WHEREAS, the final subdivision plat was recorded for Prattville Business Park Plat No.
5 (Boardroom Drive) on June 19, 2019; and
WHEREAS, the developer of said subdivision must maintain the public utilities, rights -
of -way and easements in the subdivision until accepted by the City Council of the City of
Prattville; and
WHEREAS, the owner of said subdivision has maintained the public utilities and public
improvements in the subdivision for the minimum period required by the Prattville Subdivision
Regulations and has corrected all deficiencies presented by the City of Prattville Engineering
Department; and
WHEREAS, all public utilities and public improvements in said subdivision were
inspected and approved by the City of Prattville Engineering, Planning and Development, and
Public Works Departments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville,
that all public utilities and public improvements in Prattville Business Park Plat No. 5 are hereby
accepted by the City of Prattville for permanent maintenance.

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes and mosquitoes, and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, §11-67-1 et seq., of the Code of Alabama, 1975, as amended, permits the
City Council of the City of Prattville to declare an abundance of overgrown grass and weeds to
be a public nuisance; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the properties at the following addresses and determined the existence of an abundance of
overgrown grass and weeds:
449 Dawson Street- Patrick Morace c/o Steve Patrick or Ashley Odom, 1686 Tom
Turner Road, Billingsley, AL 36006 (19 03 07 4 001 028.000)
• 460 Dawson Street- Habitat for Humanity of Autauga and Chilton Counties c/o Habitat
for Humanity of Autauga & Chilton, 120 E Fifth Street, Prattville, AL 36067

• 1212 Josephine Avenue- Creekside Drive LLC, 212 W Troy Street, Suite B, Dothan,

NOW, THEREFORE, BE IT RESOLVED THAT:
1. the City Council of the City of Prattville declares the abundance of overgrown grass and
weeds at the above -listed addresses to be a public nuisance; and
2. the owners of said property, as they appear in the records of the Autauga County or
Elmore County Revenue Commissioners, are ordered to abate the abundance of
overgrown grass and weeds; and
3. the owners of said property are ordered to appear before the City Council of the City of
Prattville at a Public Hearing at 6:00 p.m. on September 6, 2022, in Prattville City Hall;
and
4. the notice as required by §11-67-62, Code of Alabama, 1975, as amended, will be
provided in a publication of general circulation in compliance with the law, by certified
mail, and by signage on the subject property.

19 A, Page 125, that the abundance of overgrown grass and weeds at various addresses in the
20
21 City of Prattville constituted a public nuisance and set a public hearing to discuss said
22
23 nuisances; and
24
25 WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended,
26
27 was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject
28
29 property; and
30
31 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
32
33 said properties and determined that the public nuisance still exists; and
34
35 WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on August 2,
36
37 2022, permitting the owners of said properties to present evidence, objections, and protest
38
39 regarding the proposed removal of weeds.

41 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
42
43 declares that the abundance of overgrown grass and weeds on the properties continue to be
44
45 a public nuisance:

52 BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds

54 on the properties listed above cut or removed using city forces or private contractors. Any

56 property owner shall have the right to have any weeds removed at his or her own expense
57
58 provided the removal is done prior to the commencement of work by employees or agents of
59
60 the City of Prattville. The Mayor shall keep an accounting of all costs related to the removal of
61
62 overgrown grass and weeds and report such cost to the City Council following their removal.

WHEREAS, stagnant water is a public nuisance that is injurious to the public health,
safety and general welfare of the community pursuant to Section 46-6, City of Prattville Code
of Ordinances; and
WHEREAS, § 6-5-122 et seq., of the Code of Alabama, 1975, as amended, permits
the City Council of the City of Prattville to declare a public nuisance and abate the same; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and determined the existence of stagnant water at 222 Moncrief Street; and
WHEREAS, the Autauga County tax records list the property owner as Sanderson
Holding LLC c/o Infusion Properties LLC, with an address of 220 Elba Highway, Troy, AL
36079 to parcel number 19 02 09 3 018 005.000; and
WHEREAS, in compliance with Section 46-31 of the City of Prattville Code of
Ordinances, the Prattville Police Department Code Enforcement Officer sent notice to the
owner of the above property in writing on June 3, 2022, to correct, remedy or remove the
condition of stagnant water within 10 days; and
WHEREAS, the owner of 222 Moncrief Street has failed and/or refused to correct,
remedy or remove the condition of stagnant water after the expiration of said notice; and
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on
August 2, 2022, permitting the owner(s) of said property to present evidence, objections,
and protest regarding the proposed removal of stagnant water; and
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the
City to do such work or make such improvements that are necessary to correct, remedy or
remove such condition, pay therefore and charge the expenses incurred to the owner of
such lot.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the stagnant water at 222 Moncrief Street continues to be a nuisance.
BE IT FURTHER RESOLVED the Mayor shall have the stagnant water at 222 Moncrief
Street removed using City forces or private contractors. The property owner shall have the right
to remove the stagnant water at his or her own expense provided the removal is done prior to
the commencement of work by employees or agents of the City of Prattville. The Mayor shall

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are
hereby amended to reclassify the property described in Attachment "A" from FAR (Forest,
Agriculture, Recreation) to B-2 (General Business); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on August 2,
2022, at 6:00 p.m., considered said proposed ordinance and that at such time and place all
persons who desired had an opportunity to be heard in favor of or in opposition to such
ordinance.
ALL other items and provisions of the zoning ordinance of the City of Prattville not herein
specifically amended shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on June 16, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

purchase one (1) 2022 John Deere BA84C angle broom; and
WHEREAS, said angle broom is available from Warrior Tractor & Equipment Company,
Inc. at a cost not to exceed $11,155.00; and
WHEREAS, the Finance Director has identified a certain sum of surplus funds available
for departments that came in under budget in prior fiscal years; and
WHEREAS, a portion of the Engineering Department allocation of said surplus funds
shall be used for the purchase of said angle broom.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the FY2022 Budget is hereby amended as follows:
Decrease Engineering/ Departmental Reserves $11,155.00
Increase Engineering/ Capital Outlay $11,155.00
BE IT RESOLVED that funds in an amount not to exceed $11,155.00 are hereby
authorized and approved to be paid to Warrior Tractor & Equipment Company, Inc. for said
angle broom, and said funds are hereby approved and appropriated from the FY2022 Budget
Line Item Engineering/ Capital Outlay.

WHEREAS, the City of Prattville Engineering Department has identified a need to
purchase one (1) 2024 Kenworth T380 Dump Truck; and
WHEREAS, said dump truck is available through the Sourcewell Purchasing
Cooperative, Contract No. 060920-KTC, from Kenworth of Montgomery, Inc. at a cost not to
exceed $146,500.00; and
WHEREAS, there is an estimated lead time of twenty-four (24) months for assembly
and delivery of said dump truck, thus requiring authorization to purchase in FY2022; and
WHEREAS, this purchase will be funded in the Engineering/ Capital Outlay line item
of the FY2024 Budget.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes the purchase of said dump truck through Kenworth of Montgomery, Inc. at a
cost not to exceed $146,500.00.

WHEREAS, the Finance Director has identified a certain sum of surplus funds available
for departments that came in under budget in prior fiscal years; and
WHEREAS, a portion of the Engineering Department allocation of said surplus funds
shall be used for the purchase of said compaction roller and trailer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the FY2022 Budget is hereby amended as follows:

WHEREAS, CFR 2201, LLC is the petitioner of the property described in Attachment
"A"; and
WHEREAS, said property to be rezoned is located inside the City Limits at 2201 Cobbs
Ford Road; and
WHEREAS, the petitioner wishes to rezone the approximately Y2 acre property from
FAR (Forest, Agriculture, Recreation) to B-2 (General Business); and
WHEREAS, a Public Hearing on the proposed rezoning was held by the Prattville
Planning Commission on July 21, 2022; and
WHEREAS, the City of Prattville Planning Commission did recommend the zoning of
said property, as described in Attachment "A", be amended from FAR (Forest, Agriculture,

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are
hereby amended to reclassify the property described in Attachment "A" from FAR (Forest,
Agriculture, Recreation) to B-2 (General Business); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on September
6, 2022, at 6:00 p.m., considered said proposed ordinance and that at such time and place all
persons who desired had an opportunity to be heard in favor of or in opposition to such
ordinance.
ALL other items and provisions of the zoning ordinance of the City of Prattville not herein
specifically amended shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on July 21, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

RESOLUTION
[To Authorize the Mayor to Enter into an Agreement with Regions Bank to Purchase a
Temporary Construction Easement and a Portion of the Right -of -Way for the Widening of
McQueen Smith Road in an Amount Not to Exceed $23,000.00.]

WHEREAS, the City of Prattville has identified the need to widen McQueen Smith Road
from Cobbs Ford Road to U.S. Highway 31; and
WHEREAS, the City of Prattville entered into an agreement with the Alabama
Department of Transportation, Project No. STPOA-7812(600), for the widening and resurfacing
of McQueen Smith Road; and
WHEREAS, a right-of-way is required from Regions Bank, 1901 East Main Street,
Prattville, AL, for the purpose of completing said project; and
WHEREAS, the City of Prattville has agreed to purchase a temporary construction
easement and a portion of the right-of-way for $23,000.00 for said project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes the Mayor to enter into an agreement with Regions Bank to purchase said
Temporary Construction Easement and a portion of the right-of-way for the widening of
McQueen Smith Road in an amount not to exceed $23,000.00, and said funds are approved
and appropriated from FY2022 Budget Line Item Capital Projects Fund/ McQueen Smith Road.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution for and on behalf of the City
of Prattville.

[To Authorize Fees for Certain Records.]

WHEREAS, §36-12-40 et seq., of the Code of Alabama, 1975, as amended, gives
citizens of Alabama the right to certain records; and
WHEREAS, §36-12-41 et seq., of the Code of Alabama, 1975, as amended, allows for
fees to be assessed for the production of said records; and
WHEREAS, many records of the City of Prattville are available online through the
City of Prattville's public portal at no cost to the citizens; and
WHEREAS, there is a need to establish a fee schedule for record requests.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville,
that the following fee schedule is established for the production of hard copy or electronic
records:
General Record Requests $5.00
Parcel Assessment Requests $25.00
If requests are time -intensive, requiring more than one (1) hour to complete, a fee of $30
per hour will be charged beginning with the second hour. Partial hours will be rounded
to the next full hour. Costs for requests that require minimal time and resources may be
waived by the City Clerk.
BE IT FURTHER RESOLVED, that the above fee schedule will become effective
October 1, 2022.

WHEREAS, Halieus, LLC is the petitioner of the property described in Attachment "A";
WHEREAS, said property to be rezoned is located inside the City Limits at the
eastern/southeastern side of Highway 82 East, East of McQueen Smith Road and West of
Constitution Avenue; and
WHEREAS, the petitioner wishes to rezone the approximately 232-acre property from
B-2 (General Business) and FAR (Forest, Agriculture, Recreation) to PUD (Planned Unit
Development); and
WHEREAS, a Public Hearing on the proposed rezoning was held by the Prattville
Planning Commission on July 21, 2022; and
WHEREAS, the City of Prattville Planning Commission did recommend the zoning of
said property, as described in Attachment "A", be amended from B-2 (General Business) and
FAR (Forest, Agriculture, Recreation) to PUD (Planned Unit Development).
