WHEREAS, a vacancy currently exists on the Historic Preservation Commission due to
the resignation of Zack Barker on August 19, 2022; and
WHEREAS, it is the desire of the City Council of the City of Prattville to fill said vacancy
to ensure the continuity of the Commission's operation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
Tom Miller is hereby appointed to fill said vacancy effective November 1, 2022, and said term
shall expire on April 5, 2025, or until a successor is duly qualified and appointed.

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes and mosquitoes and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, §11-67-1 et seq., Code of Alabama, 1975, as amended, permits the City
Council of the City of Prattville to declare an abundance of overgrown grass and weeds to be
a public nuisance; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property at the following addresses and determined the existence of an abundance of
overgrown grass and weeds:
• 907 Brookwood Drive- Northington James, 907 Brookwood Drive, Prattville, AL 36066

• 1212 Josephine Avenue- Creekside Drive, LLC, 212 W Troy Street, STE B, Dothan,

County Road 39, Deatsville, AL 36022 [19 02 10 2 002 006.000]
NOW, THEREFORE, BE IT RESOLVED THAT:
1. the City Council of the City of Prattville declares the abundance of overgrown grass and
weeds at the above -listed addresses to be a public nuisance; and
2. the owners of said properties, as they appear in the records of the Autauga County or
Elmore County Revenue Commissioners, are ordered to abate the abundance of
overgrown grass and weeds; and
3. the owners of said properties are ordered to appear before the City Council at a Public
Hearing at 6:00 p.m. on November 15, 2022, at Prattville City Hall; and
4. the notice as required by §11-67-62, Code of Alabama, 1975, as amended, will be
provided in a publication of general circulation in compliance with the law, by certified
mail, and by signage on the subject property.

WHEREAS, the City of Prattville Police Department received one (1) Wheeled Tactical
Truck from the Alabama Department of Economic and Community Affairs (ADECA) Law
Enforcement Support Office (LESO) 1033 Program on October 1, 2013; and
WHEREAS, pursuant to the ADECA LESO 1033 Program State Plan of Operations,
said tactical truck is defined as "controlled property", thus title and ownership is not relinquished
to the law enforcement receiving agency and must be returned to the ADECA LESO 1033
Program or transferred to another participating law enforcement agency when no longer
needed; and
WHEREAS, the Police Department has determined said tactical truck is no longer
needed for law enforcement purposes; and
WHEREAS, the ADECA LESO 1033 Program approved the transfer of said tactical truck
to Millbrook Police Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the following personal property shall be removed from inventory of the Prattville Police
Department and the City's insurance policy:
• 2010 M1123 Tactical Truck (08-602)

BE IT FURTHER RESOLVED that the City Council instructs the Police Department to
complete transfer of said tactical truck to the Millbrook Police Department following all
applicable directives from the ADECA LESO 1033 Program.

WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2022-
A, Page 187, that the abundance of overgrown grass and weeds at various addresses in the
City constituted a public nuisance and set a public hearing to discuss said nuisances; and
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended,
was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject
property; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
said properties and determined that the public nuisance still exists; and
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on October
18, 2022, permitting the owners of said properties to present evidence, objections, and protest
regarding the proposed removal of weeds.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the abundance of overgrown grass and weeds on the properties continue to be
a public nuisance:
• 900 Block Wilberforce Avenue- Epkins Sylvia Mae c/o Frank Epkins Jr, 470 West
Drive, Prattville, AL 36067 [19 03 05 4 001 005.000]
• 400 Block New Moon Drive- Ellis Virginia C c/o Linda Dykes, 3313 Butler Road,
Johnson City, TN 37604 [19 05 16 2 000 116.000] (Corrected)
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds
on the properties listed above cut or removed using city forces or private contractors. Any
property owner shall have the right to have any weeds removed at his or her own expense
provided the removal is done prior to the commencement of work by employees or agents of
the City. The Mayor shall keep an accounting of all costs related to the removal of overgrown
grass and weeds and report such cost to the City Council following their removal.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the Zoning Ordinance of Prattville, Alabama, was adopted on March 15, 2022;
THAT the Planning Commission may recommend amendments to the Zoning Ordinance
as needed from time to time; and
THAT the Zoning Ordinance of Prattville, Alabama, is hereby amended as described in
Attachment "A"; and
THAT notice was advertised for three (3) weeks in the Montgomery Advertiser, a
newspaper of general circulation within the City Limits of the City of Prattville; in addition, the
same notice was published one time in the regular section of the newspaper in the form of a
one -quarter page advertisement, and that the City Council of the City of Prattville, at its public
hearing on October 18, 2022, at 6:00 p.m., considered said proposed ordinance and that at
such time and place all persons who desired had an opportunity to be heard in favor of or in
opposition to such ordinance.

15, 2022, and amended herein.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

BE IT ORDAINED by the City Council of the City of Prattville that City of Prattville Code
of Ordinances, Chapter 50 Offenses and Miscellaneous Provisions, Article III Offenses
Involving Public Peace and Order, Division 1 Generally, Section 50-49 is hereby amended to
read as follows:
Section 50-49. — Drinking, open possession of or attempt to drink, sell, etc.,
liquors, wines or malt brewed beverages in public places.
(a) It shall be unlawful for any person to drink, to have in open or unconcealed
possession or custody, for drinking, selling, serving, dispensing, or to give away, or
to attempt to drink, sell, serve, dispense ar give away any liquor, wine or malt or
brewed beverages, while upon any street, avenue or alley, or in any public building
or upon any public property, or while in any other public place. As used in this
section, the term "public place" means and includes any place or gathering which the
public generally attends or is admitted to either by invitation, common consent or
right, or by payment of an admission or other charge, and, without limiting the
generality of the foregoing, shall include any theater or other place of amusement
and any athletic contest; provided that such term "public place" shall not mean or
include premises which have been duly licensed by the City for sale thereon of such
beverages, the Doster Memorial Community Center located at 424 South
Northington Street, the Prattville Senior Citizens Center located at 334 Doster Road,
342 South Chestnut Street and the park area located along South Court Street,
provided that proper application has been made ten days prior to the event to the
mayor and the mayor has issued a permit.
(b) This section does not apply to possession of alcoholic beverages in motor
vehicles.
THIS Ordinance shall become effective upon its passage and execution as provided by
law.

BE IT ORDAINED by the City Council of Prattville, Alabama, as follows:
Section 1. In conformity with the provisions Act 2012-256 enacted by the Alabama Legislature
during the 2012 Regular Session, providing for a State Severe Weather Preparedness Sales
Tax Holiday, the City of Prattville, Alabama, exempts "covered items" from municipal sales and
use tax during the same period, beginning at 12:01 a.m. on Friday, February 24, 2023, and
ending at twelve midnight on the following Sunday, February 26, 2023.
Section 2. This ordinance shall be subject to all terms, conditions, definitions, time periods,
and rules as provided by Act 2012-256, except that the time period shall only be as specified
in Section 1 above and not for all years thereafter.
Section 3. The City Clerk is hereby authorized and directed to certify a copy of this ordinance
under the seal of the City of Prattville, Alabama, and to forward said certified copy to the
Alabama Department of Revenue to be recorded and posted on the Department website.
Section 4. This ordinance shall become effective upon its passage and publication as required
by law.

WHEREAS, pursuant to Resolution Book 2022, Page 004, on January 18, 2022, the
City of Prattville plans to proceed with Alabama Department of Transportation (ALDOT) Project
No. TAPAA-TA22(914) for Sidewalk Improvements to East Main Street, Phase I; and
WHEREAS, the Engineering Department had specifications drafted for said
improvement project; and
WHEREAS, two (2) sealed bids were received, opened and read on August 31, 2022,
at 10:00 a.m. in the Council Chambers at City Hall, and South Dade Air Conditioning (SDAC)
was the lowest responsible bidder at a cost of $608,030.25 for said improvement project; and
WHEREAS, said improvement project is a budgeted expense.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby awards Bid No. 022-015 to SDAC in an amount not to exceed $608,030.25 (net cost to
the City not to exceed $121,606.05) for said improvement project, and said funds are approved
and appropriated from the FY2023 Budget Line Item Capital Projects Fund/ TAP 2022 — Shady
Oak Silver Hills Sidewalks.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.

WHEREAS, the Engineering Department has identified a need for construction
engineering services for sidewalk improvements to East Main Street, Phase I, Alabama
Department of Transportation (ALDOT) Project No. TAPAA-TA22(914); and
WHEREAS, Civil Southeast LLC has the expertise to provide said construction
engineering services at a cost not to exceed $91,205.00 (net cost to the City not to exceed
$18,241.00); and
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to
secure services with engineers possessing a high degree of professional skill to be let without
competitive bidding; and
WHEREAS, said improvement project is a budgeted expense.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville,
that the Mayor is hereby authorized to enter into said agreement with Civil Southeast LLC for
said construction engineering services at a cost not to exceed $91,205.00 (net cost to the City
not to exceed $18,241.00), and funds are approved and appropriated from FY2023 Budget
Line Item Capital Projects Fund/ TAP 2022 — Shady Oak Silver Hills Sidewalks.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and

RESOLUTION
[To Amend the FY2023 Budget and Award Bid No. 022-018 to Ready2Go Restroom Trailers
Sales LLC for One (1) 2021 or Newer ADA Compliant Toilet Trailer for the Parks and
Recreation Department at a Cost Not to Exceed $58,617.00.]

WHEREAS, the City of Prattville Parks and Recreation Department has identified a need
for one (1) 2021 or newer ADA compliant toilet trailer; and
WHEREAS, the Parks and Recreation Department had specifications drafted for said
toilet trailer; and
WHEREAS, one (1) sealed bid was received, opened and read on October 6, 2022, at
10:00 a.m. in the Council Chambers at City Hall, and Ready2Go Restroom Trailers Sales LLC
was the lowest responsible bidder at a cost of $58,617.00 for said toilet trailer; and
WHEREAS, the Finance Director has identified a certain sum of surplus funds available
for departments that came in under budget in prior fiscal years.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the FY2023 Budget is hereby amended as follows:
Decrease Parks and Recreation/ Departmental Reserves $58,617.00
Increase Parks and Recreation/ Capital Outlay $58,617.00
BE IT FURTHER RESOLVED by the City Council that Bid No. 022-018 is hereby
awarded to Ready2Go Restroom Trailers Sales LLC in an amount not to exceed $58,617.00
for said toilet trailer, and said funds are approved and appropriated from the FY2023 Budget
Line Item Parks and Recreation/ Capital Outlay.

[To Authorize the Mayor to Negotiate Terms and Conditions for Project Gap.]

WHEREAS, the City Council of the City of Prattville works through and with the Prattville
Economic Development Team (Team) to attract and retain economic development; and
WHEREAS, the Team, when necessary, calculates, reviews and offers incentives and
other assistance to businesses who are interested in locating within the City; and
WHEREAS, the Team has met and recommended negotiating incentives for Project
Gap for the purpose of economic development in the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville,
that the Mayor is authorized to negotiate terms and conditions for Project Gap and report
back to the City Council with the agreement for consideration.
