10 WHEREAS, keeping garbage and rubbish:

12 1. is injurious to the public health, safety and general welfare of the community by providing a
13 breeding ground and shelter for rats, mice, snakes and other vermin;
14 2. may inflict injury on a person going to such property;
15 3. may also pose a fire and environmental hazard; and
16
17 WHEREAS, an abundance of overgrown grass and weeds:
18
19 1. is injurious to the public health, safety and general welfare of the community by providing a
20 breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin;
21 2. may cause the further spread of weeds;
22 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such

WHEREAS, the owner of said property has failed and/or refused to correct, remedy or
remove said conditions after the expiration of said notice; and
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City
Council to declare stagnant water and the abundance of overgrown grass and weeds to be a
public nuisance and abate the same; authorizing the City to do such work or make such
improvements that are necessary to correct, remedy or remove such conditions, pay therefore
and charge the expenses incurred to the owner of such property to the fullest extent authorized
by law.
NOW, THEREFORE, BE IT RESOLVED that:

WHEREAS, the City of Prattville operates the Pine Creek and Autauga Creek
Wastewater Treatment Facilities; and
WHEREAS, the City has implemented a MWPP Program as directed by law; and
WHEREAS, the Public Works Department staff has prepared the 2022 MWPP annual
reports for said wastewater treatment facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
does hereby acknowledge that the City Council has reviewed and submits the 2022 MWPP
annual reports for the City to ADEM.
BE IT FURTHER RESOLVED that the City, through its staff in the Wastewater Division
of the Public Works Department, shall continue to maintain the diligent monitoring of effluent
from the wastewater system and shall continue to treat wastewater effluent in the same manner
as they have in the past, in accordance with all Federal and State regulations.
BE IT FURTHER RESOLVED that the City will continue training programs as
recommended by the Public Works Director and as required by all applicable Federal or State
Government regulatory agencies.

WHEREAS, the City of Prattville Parks and Recreation Department has identified a need
to purchase one (1) 2023 Ford F250 Super Crew 4x4 Pickup Truck; and
WHEREAS, said vehicle is available through State of Alabama Contract No. T191 from
Stivers Ford Lincoln, Inc. at a cost not to exceed $43,158.00; and
WHEREAS, this is a budgeted expense for the Parks and Recreation Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
funds in an amount not to exceed $43,158.00 for the purchase of said vehicle are hereby
authorized and approved to be paid to Stivers Ford Lincoln, Inc., and said funds are approved
and appropriated from FY2023 Budget Line Item Parks and Recreation Department/ Capital
Outlay.

WHEREAS, the City of Prattville is interested in applying under ALDOT's FY2024
Transportation Alternative Set -Aside Program for Comprehensive ADA Compliance for
Downtown Pedestrian Paths and Sidewalks; and
WHEREAS, Krebs Engineering, Inc. has the staff and expertise to prepare said
application for the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
an application be submitted to ALDOT and the City Council commits to all matching funds.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this resolution.

WHEREAS, in Ordinance Book 2022, Page 035, on September 6, 2022, the City Council
of the City of Prattville rezoned property located inside the Corporate Limits at the Eastern/
Southeastern side of Highway 82 East, East of McQueen Smith Road and West of Constitution
Avenue to PUD; and
WHEREAS, the petitioner, Halieus LLC, submitted a master plan to the City of Prattville
Planning Commission; and
WHEREAS, the petitioner desires to have the Ordinance amended to allow four-story
multi -family structures, with no ground floor restrictions, as part of this PUD; and
WHEREAS, a Public Hearing on the proposed amendment was held by the Planning
Commission on May 1, 2023; and
WHEREAS, the Planning Commission did approve the master plan, conditioned on the
City Council allowing four-story multi -family structures, with no ground floor restrictions, as part
of this PUD; and

said property that was run on Sunday, August 7, 2022, with a synopsis on Sunday, August 14,
2022, in the Montgomery Advertiser, can be viewed in the City Clerk's Office.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
a Public Hearing is set for June 20, 2023, at 6:00 p.m. in the Council Chambers at City
Hall.

Pursuant to the requirements of Title 11-52-77, Code of Alabama, 1975, as amended. Notice
is hereby given by the City Council of the City of Prattville, Alabama, that at the regular meeting
of said City Council on May 16, 2023, at Prattville City Hall, 101 West Main Street, Prattville,
Alabama, the following proposed ordinance was introduced.

ORDINANCE
BE IT ORDAINED that Ordinance Book 2022, Page 035 is hereby amended to allow
four-story multi -family structures, with no ground floor restrictions, as part of this proposed
PUD.
THAT this proposed ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the
City of Prattville, and that the City Council of the City of Prattville, at its Public Hearing on June
20, 2023, at 6:00 p.m., considered said proposed amended ordinance and that at such time
and place all persons who desired had an opportunity to be heard in favor of or in opposition
to such ordinance.
ALL other items and provisions of the zoning ordinance of the City of Prattville not herein
specifically amended shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on May 1, 2023.
THIS ordinance shall become effective upon its passage and execution as provided by
law.
