Code of Alabama, 1975, as Amended.]

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes, mosquitoes and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2022-
B, Page 220, that the abundance of overgrown grass and weeds at said address in the City
constituted a public nuisance and set a Public Hearing to discuss said nuisance; and
WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended,
was provided in the Montgomery Advertiser, by certified mail, and by signage on the subject
property; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
said property and determined that the public nuisance still exists; and
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on December
6, 2022, permitting the owners of said property to present evidence, objections, and protest
regarding the proposed removal of weeds.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the abundance of overgrown grass and weeds on the property continues to be
a public nuisance:

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds
on the property listed above cut or removed using city forces or private contractors. Any
property owner shall have the right to have any weeds removed at his or her own expense
provided the removal is done prior to the commencement of work by employees or agents of
the City. The Mayor shall keep an accounting of all costs related to the removal of overgrown
grass and weeds and report such cost to the City Council following their removal.

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are
hereby amended to reclassify the property described in Attachment "A" from FAR (Forest,
Agriculture, Recreation), R-2 (Single Family Residential) and B-2 (General Business) to R-3
(Single Family Residential); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council at its Public Hearing on December 6, 2022, at 6:00 p.m.,
considered said proposed ordinance and that at such time and place all persons who desired
had an opportunity to be heard in favor of or in opposition to such ordinance.
ALL other items and provisions of the zoning ordinance not herein specifically amended
shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on October 20, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

BE IT ORDAINED by the City Council of the City of Prattville that the City of Prattville
Code of Ordinances, Chapter 54, Article I, Section 54-3 is hereby amended to read as
follows:
Sec. 54-3. - Obstructions —Generally.
It shall be unlawful for any person to place goods, wares, merchandise, fruits, vegetables,
boxes, barrels, containers: dispensers, recreational vehicles, truck tractors, utility trailers,
travel trailers, trailers, semi trailers, self-propelled campers, flat bed tow trucks or any other
obstruction of any kind in or upon any right-of-way, street, avenue, alley or sidewalk within
the City. It shall likewise be unlawful for any person in charge of or occupying any property
to permit goods, wares, merchandise, boxes, barrels, containers, dispensers, recreational
vehicles, truck tractors, utility trailers, travel trailers, trailers, semi trailers, self-propelled
campers, flat bed tow trucks or other obstructions to remain on the right-of-way, street, alley,
avenue or sidewalk adjoining the property or in such person's charge or control, whether the
same was placed thereon by such person or not.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

BE IT ORDAINED by the City Council of the City of Prattville that the City of Prattville
Code of Ordinances, Chapter 54, Article I., Sections 80-81 are hereby established to read as
follows:
Sec. 54-80. - Definitions
Recreational Vehicle -As defined in the Zoning Ordinance.
Utility Trailer -Defined as an unpowered vehicle towed by a powered vehicle, whether or
not open or enclosed.
Truck Tractor- Defined as every motor vehicle designed and used primarily for drawing
other vehicles and not so constructed as to carry a load other than a part of the weight of the
vehicle and load so drawn.
Travel Trailer- Defined as a vehicle without motive power, designed and constructed as
a camping vehicle or a temporary dwelling, living or sleeping place for recreational and/or
vocational use which is drawn by any motor vehicle.
Semi Trailer- Defined as every vehicle without motive power designed for carrying
persons or property and for being drawn by a motor vehicle and so constructed that some part
of its weight and some part of its load rest upon or are carried by another motor vehicle.
Trailer- Defined as every vehicle without motive power designed to carry persons or
property wholly on its own structure and to be drawn by another motor vehicle.
Self -Propelled Camper or House Cars- Defined as a self-propelled motor vehicle
designed and used primarily for mobile living quarters. The living quarters on self-propelled
campers or house cars are constructed as an integral part of the motor vehicle and are not
detachable. Self-propelled campers or house cars are commonly known as motor homes or
recreational vehicles.
Sec. 54-81. - Parking of Recreational Vehicles, Boats, Trailers, etc. on Public Streets or
Rights -Of -Way Restricted, Exceptions, Penalties.
(A) Prohibition. It shall be unlawful within the corporate limits of the City of Prattville to park a
recreational vehicle, boat/boat trailer, utility trailer, truck tractor, travel trailer, semi trailer, trailer,
self-propelled camper or other type of similar wheeled conveyance on any public street or right-
of-way.
(B) Exceptions.
(1) Limited Use: For the purposes of this section, parking as restricted by Section (a) above
shall not be prohibited where the recreational vehicle, boat/boat trailer, utility trailer or other
type of similar wheeled conveyance is being parked on a public street for the limited purpose
of active loading or unloading. This exception shall only apply while the owner or operator of
the recreational vehicle, boat, utility trailer or other type of similar wheeled conveyance is
actively engaged in said task.
(2) Emergency Vehicles: The prohibitions of this ordinance shall not apply to authorized
emergency vehicles parked while emergency personnel are engaged in answering a call or
rendering assistance. Authorized emergency vehicles shall include police and fire vehicles, as
well as ambulances.
(3) Mobile Food Vendors: The prohibitions of this ordinance shall not apply to mobile food
vendors who are duly licensed with the City of Prattville and are in compliance with Sections
38-335 through 38-342 of the City of Prattville Code of Ordinances.

5 (C) Penalties, Hearing, Enforcement.
6 (1) Any person or property owner found to have parked, have allowed others to be parked
7 or having a parked vehicle in violation of this ordinance shall be subject to a fine of Fifty Dollars
8 ($50.00). Each calendar day in which a violation hereunder continues or re -occurs shall
9 constitute a separate violation.

11 (2) The Chief of Police of the City of Prattville, or his duly appointed designee, shall be
12 charged with the enforcement of this ordinance. For each violation, a citation shall be given to
13 the person in violation and/or posted on the recreational vehicle, boat/boat trailer, utility trailer
14 or other type of similar wheeled conveyance found to be parked in violation of this ordinance.
15 The property owner or registered owner of said recreational vehicle, boat/boat trailer, utility
16 trailer or other type of similar wheeled conveyance shall have thirty (30) calendar days within
17 which to enter a guilty plea and pay the said fine.

19 (a) Failure to pay Fine. If the fine is not paid within the, prescribed thirty (30) calendar
20 days, a summons shall issue from the municipal court commanding the presence of the
21 property owner or registered owner of the offending recreational vehicle, boat/boat trailer, utility
22 trailer or other type of similar wheeled conveyance in municipal court to defend the prosecution
23 of the said violation.

25 (b) Failure to Appear. If the property owner or registered owner does not appear at the
26 time and place prescribed in the summons, and fails to enter a guilty plea and pay the fine
27 before the prescribed time, the Municipal Court may issue a warrant for the arrest of the
28 property owner or registered owner, who may be fined up to Fifty Dollars ($50.00) and held for
29 up to five (5) days in jail.

31 (c) Hearing. A hearing shall be held by the Municipal Court at the time and place
32 prescribed in the summons. Upon a determination by the Municipal Court that a violation has
33 occurred, the Court shall order the property owner or person found to have been in violation of
34 this section to pay the fine set out in paragraph (C)(1) above. The Municipal Court shall have
35 the additional authority to impose any court costs which may be allowable by Alabama law
36 upon a conviction after hearing or upon receiving a guilty plea after the issuance of the
37 summons.

39 (d) Failure to Pay Court Ordered Fine and Costs. If, after the hearing, the Municipal
40 Court orders the payment of the fine and/or costs as set out above, and the person so ordered
41 to pay fails to pay the said amounts, the Municipal Court may enforce said order in accordance
42 with Rule 26.11 of the Alabama Rules of Criminal Procedure as well as any other law, whether
43 state, federal or local which may empower the court to enforce said order.

45 (3) Enforcement. The Chief of Police for the City of Prattville, or his duly authorized Officers,
46 shall have the authority to enter upon private property for the purpose of ticketing an offending
47 recreational vehicle, boat, utility trailer or other type of similar wheeled conveyance found
48 parked in violation of this ordinance.

ORDINANCE
[To Authorize the Operation of Medical Cannabis Dispensing Sites Within the Corporate
Limits of the City of Prattville.]

WHEREAS, during the 2021 Regular Session of the Alabama Legislature, Act 2021-450
was enacted and codified in Title 20, 2A, Code of Alabama, 1975, as amended, to create within
Alabama a wholly interstate system of the cultivation, processing and distribution of medical
cannabis; and
WHEREAS, Act 2021-450 defines a "dispensary" as an entity licensed by the Alabama
Medical Cannabis Commission to dispense and sell medical cannabis at the dispensing sites
to registered, qualified patients and registered caregivers; and
WHEREAS, Act 2021-450 defines an "integrated facility" as an entity licensed to perform
the functions of a cultivator, processor, secure transporter and dispensary; and
WHEREAS, Act 2021-450 defines a "dispensing site" as a site operated by a dispensary
licensee or an integrated facility licensee; and
WHEREAS, Act 2021-450 requires the governing body of any municipality by ordinance
to authorize the operation of the dispensing sites within the corporate limits of the municipality;
and
WHEREAS, a dispensary would be required to purchase a business license and pay
sales tax to the City of Prattville, thus increasing revenue; and
WHEREAS, the City wishes to authorize the operation of medical cannabis dispensing
sites within the Corporate Limits of the City to assure its citizens can benefit from the medical
and economic benefits of medical cannabis.
BE IT ORDAINED by the City Council of the City of Prattville that, pursuant to §20-2A-
51, Code of Alabama, 1975, as amended, a holder of a license granted by the State of Alabama
pursuant to Act 21-450 is hereby authorized to operate a medical cannabis dispensing site
within the Corporate Limits of the City of Prattville, subject to the provisions of Act 21-450 and
any relevant provisions of the Code of Ordinances of the City of Prattville.
THIS ordinance shall become effective upon its passage and execution as provided by
law. Each of the provisions of this ordinance are severable; and if any provision shall be
declared to be invalid, the remaining provisions shall not be affected but shall remain in full
force. All ordinances, or parts of ordinances, in any manner conflicting herewith are hereby

WHEREAS, in Resolution Book 2021-A, Page 220, on December 7, 2021, the City
Council of the City of Prattville authorized the Mayor to enter into a one-year lease agreement
with Fountain City BMX, Inc. to operate a BMX Park on City property located on County Road
4; and
WHEREAS, said lease agreement will expire on December 31, 2022; and
WHEREAS, Fountain City BMX, Inc., a non-profit organization, has expressed a desire
to continue to operate said BMX Park and possesses the degree of expertise necessary to
operate the course.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes the Mayor to enter into a Lease Agreement with Fountain City BMX, Inc. for
the continuing use of said City property to operate a BMX Park for a one-year period from
January 1, 2023, through December 31, 2023.

WHEREAS, the City of Prattville has identified a need for the Public Safety Building to
be re -roofed; and
WHEREAS, the Facilities Maintenance Division of the Public Works Department had
specifications drafted for the re -roofing of the Public Safety Building; and
WHEREAS, one (1) sealed bid was received, opened and read on November 14, 2022,
at 10:00 a.m. in the Council Chambers at City Hall, and Old South Construction Company was
the lowest responsible bidder at a cost of $479,979.00 for said re -roofing project; and
WHEREAS, said re -roofing project is a budgeted expense for the Facilities Maintenance
Division of the Public Works Department.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby awards Bid No. 022-005-A to Old South Construction Company in an amount not to
exceed $479,979.00 for said re -roofing project, and said funds are approved and appropriated
from the FY2023 Budget Line Item Facilities Maintenance/ Capital Outlay.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.

WHEREAS, in Resolution Book 2022-A, Page 192, on September 20, 2022, the City of
Prattville accepted ownership of the Levee, through deed, from the Historic Prattville
Redevelopment Authority (HPRA); and
WHEREAS, it is in the best interest of the City to maintain land lying between the Levee
and Mill Pond adjacent to the Public Safety Building as described in Attachment A; and
WHEREAS, HPRA desires to deed said land to the City; and
WHEREAS, the City agrees to accept ownership of said land.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the City of Prattville does hereby accept the ownership and maintenance of the land lying
between the Levee and Mill Pond adjacent to the Public Safety Building.

WHEREAS, the City Council of the City of Prattville is authorized to direct the disposal
of any real property not needed for public or municipal services pursuant to the authority
granted by §11-47-20, Code of Alabama, 1975, as amended; and
WHEREAS, the City Council has identified an area adjacent to Gin Shop Hill Road,
formerly used for a Wastewater Pump Station (depicted in Attachment A), which is no longer
needed for public or municipal services; and
WHEREAS, the City desires to quitclaim deed said property to the Historic Prattville
Redevelopment Authority (HPRA).
BE IT ORDAINED by the City Council of the City of Prattville, that it is hereby established
said property depicted in Attachment A, is no longer needed for public or municipal purposes.
BE IT FURTHER ORDAINED by the City Council, that the property shall be conveyed
to HPRA, by quitclaim deed, and the Mayor is hereby authorized to execute any and all
documents necessary to accomplish the purpose of this Ordinance.

WHEREAS, in Resolution Book 2022-A, Page 098, on June 7, 2022, the City Council
15 authorized that an application be submitted to the Alabama Department of Transportation

17 (ALDOT) for the FY2023 Transportation Alternatives Program (TAP) for sidewalk

19 improvements along Old Ridge Road and Old Farm Lane; and

21 WHEREAS, the State and the City desire to enter into a Preliminary Engineering and
22
23 Construction Agreement for a Transportation Alternatives Program Project for said sidewalk
24
25 improvements in Project No. TAPAA-TA23(923), CPMS Ref # 100076080 and 100075863 at
26
27 a cost not to exceed $919,171.00 (net cost to City not to exceed $183,834.20); and

29 WHEREAS, this is a budgeted expense in the Capital Projects Fund.

THAT the Code of Ordinances Chapter 2. - Administration, Article 1. - In General,
Sections 2-2. - Use of City Seal and Logos, 2.3. - Flags and 2.4. - Slogans are hereby
established:

(a) City Seal.
23 The City seal above, which has been created is property of the City and hereby officially
24 adopted by the City Council of the City of Prattville. An official copy of the City seal is on file

35 The City logos above, or any variations thereof, which have been in use by the City since
36 their creation are City property and hereby officially adopted. Official copies of the City logos
37 are on file with the City Clerk.
38 (c) City Artwork/Designs
39 There are various and numerous items of City artwork and City designs which are utilized
4o by the City regularly. These artwork/designs were either created internally for use by the City
41 or events or operations, or were purchased by the City for its exclusive use. A list of City
42 artwork/designs is kept on file with the City Clerk's Office.

44 (d) Use of City seal, City logos, and City Artwork/Designs
45 1. The City Clerk has charge of the City seal and will affix the City seal to all certificates
46 and documents as may be required by law, by the code, or by ordinance of the City.
47 2. The Mayor or his designee has charge of City logos and City artwork/designs.
48 3. All other uses of the City seal, City logos, and City artwork/designs are restricted to
49 official City business and such other appropriate uses that further the operations of
50 the City as may be authorized in writing by the Mayor, or as otherwise permitted in
51 this code or City policy.
52 4. Except where authorized by federal law, no person shall make or use the City seal,
53 City logos, and City artwork/designs, or any cut, facsimile, digital or' physical
54 reproduction thereof, or to make or use any seal, logo, or any design which is an
55 imitation of, in the design of, or which may be mistaken for the City seal, City logos,
56 or City artwork/designs, without the written authorization from the Mayor or the
57 Mayor's designee.
58 5. City officials, City employees, City appointees, members of the City Council, and
59 members of City Boards and commissions may use stationery, printed materials,
60 clothing, and other articles with the City logos, or facsimile of the City logos, and City

artwork/designs while acting within the scope of their office or employment or City
elected or appointed position.
6. No person, including any elected office of the City, may use the City seal, City logos,
or City artwork/designs, or in any correspondence or other printed materials
distributed in favor of or against any ballot measure or in favor of or against any
candidate for public office.
7. City "swag", i.e. apparel, accessories, car tags, utilizing the City Seal, City logos,
and/or City artwork/designs, may not be sold by any individual or entity other than
the City.
8. The City seal, City logos, or City artwork/designs may be at times requested to be
used by outside entities or agencies for events co -hosted or supported by the City.
Requests must be submitted to the Mayor or the Mayor's designee, who has the sole
discretion to approve or deny such requests, and to promulgate the manner, timing
and format of such requests. When considering such request, the Mayor or Mayor's
designee will consider the ultimate benefit to the City of such use, the effects of
association by the City with the event or occurrence, the City's traditional
sponsorship activities, and other criteria which shall be fairly and neutrally applied to
all requestors. The Mayor is authorized to adopt policies to further provide for the
permitted use of the City seal, City logos or City artwork/designs.
(e) Penalties/Enforcement
It shall be unlawful for any person to make or use the City seal, City logos, or City
artwork/designs of the City of Prattville deceptively, fraudulently, or without express written
permission from the City of Prattville. A person engaging in the unauthorized use of the City
seal, City logos, or City artwork/designs is guilty of a misdemeanor. Such unauthorized use
is additionally declared a public nuisance and the City can abate or enjoin such use
pursuant to this Code.
Sec. 2-3. - City Flag (RESERVED)
Sec. 2-4. - Slogans (RESERVED)
THIS ordinance shall become effective upon its passage and execution as provided by
law.

through the U.S. Patent and Trademark Office.]

WHEREAS, the City Council of the City of Prattville may establish or create, from time
to time, City logotype or insignia; and
WHEREAS, the City claims all rights and title, including copyrights or trademark, to
such City logotype and insignia, and claims every right to control the use of any such City
logotype and insignia; and
WHEREAS, 15 U.S.C. § 1052 (b) allows trademarks of municipalities' logotype and
insignia; and
WHEREAS, the City wishes to register City logotype and insignia for trademark to the
fullest extent allowable by law.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby authorizes the Mayor to file for patent trademarks of the City logotype and insignia
through the U.S. Patent and Trademark Office.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
