[To Surplus Personal Property from the Executive Department.]

WHEREAS, the City of Prattville Executive Department has an item of personal property
which is no longer needed for public or municipal purposes; and
WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal
governing body to dispose of unneeded personal property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the following personal property owned by the City is no longer needed for public or municipal
purposes, and said property shall be removed from the inventory of the Executive Department:
• Decorative Organizer Unit (display shelving with storage drawers)
BE IT FURTHER RESOLVED that the City Council instructs the Mayor to sell said
property through GovDeals.com and that proceeds for said property be deposited into the
General Fund. If said property is determined to be of no value, the Mayor has the authority to
scrap or dispose of said property for and on behalf of the City.

WHEREAS, the City of Prattville Information Technology Department has various items
of personal property which are no longer needed for public or municipal purposes; and
WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal
governing body to dispose of unneeded personal property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the various items of personal property shown in Attachment "A" are no longer needed for public
or municipal purposes, and said property shall be removed from the inventory of the Information
Technology Department.
BE IT FURTHER RESOLVED that the City Council instructs the Mayor to sell said
property through GovDeals.com and that proceeds for said property be deposited into the

WHEREAS, City Council meetings are scheduled for the first and third Tuesdays of each
month; and
WHEREAS, Independence Day occurs on Tuesday, July 4, 2023; and
WHEREAS, this is a National, State and City holiday.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby moves the Public Hearing and first City Council meeting in July to Tuesday, July 11,
2023, at 6:00 p.m.

RESOLUTION
[To Appoint Carol W. Pearson to the Industrial Development Board.]

WHEREAS, a vacancy currently exists on the Industrial Development Board due to the
resignation of Tom Miller effective October 31, 2022; and
WHEREAS, it is the desire of the City Council of the City of Prattville to fill said vacancy
to ensure the continuity of the Industrial Development Board's operation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
Carol W. Pearson is hereby appointed to fill said vacancy effective immediately, and said term
shall expire on February 17, 2025, or until a successor is duly qualified and appointed.

RESOLUTION

WHEREAS, an abundance of overgrown grass or weeds:
1. is injurious to the public health, safety and general welfare by providing a breeding
ground and shelter for rats, mice, snakes and mosquitoes and other vermin;
2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to
such property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, §11-67-1 et seq., Code of Alabama, 1975, as amended, permits the City
Council of the City of Prattville to declare an abundance of overgrown grass and weeds to be
a public nuisance; and
WHEREAS, keeping garbage and rubbish is a public nuisance that is injurious to the
public health, safety and general welfare of the community pursuant to Section 46-4, City of
Prattville Code of Ordinances; and
WHEREAS, stagnant water is a public nuisance that is injurious to the public health,
safety and general welfare of the community pursuant to Section 46-6, City of Prattville Code
of Ordinances; and
WHEREAS, §6-5-122 et seq., Code of Alabama, 1975, as amended, permits the City
Council to declare a public nuisance and abate the same; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and determined the existence of an abundance of overgrown grass and weeds,
keeping garbage and rubbish and stagnant water at 1926 Tara Drive; and
WHEREAS, the Autauga County tax records list the property owner as Chandler Terry
C. address of 1926 Tara Drive, Prattville, AL 36066 to parcel number 19 0613 1 000 001.019;
C/O Cyprexx Services, 525 Grand Regency Blvd., Brandon, FL 33510; and
WHEREAS, in compliance with Section 46-31 of the City of Prattville Code of
Ordinances, the Code Enforcement Officer sent notice to the owner/operator of the above
property in writing on February 28, 2023, to correct, remedy or remove the condition of the
abundance of overgrown grass and weeds, keeping garbage and rubbish and stagnant water
within 10 days; and
WHEREAS, the owner/operator of said property has failed and/or refused to correct,

remedy or remove the said conditions after the expiration of said notice; and
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the
City to do such work or make such improvements that are necessary to correct, remedy or
remove such condition, pay therefore and charge the expenses incurred to the owner/operator
of such lot to the fullest extent authorized by law.
NOW, THEREFORE, BE IT RESOLVED that:
1. the City Council of the City of Prattville declares the abundance of overgrown grass and
weeds, keeping garbage and rubbish and stagnant water at the above -listed address to be
a public nuisance which is due to be abated; and
2. the owner/operator of said property is ordered to abate said nuisances and appear before
the City Council at a Public Hearing at 6:00 p.m. on May 2, 2023, in Prattville City Hall; and
3. the notice of a Public Hearing on the matter, as required by the applicable laws, will be
provided in a publication of general circulation in compliance with the law, by certified mail,
and by signage on the subject property.

WHEREAS, on January 1, 1997, the City of Prattville adopted Ordinance Book 97, Page
002, for the purpose of setting public hearings to allow public comment for licenses, including
Lounge Retail Liquor— Class II (Package) Licenses; and
WHEREAS, GAJANAN26 LLC d/b/a Bama Spirits located at 1601 South Memorial
Drive, Prattville, AL 36067, has made application for said license.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby sets a Public Hearing at 6:00 p.m. on May 2, 2023, in the Council Chambers at City
Hall for said license application.

WHEREAS, it has been recommended to the City Council that the 2023 Business
License issued to Cloud 9 Hookah Lounge, located at 1732 East Main Street, Prattville, AL
36066, be revoked; and
WHEREAS, proper notification by certified mail has been made to the business
owner and operator of the impending action by letter from Mayor Bill Gillespie, Jr.; and
WHEREAS, a Public Hearing was held on April 4, 2023, at 6:00 p.m. to show cause why
said license should not be revoked; and
WHEREAS, Mr. Clarence Thomas, registered owner, responded by email on Tuesday,
March 28, 2023, advising of his intention to not contest the revocation of said license.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Finance Director is hereby authorized to revoke the 2023 Business License No. 20210501
issued to Cloud 9 Hookah Lounge, located at 1732 East Main Street, Prattville, AL 36066; and
that continuation of the business in the City of Prattville shall constitute a violation of the City
of Prattville Code of Ordinances and shall be punishable accordingly.
BE IT FURTHER RESOLVED that notification of this action will be mailed to the owner
by certified mail at the last known address of record.

Lee Odom as City Attorney for the 2020-2024 Quadrennium.]

WHEREAS, pursuant to Resolution Book 2021, Page 012, the City of Prattville
appointed Andrew Lee Odom d/b/a Odom Litigation Team, LLC as City Attorney for the 2020-
2024 Quadrennium; and
WHEREAS, there is a need to amend the Resolution to change the legal operating name
under which Mr. Odom will perform the prescribed duties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
effective April 5, 2023, Andrew Lee Odom is hereby appointed to perform all usual and ordinary
services as attorney for the City of Prattville as previously prescribed.
BE IT FURTHER RESOLVED that the City Attorney shall receive compensation through
monthly payroll not to exceed the original $23,000.00 per year amount, in addition to
reimbursement of any normal and customary reimbursable legal services and expenses at an
hourly rate of $175.00 and that said appointment shall continue through the 2020-2024
Quadrennium, or until a successor is duly qualified and appointed.
BE IT FURTHER RESOLVED by the City Council of the City of Prattville, that the
FY2023 Budget is hereby amended as follows:
Decrease City Clerk/ Legal Services $23,000.00
Increase City Clerk/ Salaries and Wages $23,000.00
Decrease City Clerk/ Professional Services $ 1,830.72
Increase City Clerk/ FICA $ 1,759.50
Increase City Clerk/ Workman's Comp $ 71.22
BE IT FURTHER RESOLVED that funds in an amount not to exceed $24,830.72 are
hereby authorized and approved from the various FY2023 Budget line items noted above.

WHEREAS, said business has applied for a Retail Beer (Off Premises Only) and Retail
Table Wine (Off Premises Only) license.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
hereby approves the issuance of a Retail Beer (Off Premises Only) and Retail Table Wine (Off
Premises Only) license at the business located at 203 Interstate Commercial Park Loop,
Prattville, Alabama 36066, to Shri Ganesh 25 Inc d/b/a Kwik Shops 130.
