Preliminary Plat: Jimmy Morris Plat 2 24 Location: NW intersection of Isom Street and Martin Luther King Jr. Blvd. 25 Petitioner: Larry E. Speaks & Associates, Inc. 26 27 This item was held at the previous meeting. Mr. Stephens provided background comments on the 28 preliminary plat of Jimmy Morris Plat 2. He stated that there is currently a motion on the floor to approve 29 this plat with the requested waivers with the conditions to provide a 10’ private utility easement along Lot 30 1 and Lot 2 to provide access to and through Lot 2 and make updates as needed to comply with staff 31 comments. 32 33 Mayor Gillespie asked what provisions would be taken to ensure that Lot 2 would not be flooded by Lot 34 1. Greg Gillian of Larry E. Speaks & Associates, Inc., along with the petitioner, Jimmy Morris addressed 35 the question and Mr. Gillian stated that they would put in a small swale at the north end of Lot 1 to 36 combat the drainage to Lot 2. Mayor Gillespie stated that he is willing to work with provision by making 37 that conditional for approval because Isom Street is a nonstandard city street. However, further 38 development in the area would require Isom Street to be built to city standards. 39 40 Mayor Gillespie moved to amend the motion to provide stormwater protection drain at the north of Lot 1 41 per City Engineer’s approval. Mr. Mullins seconded the motion. The motion to amend passed 42 unanimously. 43 44 The vote was called. The motion to approve as amended passed unanimously. 45 46 2. Preliminary Plats: Highland Farms Plat 1 47 Location: East of Highland Ridge Subdivision 48 Petitioner: Flowers & White Engineering, LLC 49 50 Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 1. He stated 51 that the plat proposes to subdivide 35.14 acres into 90 single family residential lots. Jack Buckner, 318 Old Farm Lane S, inquired 58 about the divider on Old Farm Lane S where the access road will extend. Mayor Gillespie addressed the 59 comment stating that they are currently working to open it up for easy mobility. 60 61 Jon Lee Finnegan, 211 Deer Trace, inquired about Lot A. Mr. Stephens explained that a small portion of 62 Lot A will be provided for the existing approximately 33’ strip of land to be extended to a standard 50’ 63 right-of-way. 64 65 Craig Simpler, Highland Ridge Subdivision HOA President, 622 Castlebrook Drive, asked if there will be 66 anything placed to divide the two subdivisions in Phase 4. Ms. Kelly stated that landscape buffers are 67 generally provided, but not fencing. 68 69 After no further comments, the public hearing was closed. Mrs. Carpenter introduced a resolution 70 recommending approval of the preliminary plat of Highland Farms Plat 1 and moved for its approval. 71 Mr. Mullins seconded the motion. The motion to approve passed unanimously. 72 73 3. Preliminary Plats: Highland Farms Plat 2 74 Location: East of Highland Ridge Subdivision 75 Petitioner: Flowers & White Engineering, LLC 76 77 Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 2. He stated 78 that the plat proposes to subdivide 29 acres into 74 single family residential lots. Sixteen lots are located 79 in Autauga County the remainder are located in Elmore County. 80 81 Chairman Gardner opened the floor for public comments. There were none. The public hearing was 82 closed. Mr. Daniel introduced a resolution recommending approval of the preliminary plat of Highland 83 Farms Plat 2 and moved for its approval. Mr. King seconded the motion. The motion to approve passed 84 unanimously. 85 86 4. Preliminary Plats: Highland Farms Plat 3 87 Location: East of Highland Ridge Subdivision 88 Petitioner: Flowers & White Engineering, LLC 89 90 Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 3. He stated 91 that the plat proposes to subdivide 21.29 acres into 76 single family residential lots. All lots are located in 92 in Elmore County. 93 94 Chairman Gardner opened the floor for public comments. There were none. The public hearing was 95 closed. Mr. Allen introduced a resolution recommending approval of the preliminary plat of Highland 96 Farms Plat 3 and moved for its approval. Mr. Daniel seconded the motion. Preliminary Plats: Highland Farms Plat 4 100 Location: East of Highland Ridge Subdivision 101 Petitioner: Flowers & White Engineering, LLC 102 103 Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 4. He stated 104 that the plat proposes to subdivide 30.99 acres into 74 single family residential lots. Nine to eleven lots 105 are located in Autauga County the remainder are located in Elmore County. 106 107 Chairman Gardner opened the floor for public comments. Preliminary Plat: Devers Subdivision 116 Location: South Memorial Drive 117 Petitioner: The Broadway Group, LLC 118 119 The preliminary plat of Devers Subdivision was postponed at the previous meeting (January 19th) at the 120 petitioner’s request. Mr. Stephens introduced the preliminary plat of Devers Subdivision. He stated that 121 the proposed two lot subdivision plans for cross access from Lot 1-B to Lot 1-A. AL Department of 122 Transportation (ALDOT) will have to approve access to the subdivision since the property is located on S 123 Memorial Drive (Hwy. 31). He stated that the petitioner is requesting a waiver from street and right-of-124 way improvements and eliminate the curb and sidewalk requirement. 125 126 DeAnna Hyche of The Broadway Group, LLC, petitioner’s representative, presented the preliminary plat 127 of Devers Subdivision. She stated that they have no master plan for the entire property since they are 128 purchasing only Lot 1-B. 129 130 Chairman Gardner opened the floor for public comments. Jon Lee Finnegan, 211 Deer Trace, inquired 131 about the name of the business and the aesthetics of the possibility of a Dollar General Store. Mr. 132 Stephens explained that the meeting is to determine if they meet the Subdivision Regulations. If the 133 approval is granted, the next step would be site plan review and if the zoning requirements are met, there 134 would not be another public meeting for this development. After no further comments, the public hearing 135 was closed. 136 137 Mr. Mullins introduced a resolution recommending approval of the waivers for the preliminary plat of 138 Devers Subdivision and moved for its approval. Mr. Daniel seconded the motion. 139 140 In their discussion, Mayor Gillespie was favorable to have sidewalks for walkability. Mr. Mullins was 141 not favorable to sidewalks along the major highway as it would be too much of a liability. Ms. Hyche 142 stated that plans have been submitted to ALDOT, curb and gutter will be required, but they are not 143 favorable to sidewalks at the location. She stated that they are only requesting to eliminate the sidewalks 144 requirement. 145 146 The vote was called. The motion to approve the waiver failed by 4/3 vote as recorded. Favor: Mr. 147 Mullins, Mr. Allen, Mrs. Carpenter, and Mr. Daniel. Oppose: Mayor Gillespie, Mr. King, and Chairman 148 Gardner. 149 150 Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Devers 151 Subdivision and moved for its approval. Mr. Allen seconded the motion. 152 153 Mayor Gillespie stated that the plat is incomplete. Mr. Stephens confirmed that the previously submitted 154 plat failed to comply with Section 5.2 (18). The petitioner requested to submit a revised plat at the 155 meeting; Mr. Stephens noted that staff had not reviewed it. 156 157 Ms. Hyche requested to postpone to allow time to resubmit plat that will include topography and further 158 feedback from ALDOT on sidewalk requirements. 159 160 Mayor Gillespie moved to hold until the April 20th meeting at the petitioner’s request. Scott Stephens, City Planner DATE: April 14, 2023 RE: Devers Preliminary Plat At your March 2, 2023, meeting, the Devers Preliminary Plat that was submitted was lacking all of the elements as required by the Prattville Subdivision Regulations. During the meeting, a motion was made by Mr Mullins to approve the waiver request of not completing additional street and infrastructure improvements in the right-of-way (e.g. sidewalks and curb & gutter), and it was seconded by Mr Daniel. The motion for the waiver failed with a 4-3 vote (Yes-Mullins, Allen, Carpenter, Daniel; No-Gillespie, King, Gardner). Note that plats need six affirmative votes to pass, and since this is an element of the plat, it also needs six affirmative votes to pass. A motion to approve the plat without waivers was made by Mrs Carpenter and seconded by Mr Allen. During discussion, Mayor Gillespie stated that the plat failed to meet minimum requirements, namely the topographic contours being shown on the plat (§5.2). The petitioner, Ms Hyche, had an updated plat she wished to be reviewed, but it had not been submitted in time and had not been reviewed by staff. Ms Hyche then requested to postpone the consideration of the plat to the April meeting. Mayor Gillespie moved to postpone, Mr Mullins seconded, and the motion to postpone was approved unanimously. The plat as submitted for your consideration at the April 20, 2022, meeting complies with the minimum standards for a preliminary plat. Scott Stephens, City Planner DATE: April 14, 2023 RE: Riverfell PUD Master Plan As you may recall from the Preliminary Plan, the proposed Riverfell PUD is a large project with various land uses, street types, street connections, and other elements. I am requesting to postpone the hearing and consideration of the Riverfell Master Plan to a later date to allow staff to have more time to examine the application and confer with the applicant. I have spoke with the applicant and he is understanding of the request. Staff and the applicant have a meeting scheduled the week of April 17th to discuss questions and receive more clarification. My request for the postponement is to allow staff to have more time so that staff will be able to better answer questions and provide feedback to members of the Planning Commission or City Council. The applicant will be requesting the Planning Commission to hold a special called meeting between the April 20th and May 18th meetings for the Riverfell PUD Master Plan. Lots 1, 2, & 3 will share an access easement that will be located on Lot 1. The proposed plat is located off Highway 82 and public water and sewer are available. The future land use map has this area designated as a Low-Density Residential area. Subdividing the parcels will be consistent with FLUM. EVALUATION/COMMENTS: Proposed Use: The applicant is requesting to rezone a 1.68 +/- acre parcel located directly south of Centerpoint Church, from split zoning of B-2 (General Business) and R-3 (Single Family Residential) to B-2 (General Business). Street Connectivity: Parcel has frontage on McQueen Smith Road Water/Sewer: Public water and sewer are available to this site. E. COMPREHENSIVE PLAN: The subject site has a Future Land Use Map (FLUM) designation of Low-Density Residential. On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in Medium-Density Residential FLUM zones and surrounded by Medium Density Residential to the North and East and West, Commercial to the South. The proposed Zoning Map Amendment to B-2 General Business meets the general fabric of the area. PLANNING STAFF EVALUATION This property has a split zoning designation, with over 80 % being B-2 (General-Business) and the remaining back portion of the parcel (~20%) is zoned R-2 Single Family Residential. The FLUM zone for this parcel is Medium- Density Residential. The McQueen Smith corridor on the corner of Hwy 82 is mostly B-2 (General-Business), the proposed zoning of this parcel will maintain that general fabric of the area. The proposed zoning map amendment will eliminate the current split commercial/residential zoning of this parcel and will create a uniform parcel zoned B- 2 General Business.
