shall be entered upon the 49 records of the fire department and a signed copy shall be furnished to the applicant. 50 51 Sec. 26-44. Appeals. 52 Whenever the Fire Chief shall disapprove an application or refuse to grant a license or 53 permit applied for, or when it is claimed that the provisions of the fire prevention code 54 adopted by this article do not apply or that the true intent and meaning of the code have been 55 misconstrued or wrongly interpreted, the applicant may appeal the decision of the Fire Chief 56 to the City Council within 30 days from the date of the decision. 57 58 Sec. 26-45. Investigation of fires. 59 The Fire Marshal's office of the fire department shall investigate the cause, origin, and 60 circumstance of every fire occurring in the City which is of suspicious nature or which 61 involves loss of life or injury to persons or by which property has been destroyed or 62 substantially damaged. Such investigation shall begin immediately upon the occurrence of 63 such fire and the Fire Chief shall be immediately notified of the facts. The Fire Chief shall 1 take charge immediately of the physical evidence and shall notify the proper law enforcement 2 officials and the State Fire Marshal, if needed. 3 4 Sec. 26-46. Building permits and plan checking. 5 Prior to the issuance of any building permit for building construction, building 6 modification, building alteration, etc., a member of the fire department and/or the Fire 7 Marshal, as delegated by the Fire Chief, shall review all plans submitted to evaluate the same 8 for fire safety features, such as vertical separation, exits, exit corridors and stairs, 9 combustibility of materials to be used, fire extinguishing apparatus and exit lights, and exit 10 ways and entranceways to and from such property. Single-family residences shall be exempt 11 from this requirement, unless the owner or builder requests a fire department evaluation. 12 13 Secs. 26-47-26-75. Reserved 14 15 DIVISION 2. FIRE SCENE 16 17 Sec. 26-76. Delay by citizens in reporting fires. 18 It shall be unlawful for any person to delay reporting immediately any fire or emergency 19 discovered to the fire department (911) or the police department so that emergency vehicles 20 may be dispatched. 21 22 Sec. 26-77. Report of fire injury or death. 23 It shall be unlawful for any person to fail to notify or delay the notification to the Fire Chief 24 of a fire injury or death. 25 26 Sec. 26-78. Certain acts prohibited at or near fires or emergencies. 27 It shall be unlawful to commit any of the following acts at the burning of a building or at 28 any other incident, time and place where any employee of the fire department is discharging 29 or attempting to discharge an official duty: 30 (1) To possess any flammable, explosive or combustible material or substance, or any 31 device in an arrangement or preparation with intent to willfully and maliciously use 32 such material to set fire to or bum any building or property. 33 (2) To possess, manufacture or dispose of a fire bomb containing a flammable liquid 34 with a flashpoint of 150 degrees Fahrenheit or less having a wick or similar device 35 capable of being ignited, excluding commercial manufactured devices primarily for 36 the purpose of illumination. 37 38 Secs. 26-79-26-99. Reserved 39 40 DIVISION 3. FIRE HYDRANTS 41 42 Sec. 26-100. Installation requirements. 43 (a) All residential subdivisions, commercial developments, shopping centers and apartment 44 developments shall have fire hydrants installed by the developer in accordance with the 45 following requirements: 46 (1) Fire hydrant spacing shall be installed according to the fire flow demand as outlined 47 in accordance with the insurance service office grading schedule for municipal fire 48 protection. 49 (2) Fire hydrants shall be of the type recommended by the American Water Works 50 Association (AWWA), National Fire Protection Association (NFPA), Standard 24 and 51 approved by the public water system supplying such hydrants and the City Fire 52 Department. 53 (3) Fire hydrants shall be equipped with not less than one 4Y2-inch outlet and two 2Y2- 54 inch outlets with national standard threads. All outlets shall be male, with the 55 direction of the discharge parallel to the street served by the hydrant. 56 (4) All fire hydrants shall be connected to and supplied by water mains of not less than 57 six inches in size. The water mains shall meet the specifications established by the 58 American Water Works Association and approved by the public water system 59 supplying the hydrants. 60 (5) For all apartment and residential developments, the fire hydrants shall be placed at 61 each street intersection and spaced intermittently not more than 800 feet apart with 62 additional fire hydrants located as necessary to permit all portions of the buildings to 63 be accessed by hose lays of not more than 400 feet. 1 (6) In shopping centers and other commercial developments, fire hydrants shall be 2 spaced not more than 500 feet apart with additional fire hydrants located as 3 necessary so as to permit all portions of the building located therein to be accessed 4 by hose lays of not more than 300 feet. 5 (7) In industrial parks or manufacturing developments that are developed with streets, 6 fire hydrants shall be placed at each intersection with intermittent hydrants between 7 intersections spaced not more than 300 feet apart with additional hydrants located 8 as necessary so as to permit all portions of the buildings located therein to be 9 accessed by hose lays of not more than 300 feet. 10 (8) No fire hydrant shall be installed and deemed serviceable that has a fire flow of less 11 than 500 gallons per minute and 20 pounds of residual pressure. 12 (9) The developer shall file with the planning and development department and with the 13 fire department a map indicating the size of the mains, location of hydrants prior to 14 the installation of the mains or the hydrants and prior to the construction of any 15 buildings in any development, which map shall be approved by the Fire Chief or the 16 chiefs designated representative. Additionally, upon completion, the developer shall 17 file with the appropriate City department three sets of as -built plans of fire hydrants 18 and mains. 19 (b) No building permit shall be issued in any area affected by this section for any 20 development that has failed to comply with the terms and conditions of this section. All 21 water mains and fire hydrants shall be installed under pressure, and ready for firefighting 22 use, before any sheathing may be installed on walls and on roofs of any buildings in a 23 development. 24 25 Sec. 26-101. Breaking, defacing, etc. 26 It shall be unlawful for any person to break, deface or carry away without lawful authority 27 any part of any fireplug or hydrant. 28 29 Sec. 26-102. Unauthorized tapping. 30 It shall be unlawful for any person, except in case of a fire under the direction of the fire 31 department or by direction of some officer or person legally authorized to so direct, to open 32 any fireplug or hydrant and allow the water to escape. 33 34 Secs. 26-103-26-132. Reserved. 35 36 DIVISION 4. FIRE LANES 37 38 Sec. 26-133. Creation and maintenance. 39 It shall be the duty of the fire department or its authorized representative to create or 40 establish and maintain, at the property owner's expense, such fire lanes as may be required 41 for the protection of commercial properties within the City limits. It shall be unlawful to block 42 or obstruct any designated fire lane when such lane is located on public property or private 43 property dedicated to public use. 44 45 Secs. 26-134-26-164. Reserved. 46 47 DIVISION 5. FIRE PRECAUTIONS 48 49 Sec. 26-165. Sale, purchase, possession and explosion of fireworks and pyrotechnics. 50 (a) Definition. When used in this division, the term "fireworks" or "pyrotechnics" means and 51 includes one or more of the following: 52 (1) Sparklers; 53 (2) Squibs; 54 (3) Rockets; 55 (4) Firecrackers; 56 (5) Roman candles; 57 (6) Fire balloons; 58 (7) Signal lights; 59 (8) Torpedoes; 60 (9) Torpedo caps; 61 (10) Railroad and track torpedoes; 62 (11) Flashlight compositions; 63 (12) Firecrackers of all kinds; or 1 (13) Other devices or compositions which are used to obtain visible or audible 2 pyrotechnic displays. 3 (b) Possession. It shall be unlawful for any person to have in possession, keep, store, use, 4 manufacture, sell, offer for sale, give away or handle any pyrotechnics within the 5 corporate limits of the City; provided, however, nothing in this section shall be held to 6 apply to articles manufactured for use as signaling devices and used as such in the 7 operation of railroads, boats, airplanes or other required emergency purposes; and 8 provided further, nothing in this section shall be held to apply to a normal supply of 9 flashlight compositions in the hands of photographers or dealers in photographic 10 supplies. Exceptions: This section shall be forever waived for the purpose of the annual 11 Independence Day celebration sponsored by the City. 12 13 Sec. 26-166. Barbeque grills and outdoor cooking. 14 Barbeque grills and similar cooking equipment shall not be used or stored on balconies, 15 terraces, or porches of multistory buildings. They shall be used only outside and at a safe 16 distance, not less than ten feet, from the nearest building. 17 18 Sec. 26-167. Discharge of sparks, cinders, etc. 19 It shall be unlawful for any person to discharge or to cause, permit or allow the 20 discharge, emission or escape into the open air in or upon any public place, public street or 21 public avenue, or in or upon the premises or dwelling of another, of any live, hot or burning 22 sparks, cinders or embers or other hot or burning material. 23 Open burning and recreational fires as defined by the adopted fire code and ADEM shall 24 be regulated or permitted by the Fire Marshal. 25 Allowable fuels excluded from recreational fires, approved fire pits or outdoor fireplaces 26 include leaves, grass clippings, construction or packing materials. 27 28 Sec. 26-168. Threatening to burn, damage or destroy property. 29 It shall be unlawful for any person, knowing the contents thereof to send, deliver or cause 30 to be received by another, or post on the premises of another, any letter or writing or any 31 verbal message threatening to burn, damage or destroy, conditionally or unconditionally, any 32 house, store, shop, barn or other building, or any vehicle. 33 34 Sec. 26-169. Storage of explosives and blasting agents, class 1 liquids and 35 liquefied petroleum gas restricted. 36 The limits referred to in the fire prevention code in which storage of explosives and 37 blasting agents is prohibited, in which storage of class I liquids in outside aboveground tanks 38 is prohibited, and in which bulk storage of liquefied petroleum gas is restricted, shall be the 39 City limits and the police jurisdiction thereof. 40 41 Sec. 26-170. Reserved. 36 37 ARTICLE II. BUILDING CODE 38 39 Sec. 105-23. Adopted. 40 In accordance with the authority granted by Code of Ala. 1975, § 11-45-8(c) and Code of 41 Ala. 1975, § 41-9-166, the International Building Code, 2021 edition, International Residential 42 Code, 2021 edition (With the Alabama Residential Building and Energy Code Amendments), 43 the International Existing Building Code, 2021 edition and the 2015 International Commercial 44 Energy Code, except such sections and portions thereof as are herein modified, is hereby 45 adopted by reference as the building code of the City. Work prior to permit. Where work for which a permit is required by this chapter 2 commences prior to obtaining said permit, the permit fee herein specified shall be 3 doubled. 4 b. Moving fee. For the relocation of any building or structure, the fee shall be $100.00 5 per section. 6 c. Demolition fee. For the demolition of any building or structure, the fee shall be 7 $25.00 per story. In addition, the application for a demolition shall be accompanied 8 by a $1,000.00 surety, which shall be refunded by the Building Official when all 9 demolition debris has been properly removed from the site. Said bond or cash 10 deposit shall indemnify the City against damage to the public streets and 11 sidewalks, and against unwarranted litter and debris allowed to remain on the 12 premises, which constitutes a public nuisance. Interior demolition shall be based on 13 the contract value provided by the permittee. 14 d. Mobile or manufactured home. For the placement of any manufactured home 15 covered by the National Manufactured Housing Construction and Safety Standards 16 Act of 1974 (commonly known as the HUD Code), a fee of $100.00 shall be paid 17 prior to placement of the structure. The permit fee shall cover the inspection of 18 correct installation, flood hazard determination, electrical connection and plumbing 19 connection. 20 e. Plan review fee. A plan review fee shall be paid for the review of all multi -family, 21 commercial and industrial projects that require architectural plans. Said fee shall be 22 paid at the time said plans are submitted to the City planning and development 23 department. 24 Plan review fee shall be calculated as $2.50 per $1,000.00 of building valuation, 25 with a minimum fee of $250.00 and a maximum of $10,000.00. 26 When determined by the Building Official or the Fire Marshal that it is necessary 27 for plan review to be performed by an outside party (e.g., International Code 28 Council), the full fee shall be paid by the owner or contractor to the outside 29 party. 30 f. Re -inspection fee. A fee of $100.00 shall be paid for each re -inspection of a failed 31 second inspection. 32 g. Pursuant to Alabama Act 2015-308, the City shall assess a fee on all non- 33 residential construction work permitted within the City in the amount of $1.00 for 34 every $1,000.00 of said non-residential construction work permitted. 35 The fees shall be collected by the City and shall be electronically remitted 36 monthly to the department of finance, division of construction management, by 37 the 20th day of the month following the issuance of the applicable permits as 38 required by Act 2015-308. 39 (5) Fee refunds. The Building Official shall authorize the refunding of fees as follows: 40 a. The full amount of any fee paid hereunder that was erroneously paid or collected. 41 b. Not more than 80 percent of the permit fee paid when no work has been done 42 under the permit issued in accordance with this chapter. 43 c. Not more than 80 percent of the plan review fee paid when an application for a 44 permit for which a plan review fee has been paid is withdrawn or cancelled before 45 the plan review has been completed. 46 (b) The Building Official shall not authorize the refunding of any fee paid except upon written 47 application filed with the City planning and development department by the original 48 permittee. 49 50 Sec. 105-27. Penalty for violation. 51 Any person who violates a provision of this chapter or fails to comply with any 52 requirements thereof or who erects, constructs, alters, or repairs a building or structure in 53 violation of the approved construction documents or directive of the Building Official, or of a 54 permit or certificate issued under the provisions of this chapter, shall be guilty of a 55 misdemeanor. 56 57 Sec. 105-28. Business license prerequisite to building permit. 58 No person shall be issued a building permit unless he holds a valid business license 59 issued by the City. Nothing in this section requires a homeowner to obtain a business license 60 in order to do work on his own property. 61 62 Sec. 105-29. Building permit required for subcontractors. 63 (a) All builders and contractors shall upon request furnish the Building Official or the license 64 inspector a full and complete list showing the names, addresses and license numbers of I all subcontractors to whom any work has been let or sublet to be done and will not allow 2 any work to be done by such subcontractor until the permit required by the code adopted 3 by this article has been obtained by the subcontractor. If any changes to the 4 subcontractors list are made after the issuance of a permit, the builder or contractor must 5 notify the Building Official, in writing, of such changes. 6 (b) If all subcontracts have not been closed or awarded at the time application is made for 7 such permit by the builder or contractor or by the owner, they shall not allow any work to 8 proceed by any subcontractor until such subcontractor has exhibited to such 9 subcontractor's permit for the work to be done on the job, and unless such subcontractor 10 is certified by the license division or by the Building Official as having paid for the permit. 11 (c) In the event that no contract has been let by the owner, then the owner shall be subject 12 to all of the provisions herein required of a builder or contractor. 13 14 Secs. 105-30-105-46. Reserved. 15 16 ARTICLE Ill. ELECTRICAL CODE 17 18 DIVISION 1. GENERALLY 19 20 Sec. 105-47. Definition. 21 The term "electrical inspector," as used in this article, shall mean the primary inspector 22 designated by the Building Official to make electrical inspections. 23 24 Sec. 105-48. Records and reports of electrical inspection. 25 Inspectors shall keep a full and complete daily record of all work done, permits issued, 26 examinations made, and other official work performed as required by this article, and shall 27 make a report thereof to the City Council at the first meeting of each year. 28 29 Secs. 105-49-105-64. Reserved. 30 31 Secs. 105-74-105-89. Reserved. 32 33 DIVISION 3. WORK PERMITS 34 35 Sec. 105-90. Application. 36 Application for a permit under this division shall be made in writing to the Building 37 Official by the person installing the work. Such application shall show the name of the 38 property owner, the name of the electrician or electrical contractor who is to do the work, the 39 exact location of the premises by number of block, lot and house, or other good and sufficient Q description, a clear description of the work to be done, and the number of lights, fixtures, 41 circuits and equipment. 42 43 Sec. 105-91. Filing of plans and specifications by applicant. 44 The person making application for a permit under this division shall, when required by 45 the electrical inspector, file with the inspector complete plans and specifications for the 46 installation, showing sizes of all conductors and such other details as may be necessary to 47 determine whether the installation as described will be in conformity with the requirements of 48 this article. 49 50 Sec. 105-92. Not to issue to person failing to correct defects. 51 Any person who shall fail to correct any defect in such person's work, after having 52 been duly notified by the electrical inspector, shall not receive any further permit under this 53 division until such defect has been corrected. 54 55 Sec. 105-93. Effect; compliance. 56 A permit issued under this division shall be for such installation as is described in the 57 application and no deviation shall be made from the installation so described, without the 58 written approval of the electrical inspector. 59 60 Secs. 105-94-105-116. Reserved. 61 62 DIVISION 4. INSTALLATION REQUIREMENTS 63 1 Sec. 105-117. Electrical code adopted. 2 There is hereby adopted by the City, for the purpose of establishing rules and 3 regulations, including the practice, materials and fixtures used, for the installation, 4 construction, maintenance, extension, removal, demolition, and erection of electrical wiring, 5 construction, electrical signs, and installation of electrical fixtures, machinery, equipment and 6 appurtenances, the 2020 edition of the National Electrical Code, NFPA 70. Such code shall 7 be subject to all amendments, modifications and conflicting provisions contained in this code. 8 9 Sec. 105-118. Regulating the placement, etc., of wires and appliances. 10 The electrical inspector is hereby authorized, empowered and directed to regulate and 11 determine the placing of electric wires or other appliances for electric light, heat or power in 12 the city and to cause all such wires or appliances to be placed, constructed and guarded as 13 not to cause fires or accidents, endangering life or property. 14 15 Sec. 105-119. Inspection and approval of wiring installations. 16 Upon the completion of any wiring installation of any building for light, heat or power, it 17 shall be the duty of the person doing the same to notify the electrical inspector, and all wiring 18 shall then be inspected and, if found properly installed and protected so as not to endanger 19 life or property, the inspector shall notify the utility furnishing electric current and power in that 20 section that it is ready to be used; thereby permitting connection to the system at the 21 pleasure of the owner. There shall not be any approval issued on any installation not in 22 accordance with this article, nor shall current be turned on to such installations until such 23 approval is issued. 24 25 Sec. 105-120. Discontinuing electric service to defective systems. 26 In any case of failure to comply with this article, the electrical inspector shall have 27 authority, after due notice, to cut off, or cause to be cut off, electric current or power in the 28 locality involved, and it shall be unlawful for any person to connect or cause to be connected 29 any system cut off for this purpose, until such corrections are made as are deemed 3o necessary by the electrical inspector for the protection of life and property. 31 32 Sec. 105-121. Electrical inspector's right of entry; removal of defects in wires or 33 appliances. 34 (a) The electrical inspector shall have the right, in the discharge of official duties, to enter, 35 during reasonable hours, any building, manhole, or subway, or to climb any pole, for the 36 purpose of examining and testing the electrical appliances therein or thereon contained. 37 For that purpose, such inspector shall be given prompt access to all buildings, public and 38 private, and to all manholes, subways or poles. 39 (b) Whenever an electric wire or appliance shall be defective through improper or insufficient 40 insulation, or for any other reason, the electrical inspector shall at once cause the 41 removal of such defects at the expense of the owner of such wires or appliances. 42 43 Sec. 105-122. Review when installation condemned. 44 When the electrical inspector condemns all or part of any electrical installation, the owner 45 may, within five days after receiving written notice, file a petition in writing for review of such 46 action of the electrical inspector with the electrical examining board, upon receipt of which the 47 board shall determine whether the electrical installation complies with the law, and render its 48 decision accordingly. 49 50 Secs. 105-123-105-142. This property has not been used as a roadway and the 2018 easement granted provided for the actual roadway used by the City of Prattville. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that in order to effectuate the intent of the parties in the December 2018 easement, the City of Prattville shall quitclaim any possible interest in the lands of Prattville Land Company, Inc., other than those deeded by the Prattville Land Company, Inc., to the City of Prattville by deed recorded in RLPY Book 2018 at Page 9300 on December 31, 2018. This shall divest the City of Prattville of any property rights outside of the deed recorded in RLPY Book 2018 at Page 9300 and vest all property rights in Prattville Land Company, Inc. (ACIC), a non-profit corporation, maintains the 13-mile national recreation trail known as the Autauga Creek Canoe Trail; and and WHEREAS, the ACIC also offers classes that promote kayaking and encourage safety; WHEREAS, the ACIC has a need for property to store kayaks and equipment for ease of access to Autauga Creek; and WHEREAS, the City of Prattville desires to lease certain property located on West 4th Street, more specifically described below, to the ACIC for storage of said kayaks and equipment for a term of one year. Commencing at the southeast comer of Lot 8 of A.G. Carter Plat as recorded in Map Book 3, Page 69, thence North 85 feet to a point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that the Mayor is authorized to enter into an agreement with Hydro Engineering Solutions for said engineering services.
