WHEREAS, a vacancy currently exists on the Autauga-Prattville Library Board of
Trustees due to the resignation of Kim Miers on September 1, 2022; and
WHEREAS, it is the desire of the City Council of the City of Prattville to fill said vacancy
to ensure the continuity of the Board's operation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
Pam Frederick is hereby appointed to fill the vacancy on the Autauga-Prattville Public Library
Board of Trustees effective immediately and said term shall expire on November 30, 2025, or
until a successor is duly qualified and appointed.

WHEREAS, the appointment of Steve Burton to the Autauga-Prattville Library Board of
Trustees shall expire on November 30, 2022; and
WHEREAS, it is the desire of the City Council of the City of Prattville to ensure the
continuity of the Board's operation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that

RESOLUTION

WHEREAS, pursuant to §11-5313-3, Code of Alabama, 1975, as amended, the City
Council of the City of Prattville adopted Resolution Book 2022-A, Page 166 on September 6,
2022, authorizing the Mayor to affix the cost of demolition of an unsafe structure and establish
a lien against the property at 111 Isom Street in the amount of $4,161.28; and
WHEREAS, said lien was paid by Wilbert Von Burt on October 12, 2022.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that
said demolition lien is satisfied and hereby released.
BE IT FURTHER RESOLVED that the City Attorney shall Ole with the Autauga County
Probate Court a lien release letter for 111 Isom Street.

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes and mosquitoes and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, §11-67-1 et seq., Code of Alabama, 1975, as amended, permits the City
Council of the City of Prattville to declare an abundance of overgrown grass and weeds to be
a public nuisance; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property at the following address and determined the existence of an abundance of
overgrown grass and weeds:
• 122 Quail Run- Edwards Carson B, 122 Quail Run, Prattville, AL 36067

NOW, THEREFORE, BE IT RESOLVED THAT:
1. the City Council of the City of Prattville declares the abundance of overgrown grass and
weeds at the above -listed address to be a public nuisance; and
2. the owners of said property, as they appear in the records of the Autauga County or
Elmore County Revenue Commissioners, are ordered to abate the abundance of
overgrown grass and weeds; and
3. the owners of said property are ordered to appear before the City Council at a Public
Hearing at 6:00 p.m. on December 6, 2022, at Prattville City Hall; and
4. the notice as required by §11-67-62, Code of Alabama, 1975, as amended, will be
provided in a publication of general circulation in compliance with the law, by certified
mail, and by signage on the subject property.

WHEREAS, stagnant water is a public nuisance that is injurious to the public health,
safety and general welfare of the community pursuant to Section 46-6, City of Prattville Code
of Ordinances; and
WHEREAS, §6-5-122 et seq., Code of Alabama, 1975, as amended, permits the City
Council of the City of Prattville to declare a public nuisance and abate the same; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and determined the existence of stagnant water at 311 Walker Street; and
WHEREAS, the Autauga County tax records list the property owner as Moffett Jules M.
& Wells Robert Spencer Sr., Trustee of the CMC Trust dated January 22, 2020, with an address
of 4565 Highway 14, Millbrook, AL 36054, to parcel number 19 02 10 2 007 010.000; and
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the
Code Enforcement Officer sent notice to the owner of the above property in writing on
September 16, 2022, to correct, remedy or remove the condition of stagnant water within 10
days; and
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or
remove the condition of stagnant water after the expiration of said notice; and
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on November
1, 2022, permitting the owner of said property to present evidence, objections, and protest
regarding the proposed removal of stagnant water; and
WHEREAS, Section 46-32, City of Prattville Code of Ordinances, authorizes the City to
do such work or make such improvements that are necessary to correct, remedy or remove
such condition, pay therefore and charge the expenses incurred to the owner of such lot.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the stagnant water at 311 Walker Street continues to be a nuisance.
BE IT FURTHER RESOLVED the Mayor shall have the stagnant water at 311 Walker
Street removed using City forces or private contractors. The property owner shall have the right
to remove the stagnant water at his or her own expense provided the removal is done prior to
the commencement of work by employees or agents of the City. The Mayor shall keep an
accounting of all costs related to this request and report such cost to the City Council following

City constituted a public nuisance and set a public hearing to discuss said nuisances; and
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended,
was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject
properties; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
said properties and determined that the public nuisance still exists; and
WHEREAS, the City Council held the required public hearing at 6:00 p.m. on November
1, 2022, permitting the owners of said properties to present evidence, objections, and protest
regarding the proposed removal of weeds.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the abundance of overgrown grass and weeds on the properties continue to be
a public nuisance:

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds
on the properties listed above cut or removed using city forces or private contractors. Any
property owner shall have the right to have any weeds removed at his or her own expense
provided the removal is done prior to the commencement of work by employees or agents of
the City. The Mayor shall keep an accounting of all costs related to the removal of overgrown
grass and weeds and report such cost to the City Council following their removal.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are
hereby amended to reclassify the property described in Attachment "A" from FAR (Forest,
Agriculture, Recreation) to M-2 (General Industry); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council at its Public Hearing on November 1, 2022, at 6:00 p.m.,
considered said proposed ordinance and that at such time and place all persons who desired
had an opportunity to be heard in favor of or in opposition to such ordinance.
ALL other items and provisions of the zoning ordinance not herein specifically amended
shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on September 15, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

ORDINANCE

WHEREAS, on August 1, 2022, the Alabama Department of Revenue issued a notice
authorizing the increase of the municipal business license issuance fees based on the U.S.
Department of Labor's Producer Price Index; and
WHEREAS, the City of Prattville will increase the business license issuance fee from
$12.00 to $14.00 for the license year beginning January 1, 2023.
BE IT ORDAINED that the City Council of the City of Prattville hereby authorizes the
increase of the business license issuance fee from $12.00 to $14.00 for the license year
beginning January 1, 2023 pursuant to §11-51-90 Code of Alabama, 1975 as amended.
THIS Ordinance shall become effective upon its passage and execution as provided by
law.

RESOLUTION
[To Request an Attorney General's Opinion Regarding the Applicability of the
Requirement to Receive a Certificate of Appropriateness to Governmental Agencies or
Public Authorities and Public Properties within a Designated Historic District.]

WHEREAS, §11-68-1 through §11-68-15, Code of Alabama, 1975, as amended,
authorizes the creation of historic preservation commissions and historic districts; and
WHEREAS, the City Council of the City of Prattville established the City of
Prattville Historic Preservation Commission (HPC) on October 15, 2002, through
Ordinance Book 2002, Page 024, and the Prattville Historic District on January 3, 2008
through Ordinance Book 2008, Page 002; and
WHEREAS, a Certificate of Appropriateness is required for exterior changes to
buildings, structures, or sites in the Prattville Historic District; and
WHEREAS, §11-68-9(a), Code of Alabama, 1975, as amended, states that the
Certificate of Appropriateness shall apply to all actions of public authorities which involve
historic properties and public properties within historic districts; and
WHEREAS, there is uncertainty if the requirement to receive a Certificate of
Appropriateness applies to governmental agencies or public authorities performing
governmental functions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Prattville hereby authorizes Andrew Odom, City Attorney, to request the Honorable
Steve Marshall, Attorney General for the State of Alabama, to give his opinion on the
applicability of the requirement to receive a Certificate of Appropriateness to
governmental agencies or public authorities and public properties within a designated
historic district.

WHEREAS, Carolyn Peddy Brown is the petitioner of the property described in
Attachment "A"; and
WHEREAS, said property to be rezoned is located inside the City Limits east of Highland
Ridge Subdivision; and
WHEREAS, the petitioner wishes to rezone the approximately 115.62-acre property
from FAR (Forest, Agriculture, Recreation), R-2 (Single Family Residential), and B-2 (General
Business) to R-3 (Single Family Residential); and
WHEREAS, a Public Hearing on the proposed rezoning was held by the City of Prattville
Planning Commission on October 20, 2022; and
WHEREAS, the Planning Commission did recommend the zoning of said property, as
described in Attachment "A", be amended from FAR (Forest, Agriculture, Recreation), R-2
(Single Family Residential), and B-2 (General Business) to R-3 (Single Family Residential).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
a Public Hearing is set for December 6, 2022, at 6:00 p.m. at Prattville City Hall.

Pursuant to the requirements of Title 11-52-77, Code of Alabama, 1975, as amended. Notice
is hereby given by the City Council of the City of Prattville, Alabama, that at the regular meeting
of said City Council on November 1, 2022, at Prattville City Hall, 101 West Main Street,
Prattville, Alabama, the following proposed ordinance was introduced.

ORDINANCE
BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are
hereby amended to reclassify the property described in Attachment "A" from FAR (Forest,
Agriculture, Recreation), R-2 (Single Family Residential), and B-2 (General Business) to R-3
(Single Family Residential); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council at its Public Hearing on December 6, 2022, at 6:00 p.m.,
considered said proposed ordinance and that at such time and place all persons who desired
had an opportunity to be heard in favor of or in opposition to such ordinance.
ALL other items and provisions of the zoning ordinance not herein specifically amended
shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on October 20, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

RESOLUTION
[To Authorize the Mayor to Enter into an Agreement with the Autauga County Board of
Education for Use of Stanley Jensen Stadium.]

WHEREAS, the City of Prattville owns, maintains, and operates Stanley Jensen
Stadium; and
WHEREAS, the Autauga County Board of Education (ACBOE) utilizes Stanley Jensen
Stadium for Prattville High School and Prattville Junior High School athletic and band events
and practices; and
WHEREAS, the City has allocated funding to upgrade and renovate Stanley Jensen
Stadium and requested ACBOE to contribute to the renovation costs; and
WHEREAS, ACBOE has approved a $1,772,250.00 contribution for said renovation
costs; and
WHEREAS, the City and the ACBOE desire to enter into an agreement for said usage
at Stanley Jensen Stadium for a term of twenty (20) years; and
WHEREAS, the term for said agreement shall commence on August 1, 2022, and end
on July 31, 2042.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into said agreement between the City and the ACBOE
for Prattville High School and Prattville Junior High School athletic and band events and
practices, and hereby ratifies and affirms said agreement's term from August 1, 2022, through
July 31, 2042.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.

WHEREAS, on October 20, 2022, the City of Prattville Police Department was awarded
Homeland Security Grant No. 2022-2LOC-STS-73, in the amount of $38,761.00, to purchase
one (1) CCTV heavy duty surveillance trailer; and
WHEREAS, said surveillance trailer is available through the GSA Purchasing
Cooperative, Contract No. GS-35F-0740P, from IP Integration, Inc. at a total cost not to exceed
$38,761.00; and
WHEREAS, this is a budgeted expense for the Police Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
funds in an amount not to exceed $38,761.00 (net cost to the City $0.00) are hereby authorized
and approved to be paid to IP Integration, Inc. for said surveillance trailer, and said funds are
hereby approved and appropriated from the FY2023 Budget Line Item Police Department/
Capital Outlay.

County Commission.]

WHEREAS, on March 2, 2022, the City of Prattville received an Attorney General's
Opinion regarding City Services in the Police Jurisdiction; and
WHEREAS, there are certain portions of streets within the county which are partially
inside the corporate limits of the City and partially outside of the corporate limits; and
WHEREAS, the City of Prattville (City) and Autauga County Commission (County)
desire to be responsible for certain Household Garbage Services for various addresses under
the terms of said agreement; and
WHEREAS, the City and County have set out specifically the addresses in which this
service agreement applies as described in Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes the Mayor to enter into said Household Garbage Service Agreement with
Autauga County Commission.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.

Improvements around Pratt Park and Stanley Jensen Stadium at a Total Cost Not to Exceed
$249,918.26.]

WHEREAS, the City of Prattville has a need for lighting improvements around the areas
of Pratt Park and Stanley Jensen Stadium; and
WHEREAS, Alabama Power is the electric service provider in this area; and
WHEREAS, it is the desire of the City to enter into an agreement with Alabama Power
to install and maintain said lighting improvements at a total cost not to exceed $249,918.26;
and
WHEREAS, said improvement project is a budgeted expense.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into an agreement with Alabama Power for said lighting
improvements at a total cost not to exceed $249,918.26 and funds are hereby approved and
appropriated from FY2023 Budget Line Items Capital Projects Fund/ Pratt Park Reno - Tier 1
and Stanley Jensen Reno - Tier 1.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.
