After the Pledge of Allegiance, 8 Mr. Parker gave the invocation. 9 10 ROLL CALL: 11 Members present were Chairman Charles Knapp, Vice-Chairman Billy Barrett, Mr. Jerry Crosby, and Mr. 12 Greg Duke. Ms. Sarah Johnson was absent. Also present was supernumerary member Mr. Neal Parker. 13 14 Quorum Present 15 16 Staff present were Mr. Scott Stephens, City Planner; Mr. Tommie Williams, Planner; and Ms. Alisa 17 Morgan, Secretary. 18 19 CHARACTER TRAIT OF THE MONTH: 20 The Character Trait of the Month is Positivity… Maintaining a good attitude, even when faced with 21 difficulty. 22 23 Chairman Knapp stated the governing rules for the Prattville Board of Zoning Adjustment and the procedure 24 of the meeting. 25 26 COMMITTEE REPORTS: 27 Chairman Knapp provided a summary of the cases heard in the previous year and wished for a successful 28 year going forward. 29 30 OLD BUSINESS: 31 There was no old business to discuss. 32 33 NEW BUSINESS: 34 SPECIAL EXCEPTION: 35 To operate a home business. 36 373 Wetumpka Street 37 Bob Burton, Petitioner 38 39 Mr. Williams introduced the special exception request to operate a home business for a law office on 40 property located at 373 Wetumpka Street. 41 42 Bob Burton, petitioner, presented the request to allow operation of his law business on property located at 43 373 Wetumpka Street. He stated that the small business would have a minimum of three clients. There 44 would be no signs on the property advertising the business. He stated that there is currently enough 45 parking to accommodate his clients. He provided signatures from adjacent property owners who support 46 the request (attached and made a part of the minutes). 47 48 Chairman Knapp opened the floor for public comments. With no public comments, the public hearing 49 was closed. 50 51 Chairman Knapp opened the discussion for the Board. Chairman Knapp opened the discussion for the 52 Board. After their discussion, the vote was called. Mr. Barrett moved to establish the findings of fact 53 stating that 1) the proposed home occupation is an allowable special exception, and is not a prohibited use 54 DR A F T Draft Prattville Board of Zoning Adjustment January 10, 2023 Minutes Page 2 of 3 in a R-2 district; 2) development of the proposed use is in the public interest and meets the spirit of the 55 City of Prattville Zoning Ordinance; and 3) the proposed use will not cause substantial adverse impact to 56 adjacent or nearby properties or uses. Mr. Crosby seconded the motion. The motion to approve the 57 findings of fact passed unanimously. 58 59 After no further discussion, the vote was called. Mr. Barrett moved to approve the request as proposed 60 based on the approved findings of fact. Mr. Duke seconded the motion. The motion to approve passed 61 unanimously. 62 63 VARIANCE: 64 Signs-to vary from the requirements. 65 110 Bridge Street, 71 Maple Street, 81 Maple Street, 91 Maple Street (The Mill Apartments) 66 Chambless King Architects, Petitioner 67 68 Mr. Williams introduced the variance request for signs on property located at 110 Bridge Street, 71 Maple 69 Street, 81 Maple Street, and 91 Maple Street. He stated that the petitioner is requesting three (3) 70 variances for sign placement. The first variance request is proposed for building 110 to allow two signs 71 on the building which will exceed the number of signs allowed (one sign) per building and the second 72 variance to place an attached awning sign larger than (80 ft2). He stated that the third variance request is 73 to allow the attached sign placed on the awning at 98 ft2 in exchange for an allowable freestanding sign. 74 75 Nick Henninger of Chambless King Architects, petitioner’s representative, presented the variance request 76 to allow signs on property located at 110 Bridge Street, 71 Maple Street, 81 Maple Street, and 91 Maple 77 Street. He stated that they are requesting two signs on (Building D) 110 Maple Street because of its 78 layout. He stated that the proposed 98 ft2 awning sign would be the main signage and is closer in size to a 79 freestanding sign. He requested to have a larger sign on the building and if granted, they would be 80 willing to forgo the right to have a freestanding sign. 81 82 Chairman Knapp opened the floor for public comments. With no public comments, the public hearing 83 was closed. 84 85 Chairman Knapp opened the discussion for the Board. After their discussion, the vote was called. Mr. 86 Parker moved to establish the findings of fact stating that 1) that special conditions and circumstances 87 exist which are peculiar to the land, structure, or building involved and which are not applicable to other 88 lands structures, or buildings in the same zoning district; 2) that the special conditions and circumstances 89 do not result from actions of the applicant (self-imposed hardship); 3) that granting of a variance is in 90 harmony with the intent and purposes of the zoning ordinance; 4) that a variance will not adversely affect 91 the surrounding property, the general neighborhood, or the community as a whole; and 5) that a variance 92 will not allow the establishment of a use prohibited under the terms of the zoning ordinance in an R-4 93 district. Mr. Barrett seconded the motion. The motion to approve the findings of fact passed 94 unanimously. 95 96 After no further discussion, the vote was called. Mr. Parker moved to approve the request as proposed 97 based on the approved findings of fact contingent that the proposed 98 ft2 awning sign replaces a 98 freestanding sign. Mr. Crosby seconded the motion. The motion to approve passed unanimously. 99 100 MINUTES: 101 Mr. Barrett moved to approve the minutes of the November 8, 2022, regular meeting. Mr. Crosby seconded 102 the motion. Special Exception to allow metal siding on street-facing and side facades of structure ZONING ORDINANCE REFERENCED: Article 5 Nonresidential Districts, §5.01 General Regulations, §5.01.03 Additional Regulations: Appearance Standards. The following standards apply except the M-1 and M-2 Districts: a. The use of metal siding on any street-facing and side facades is subject to approval by the Board of Adjustment in accordance with §12.03 Special Exceptions. Section 12.03 Special Exceptions The Board shall review the application for compliance with this ordinance and all other applicable codes and ordinances of the city. The Board must make written findings determining that the proposed use-on-appeal will not: 1. Be contrary to the public interest and will ensure that the spirit of this ordinance is observed; 2. Permit the establishment of a use prohibited in the zoning district; or 3. Cause a substantial adverse impact on property or improvements in the vicinity or in the district in which the proposed use is located. DR A F T Page 2 of 3 ANALYSIS: Petitioner is proposing an approximately 5,350 square foot building on currently undeveloped land on the east side of N Memorial Drive (Hwy 31), approximately 600ft north of Fairview Ave. The Zoning Ordinance states, “The use of metal siding on any street-facing and side facades is subject to approval by the Board of Adjustment.” The petitioner requests a Special Exception to install a stone base/wainscoting and leave the exterior walls above the wainscoting as corrugated metal (see included example pictures with application).
