Upon the conclusion of the hearing, the Council, by resolution, shall decide whether a
public nuisance continues to exist and, if so, shall further order it to be removed with
respect to any property or part of such property described. The Council by passage of such
resolution shall be deemed to have acquired jurisdiction to proceed and either to perform
or have performed the work of abatement or removal with respect to such property or part
of such property. The decision of the Council on the matter shall be deemed final and

of Prattville Code Enforcement may authorize private contractors, companies,

so designated are hereby authorized to enter upon private property for purposes of abating
or removing the nuisance. Any property owner shall have the right to have such weeds
removed at their own expense providing that the removal is done prior to the
commencement of work by the employees or agents of the City with the following
provisions:
1. The declaring of the violation as a Public Nuisance and the Order of Abatement along
with setting the Public Hearing initiates:
• a fine for violation pursuant to Sec. 46-124.
• designation as a repeat offender pursuant to Sec. 46-121.
2. Any subsequent violations for this property occurring within three (3) years from the date
of abatement are subject to the repeat offender provisions.
For purposes of this article, compliance with the competitive bid law is not required.
Sec. 46-115. - Administrative procedures.
(a) Report of Costs. The City shall keep an account of the costs of abating and/or removing
the nuisance in front of or on each separate lot or parcel of land and shall render an
itemized report, in writing, to the City Council showing the cost of abating and/or removing
the nuisance, to include fine(s) for violation(s), legal advertisement cost, administrative
costs, legal fees, etc. Before the report is submitted to the Council, a copy of the report
shall be posted for at least five (5) days prior thereto on or near the chamber door of the
Council, together with a notice of the time when the report shall be submitted to the Council
for confirmation.
(b) At the time fixed for receiving and considering the report, the Council shall hear the report,
together with any objections which may be raised by any of the property owners liable to
be assessed for the work of abating the nuisance and, thereupon, make such modifications
in the report as deemed necessary after which by resolution the report shall be confirmed.
The amounts of the cost for abating such nuisance in front of or upon the various parcels
of land mentioned in the report shall hereinafter be referred to as "weed liens" and shall
constitute a weed lien on the property for the amount of the weed liens, respectively. After
confirmation of the reports, a copy shall be given to the County Revenue Commissioner
who, under the "Optional Method of Taxation," is charged with the collection of the City's
municipal taxes pursuant to Article 1, Division 2, Chapter 51, of Title 11, Code of Alabama,
1975, as amended. It shall be the duty of the County Revenue Commissioner to add the
amounts of the respective weed liens to the next regular bills for taxes levied against the
respective lots and parcels of land. Thereafter, such amounts shall be collected at the same
time and in the same manner as ordinary municipal ad valorem taxes are collected and
shall be subject to the same penalties and the same procedure under foreclosure and sale
in case of delinquency.
Secs. 46-116--46-120. - Reserved.
DIVISION 2. - WEED CONTROL REPEAT OFFENDERS
Sec. 46-121. - Notification and enforcement.
(a) Pursuant to Code of Alabama, 1975, § 11-67-68, as amended, when a public nuisance
exists that was previously abated or on which abatement has been attempted through the
process of posting notice on the property in accordance with the provisions of this chapter,
the owner of the property on which the nuisance is located shall remove all weeds, wild
bushes, grass or other unintentional vegetative growth located upon the streets, sidewalks
or upon private property in the City which bears seeds of a wingy or downy nature, or
which attain a growth height of twelve (12) inches or taller, orwhich becomes a fire menace
when dry, or which provide habitat to rats, snakes or other disease vectors, or which are
I otherwise noxious or dangerous. The code enforcement officer may declare the condition
2 to be a reoccurring public nuisance, for the purposes of abatement, and the code
3 enforcement officer's declaration shall be final.
4 (b) When the code enforcement officer does so declare the reoccurring condition to be a
5 nuisance, the City may take such actions as are necessary to abate the nuisance without
6 first adhering to the procedures set out in Code of Alabama, 1975, § 11-67-60 et seq., as
7 amended, including without a resolution by the City Council declaring the condition to be
8 a public nuisance, without posting notice, without the Council hearing objections, and
9 without an order from the Council authorizing the City to abate said nuisance. A property
10 that has previously had an overgrown grass/weed violation abated by the Council, whether
11 or not the City has taken action to remove or remedy the nuisance on the property,
12 constitutes the initiation of repeat offender status. Repeat offender status is applicable
13 from the date of the initial abatement until either the expiration of three (3) years or the
14 date the property comes under new ownership, if applicable. All necessary employees of
15 the City and its contractors and designees are expressly authorized to enter upon such
16 properties as are necessary to abate the nuisance.
17 (c) Before the City may abate the nuisance, the code enforcement officer shall send the
18 owners of the property written notice by regular United States mail no less than ten (10)
19 calendar days before the City acts to abate the nuisance. The notice shall:
20 1. inform the owners the code enforcement officer has declared the property presents a
21 nuisance; and
22 2. inform the owners the City has previously abated such a nuisance, or it has attempted
23 to abate such a nuisance, on the property; and
24 3. inform the owners that the reasonable costs and penalties of the abatement, including
25 fine(s) of violation and administrative costs shall be assessed and collected as a special
26 assessment on taxes; and
27 4. inform the owners they may have any nuisance removed at their own expense prior
28 to the arrival of the employees, contractors, or designees assigned by the City to abate
29 the nuisance by the expiration of said notice; and
30 5. inform the owners that no further notices will be sent by the City for the remainder of the
31 three (3) years, other than a ten (10) day notice of violation.
32
33 Sec. 46-122. - Administrative procedures.
34 (a) When properties that have required repeated maintenance of noxious and overgrown
35 grass and weeds are abated by the City, as set forth in this article, the City shall render an
36 itemized report, in writing, to the City Council showing the cost of abating and/or removing
37 the nuisance, to include fine(s) for violation(s), administrative costs, legal fees, etc. Before
38 the report is submitted to the Council, a copy of the report shall be posted for at least five
39 (5) days prior thereto on or near the chamber door of the Council, together with a notice of
40 the time when the report shall be submitted to the Council for confirmation.
41 (b) At the time fixed for receiving and considering the report, the Council shall hear the report,
42 together with any objections which may be raised by any of the property owners liable to
43 be assessed for the work of abating the nuisance and, thereupon, make such modifications
44 in the report as deemed necessary after which by resolution the report shall be confirmed.
45 The amounts of the cost for abating such nuisance in front of or upon the various parcels
46 of land mentioned in the report shall hereinafter be referred to as "weed liens" and shall
47 constitute a weed lien on the property for the amount of the weed liens, respectively. After
48 confirmation of the reports, a copy shall be given to the County Revenue Commissioner
49 who, under the "Optional Method of Taxation," is charged with the collection of the city's
50 municipal taxes pursuant to Article 1, Division 2, Chapter 51, of Title 11, Code of Alabama,
51 1975, as amended. It shall be the duty of the County Revenue Commissioner to add the
52 amounts of the respective weed liens to the next regular bills for taxes levied against the
53 respective lots and parcels of land. Thereafter, such amounts shall be collected at the same
54 time and in the same manner as ordinary municipal ad valorem taxes are collected and
55 shall be subject to the same penalties and the same procedure under foreclosure and sale
56 in case of delinquency.
57
58 Sec. 46-123. - Effect of redemption or sale.
59 It shall be the responsibility of the owner to promptly advise the enforcing official(s) of any
60 change in ownership or interest in the property. It shall be unlawful to knowingly fail to notify
61 the enforcing official(s) of any change of ownership or interest in the property.
