CITY OF PRATTVILLE PLANNING COMMISSION MINUTES Special Meeting March 3, 2023 Call to order: Chairman Reuben Gardner called the special meeting to order at 3:02 p.m. Roll Call: Ms. Morgan called the roll. Members present were Mayor Bill Gillespie, Chairman Reuben Gardner, Vice-Chairman Ken Daniel, Deputy Fire Marshal Craig Allen, Mrs. Paula Carpenter, Mr. Robert King, and Mr. Mugs Mullins. Councilman John Chambers and Mr. Seth Hayden were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner, Mr. Tommie Williams, Planner, and Ms. Alisa Morgan, Secretary. Minutes: The minutes of the January 19, 2023 regular meeting were approved.
Committee Reports: Old Business: 1. Preliminary Plat: Jimmy Morris Plat 2 Location: NW intersection of Isom Street and Martin Luther King Jr. Blvd. Petitioner: Larry E. Speaks & Associates, Inc. This item was held at the previous meeting. Mr. Stephens provided background comments on the preliminary plat of Jimmy Morris Plat 2. He stated that there is currently a motion on the floor to approve this plat with the requested waivers with the conditions to provide a 10’ private utility easement along Lot 1 and Lot 2 to provide access to and through Lot 2 and make updates as needed to comply with staff comments. Mayor Gillespie asked what provisions would be taken to ensure that Lot 2 would not be flooded by Lot 1. Greg Gillian of Larry E. Speaks & Associates, Inc., along with the petitioner, Jimmy Morris addressed the question and Mr. Gillian stated that they would put in a small swale at the north end of Lot 1 to
combat the drainage to Lot 2. Mayor Gillespie stated that he is willing to work with provision by making that conditional for approval because Isom Street is a nonstandard city street. However, further development in the area would require Isom Street to be built to city standards.
Mayor Gillespie moved to amend the motion to provide stormwater protection drain at the north of Lot 1 per City Engineer’s approval. Mr. Mullins seconded the motion. The motion to amend passed
unanimously. The vote was called. The motion to approve as amended passed unanimously. 2. Preliminary Plats: Highland Farms Plat 1 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 1. He stated that the plat proposes to subdivide 35.14 acres into 90 single family residential lots. Traffic calming techniques have been implemented as required by approval of the Master Plan.

Chairman Gardner opened the floor for public comments. Jack Buckner, 318 Old Farm Lane S, inquired
about the divider on Old Farm Lane S where the access road will extend. Mayor Gillespie addressed the comment stating that they are currently working to open it up for easy mobility.
Jon Lee Finnegan, 211 Deer Trace, inquired about Lot A. Mr. Stephens explained that a small portion of Lot A will be provided for the existing approximately 33’ strip of land to be extended to a standard 50’ right-of-way. Craig Simpler, Highland Ridge Subdivision HOA President, 622 Castlebrook Drive, asked if there will be anything placed to divide the two subdivisions in Phase 4. Ms. Kelly stated that landscape buffers are generally provided, but not fencing. After no further comments, the public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Highland Farms Plat 1 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously.
3. Preliminary Plats: Highland Farms Plat 2 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 2. He stated
that the plat proposes to subdivide 29 acres into 74 single family residential lots. Sixteen lots are located in Autauga County the remainder are located in Elmore County. Chairman Gardner opened the floor for public comments. There were none. The public hearing was closed. Mr. Daniel introduced a resolution recommending approval of the preliminary plat of Highland Farms Plat 2 and moved for its approval. Mr. King seconded the motion. The motion to approve passed unanimously. 4. Preliminary Plats: Highland Farms Plat 3 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 3. He stated that the plat proposes to subdivide 21.29 acres into 76 single family residential lots. All lots are located in
in Elmore County. Chairman Gardner opened the floor for public comments. There were none. The public hearing was
closed. Mr. Allen introduced a resolution recommending approval of the preliminary plat of Highland Farms Plat 3 and moved for its approval. Mr. Daniel seconded the motion. The motion to approve passed unanimously. 5. Preliminary Plats: Highland Farms Plat 4 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC
Tommie Williams provided the staff report for the preliminary plat of Highland Farms Plat 4. He stated that the plat proposes to subdivide 30.99 acres into 74 single family residential lots. Nine to eleven lots are located in Autauga County the remainder are located in Elmore County.
Chairman Gardner opened the floor for public comments. Craig Simpler, Highland Ridge Subdivision HOA President, 622 Castlebrook Drive, stated that Highland Ridge will be making a formal request from
the City to provide speed humps/bumps on Chancellor Ridge Road.

Mr. King introduced a resolution recommending approval of the preliminary plat of Highland Farms Plat 4 and moved for its approval. Mr. Daniel seconded the motion. The motion to approve passed
unanimously. 6. Preliminary Plat: Devers Subdivision Location: South Memorial Drive Petitioner: The Broadway Group, LLC The preliminary plat of Devers Subdivision was postponed at the previous meeting (January 19th) at the petitioner’s request. Mr. Stephens introduced the preliminary plat of Devers Subdivision. He stated that the proposed two lot subdivision plans for cross access from Lot 1-B to Lot 1-A. AL Department of Transportation (ALDOT) will have to approve access to the subdivision since the property is located on S Memorial Drive (Hwy. 31). He stated that the petitioner is requesting a waiver from street and right-of-way improvements and eliminate the curb and sidewalk requirement. DeAnna Hyche of The Broadway Group, LLC, petitioner’s representative, presented the preliminary plat of Devers Subdivision. She stated that they have no master plan for the entire property since they are purchasing only Lot 1-B.
Chairman Gardner opened the floor for public comments. Jon Lee Finnegan, 211 Deer Trace, inquired about the name of the business and the aesthetics of the possibility of a Dollar General Store. Mr. Stephens explained that the meeting is to determine if they meet the Subdivision Regulations. If the
approval is granted, the next step would be site plan review and if the zoning requirements are met, there would not be another public meeting for this development. After no further comments, the public hearing was closed. Mr. Mullins introduced a resolution recommending approval of the waivers for the preliminary plat of Devers Subdivision and moved for its approval. Mr. Daniel seconded the motion. In their discussion, Mayor Gillespie was favorable to have sidewalks for walkability. Mr. Mullins was not favorable to sidewalks along the major highway as it would be too much of a liability. Ms. Hyche stated that plans have been submitted to ALDOT, curb and gutter will be required, but they are not favorable to sidewalks at the location. She stated that they are only requesting to eliminate the sidewalks requirement. The vote was called. The motion to approve the waiver failed by 4/3 vote as recorded. Favor: Mr.
Mullins, Mr. Allen, Mrs. Carpenter, and Mr. Daniel. Oppose: Mayor Gillespie, Mr. King, and Chairman Gardner.
Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Devers Subdivision and moved for its approval. Mr. Allen seconded the motion. Mayor Gillespie stated that the plat is incomplete. Mr. Stephens confirmed that the previously submitted plat failed to comply with Section 5.2 (18). The petitioner requested to submit a revised plat at the meeting; Mr. Stephens noted that staff had not reviewed it. Ms. Hyche requested to postpone to allow time to resubmit plat that will include topography and further
feedback from ALDOT on sidewalk requirements. Mayor Gillespie moved to hold until the April 20th meeting at the petitioner’s request. Mr. Mullins seconded the motion. The motion to hold passed unanimously. New Business: There was no new business to discuss. Miscellaneous:

D. EVALUATION/COMMENTS:
Street Connectivity: Proposed Lot 1 will have frontage on both MLK and Isom. Proposed Lot 2 will have frontage
on Isom St.
Water/Sewer: Public water are located on Martin Luther King Jr Drive.
R-4 (Multi-Family Residential) District Standards:
Lot requirements for uses in R-4 zoning include the following:
Staff Comments:
The proposed subdivision will subdivide a single 0.84ac lot into two lots. The current parcel is zoned R-4 (Multi-
Family Residential) which allows for single-family use.
Proposed Lot 1 has a single-family house currently under construction and has access to water and sanitary sewer.
The Subdivision Regulations (§ 4.3) requires subdivisions that adjoin existing streets to dedicate additional right-of-
way to meet minimum ROW requirements. The subdivider has provided for this additional ROW on the proposed
plat.
The Regulations also require (§ 4.3) when a subdivision is proposed on one side of an existing street, that half of the
right-of-way must be improved (“half-street improvements”), including the width of the pavement, curb and gutter,
and sidewalks. The existing Isom Street pavement is approximately 13ft wide without curb, gutter, or sidewalks.
The existing Martin Luther King Jr Drive has adequate ROW width and is fully improved. The subdivider is
requesting a waiver from these requirements. See pictures in this report of existing conditions.
The Regulations require (§ 4.11) that subdivisions be designed to accommodate public sanitary sewer when available
and that “installation of all lines shall be the responsibility of the developer.” The subdivider is requesting a waiver
from this requirement and is proposing to install a 6” private sewer lateral to the public line on MLK.

On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel is
primarily Low Density & Medium Density Residential and surrounded by Medium Density Residential to the north,
south, east, and west.
PLANNING STAFF EVALUATION:
The applicant is submitting a preliminary plat that proposes to subdivide 35.14 acres of property zoned R-3
(Single-Family Residential) located east of Highland Ridge Subdivision into 90 residential lots. The typical lot
shown on the plan will comply with the underlying zoning. All of the parcels will be located in Elmore County.
Street B connects to Street A, which has been increased to 50 feet, to Old Farm Lane. The preliminary plat also
proposes a HOA maintained amenity area. The discussion during the Master Plan process was that the amenity
must be completed before any final plat approval of the next phase of Highland Farms. Street B does have
traffic calming techniques implemented. There are two islands located on street B to mitigate traffic speeds.
The plat is in compliance with the previously approved Master Plan.

On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel is primarily Low Density & Medium Density Residential and surrounded by Medium Density Residential to the north, south, east, and west.
PLANNING STAFF EVALUATION: The applicant is submitting a preliminary plat that proposes to subdivide 29 acres of property zoned R-3 (Single-
Family Residential) located east of Highland Ridge Subdivision into 74 residential lots. The typical lot shown
on the plan will comply with the underlying zoning. The majority of the parcels will be located in Elmore
County while about 16 parcels will be in Autauga County. Street C connects to Street A, which has been
increased to 50 feet, to Old Farm Lane. Street C will connect to The Exchange North. The Exchange North goes
to a signalized intersection on Cobbs Ford Rd. The county line lies within this preliminary plat and the applicant
has ensured that enough land is established on either side to conform to the lot requirements listed in the
Subdivision Regulations. The plat is in compliance with the previously approved Master Plan.

to Old Farm Lane. Street B will also connect to Wee Lovett Drive which connects to Chancellor Ridge Road in
Highland Ridge Subdivision. Traffic calming devices have been proposed to help mitigate the speed and traffic
going into the existing Highland Ridge Subdivision. The plat is in compliance with the previously approved
Master Plan.
