WHEREAS, keeping garbage and rubbish is a public nuisance that is injurious to the
public health, safety and general welfare of the community pursuant to Section 46-4, City of
Prattville Code of Ordinances; and
WHEREAS, §6-5-122 et seq., Code of Alabama, 1975, as amended, permits the City
Council of the City of Prattville to declare a public nuisance and abate the same; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and has determined the existence of garbage and rubbish at 104 Magnolia Court,
Prattville, AL 36067; and
WHEREAS, the Autauga County tax records list the property owner as Petrin Robert &
Deborah, with an address of 104 Magnolia Court, Prattville, AL 36067 C/O 536 Sheila
Boulevard, to parcel number 19 02 09 1 008 010.000; and
WHEREAS, in compliance with Section 46-31 of the City of Prattville Code of
Ordinances, the Code Enforcement Officer sent notice to the owner of the above property in
writing on November 8, 2022, to correct, remedy or remove the condition of garbage and
rubbish within 10 days; and
WHEREAS, the owner of 104 Magnolia Court, has failed and/or refused to correct,
remedy or remove the condition of garbage and rubbish after the expiration of said notice; and
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the
City to do such work or make such improvements that are necessary to correct, remedy or
remove such condition, pay therefore and charge the expenses incurred to the owner of such
lot.
NOW, THEREFORE, BE IT RESOLVED that:
1. the City Council of the City of Prattville declares the garbage and rubbish at the above -listed
address to be a public nuisance which is due to be abated; and
2. the owners of said property are ordered to appear before the City Council at a Public
Hearing at 6:00 p.m. on March 7, 2023, in Prattville City Hall; and
3. the notice of a Public Hearing on the matter, as required by the applicable laws, will be
provided in a publication of general circulation in compliance with the law, by certified mail,
and by signage on the subject property.

WHEREAS, a vacancy currently exists on the Historic Preservation Commission due to
the resignation of Teresa D. Nettles on January 13, 2023; and
WHEREAS, it is the desire of the City Council of the City of Prattville to fill said vacancy
to ensure the continuity of the Historic Preservation Commission's operation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that

WHEREAS, pursuant to Resolution Book 2022-B, Page 252, a Special Election filling
the vacancy in Council District 4 was called to be held on February 28, 2023, and a run-off
election (if necessary) on March 28, 2023; and
WHEREAS, §11-46-27,Code of Alabama, 1975, as amended, provides in part that the
municipal governing body, not less than 15 days before holding of a Municipal Election, appoint

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows:
THAT the zoning ordinance of the City of Prattville and the zoning map are hereby
amended to reclassify the property described in Attachment "A" from B-2 (General Business)
and Downtown Overlay District to R-3 (Single Family Residential); and
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the City Limits of the City of
Prattville, and that the City Council at its Public Hearing at 6:00 p.m. on February 7, 2023,
considered said proposed ordinance and that at such time and place all persons who desired
had an opportunity to be heard in favor of or in opposition to such ordinance.
ALL other items and provisions of the zoning ordinance not herein specifically amended
shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on December 15, 2022.
THIS ordinance shall become effective upon its passage and execution as provided by
law.

WHEREAS, Alabama Bass Trail desires to conduct and promote an Alabama Bass Trail
Tournament Series Divisional with a tournament date of June 10, 2023; and
WHEREAS, the City of Prattville shall serve as a host for said event; and
WHEREAS, the host fee for said event shall be $7,500.00; and
WHEREAS, this is a budgeted expense for the Parks and Recreation Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into an agreement with Alabama Bass Trail to host said
tournament at a cost not to exceed $7,500.00, and funds are hereby approved and
appropriated from FY2023 Budget Line Item Parks and Recreation/ Operating Supplies.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intention of this resolution.

WHEREAS, the City of Prattville Fire Department has identified a need to purchase one
(1) 2022 Wheeled Coach Type I Ford F450 ambulance; and
WHEREAS, said ambulance is available through the H-GAC Purchasing Cooperative,
Contract AM10-20, from Southern Emergency Consultants LLC at a cost not to exceed
$256,965.00; and
WHEREAS, the Finance Director has identified a certain sum of surplus funds available
for departments that came in under budget in prior fiscal years; and
WHEREAS, a portion of the FY2022 Fiscal Departmental Reserves are available for
use on said ambulance, and
WHEREAS, a portion of the cost of said ambulance is budgeted for the Fire Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the FY2023 Budget is hereby amended as follows:
Decrease General Fund/ Fiscal Departmental Reserves $97,371.00
Increase Fire Department/ Capital Outlay $97,371.00
BE IT FURTHER RESOLVED that funds in an amount not to exceed $256,965.00 for
the purchase of said ambulance are hereby authorized and approved to be paid to Southern
Emergency Consultants LLC, and said funds are approved and appropriated from FY2023
Budget Line Item Fire Department/ Capital Outlay.

WHEREAS, pursuant to Resolution Book 2021, Page 012, the City of Prattville
appointed Andrew Lee Odom d/b/a Odom Litigation Team, LLC as City Attorney for the 2020-
2024 Quadrennium; and
WHEREAS, there is a need to amend the Resolution to change the legal operating name
under which Mr. Odom will perform the prescribed duties.
NOW, THEREFORE, BE IT RESOLVED, effective February 19, 2023, Andrew Lee
Odom is hereby appointed to perform all usual and ordinary services as attorney for the City
of Prattville as previously prescribed.
BE IT FURTHER RESOLVED that the CityAttomey shall receive compensation through
monthly payroll not to exceed the original $23,000.00 per year amount, in addition to
reimbursement of any normal and customary reimbursable legal services and expenses at an
hourly rate of $175.00 and that said appointment shall continue through the 2020-2024
Quadrennium, or until a successor is duly qualified and appointed.

WHEREAS, the City of Prattville has a need for an Economic Development
Director, and a hiring process was conducted by the City of Prattville Human
Resources Department; and
WHEREAS, the Human Resources Department recommends Bryant T. Whaley be
appointed as Economic Development Director of the City of Prattville; and
WHEREAS, this is a budgeted position in the Executive Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Prattville, that Bryant T. Whaley is hereby appointed as Economic Development Director
of the City of Prattville effective February 20, 2023, and said appointment shall be for the
remainder of the 2020-2024 Quadrennium or until a successor is duly qualified and
appointed at Pay Grade 26-G.
BE IT FURTHER RESOLVED, that the salary for said position is approved in

WHEREAS, the City of Prattville owns undeveloped property in the South Industrial
Park; and
WHEREAS, said property is not currently needed for public or municipal purposes; and
WHEREAS, James Hardie Building Products, Inc. has a state-of-the-art fiber cement
siding manufacturing facility located in the South Industrial Park; and
WHEREAS, James Hardie Building Products, Inc. is expanding operations at said
facility and desires to construct a temporary parking area adjacent to their facility for
contractors, consultants, advisors and representatives; and
WHEREAS, §11-47-21, Code of Alabama, 1975, as amended, authorizes the City to
lease unneeded real property; and
WHEREAS, the City and James Hardie Building Products, Inc. desire to enter into a
parking lease agreement until February 29, 2024; and
WHEREAS, the amount for said lease agreement shall be $1.00 per month; and
WHEREAS, said lease agreement provides for the option to renew the lease at the
end of the term for an additional six (6) months.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into a parking lease agreement between the City and
James Hardie Building Products, Inc. for the utilization of undeveloped property adjacent to
their facility in the South Industrial Park until February 29, 2024.
BE IT FURTHER ORDAINED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this ordinance.

WHEREAS, the City of Prattville owns property located at 124 West Main Street; and
WHEREAS, said property is not currently needed for public or municipal purposes; and
WHEREAS, the Federal Emergency Management Agency (FEMA) has an interest in
and a need to utilize said property of the City in response to the storm damage of January 12,
2023; and
WHEREAS, §11-47-21, Code of Alabama, 1975, as amended, authorizes the City to
lease unneeded real property; and
WHEREAS, the City and FEMA desire to enter into a lease agreement for a period of
ninety (90) days; and
WHEREAS, the term for said lease agreement shall commence on January 23, 2023,
and end on April 23, 2023; and
WHEREAS, the amount for said lease agreement shall be $110,000.00 per month; and
WHEREAS, said lease agreement provides for the option to renew the lease at the end
of the term for three (3) additional months on a month -to -month basis.
NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of Prattville
does hereby ratify and affirm said lease agreement between the City and FEMA for the property
located at 124 West Main Street, Prattville, Alabama, 36067.
BE IT FURTHER ORDAINED that the Mayor is hereby authorized to execute any and

one (1) boom truck to better serve the needs of its customers; and
WHEREAS, the Sanitation Department had specifications drafted for said truck; and
WHEREAS, one (1) sealed bid was received, opened and read on February 1, 2023, at
2:30 p.m. in the Human Resources Department Conference Room at City Hall, and Ingram
Equipment Company was the lowest responsible bidder at a cost of $112,850.00 for said truck;
and
WHEREAS, in Resolution Book 2023, Page _, the City Council of the City of Prattville
authorized the surplus of one (1) 2014 International 4400 42 Truck with Ramer Knuckleboom
Loader (06-206 / VIN: 5987) to trade in to Ingram Equipment Company toward the purchase of
said truck; and
WHEREAS, the credit for said surplus truck is $43,000.00; and
WHEREAS, the net cost to the City for the purchase of said truck is $69,850.00.
