WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2023,
Page 088 that keeping garbage and rubbish and the abundance of overgrown grass and weeds
at 205 Edgewood Avenue constituted public nuisances and set a Public Hearing on said
nuisances; and
WHEREAS, the Autauga County tax records list the property owner as Haster Michael
R, with an address of 205 Edgewood Avenue, Prattville, AL 36067, to Parcel Number 19 02 10
2 008 003.000; and
WHEREAS, notice was provided to correct, remedy or remove the garbage and rubbish
and overgrown grass and weeds; and
WHEREAS, the owner of 205 Edgewood Avenue has failed and/or refused to correct,
remedy or remove said nuisances by the expiration of said notice; and
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 20,
2023, permitting the owner of said property to present evidence, objections and protest
regarding said nuisances; and
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the
City to do such work or make such improvements that are necessary to correct, remedy or
remove such conditions, pay therefore and charge the expenses incurred to the owner of such
property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
declares that the garbage and rubbish and overgrown grass and weeds at said property
continue to be public nuisances.
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish and
overgrown grass and weeds at said property removed using City forces or private contractors.
The property owner shall have the right to remove said nuisances at their expense provided
that the removal is done prior to the commencement of work by employees or agents of the
City of Prattville. The Mayor shall keep an accounting of all costs related to this request and
report such costs to the City Council following its removal.

WHEREAS, the owner of 719 Cranbrook Drive has failed and/or refused to correct,
remedy or remove said nuisances by the expiration of said notice; and
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 20,
2023, permitting the owner of said property to present evidence, objections and protest
regarding said nuisances; and

WHEREAS, the owner of 302 Poplar Street has failed and/or refused to correct, remedy
or remove said nuisance by the expiration of said notice; and
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 20,
2023, permitting the owner of said property to present evidence, objections and protest
regarding said nuisance; and
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the

9 WHEREAS, an abundance of overgrown grass and weeds:
10
11 1 is injurious to the public health, safety and general welfare of the community by providing a
12 breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin;
13 2. may cause the further spread of weeds;
14 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such
15 property;
16 4. may also pose a fire hazard and respiratory hazard; and
17
18 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
19
20 the properties and determined the existence of the abundance of overgrown grass and weeds
21
22 at 130 Lee Circle and 212 Edgewood Avenue; and
23
24 WHEREAS, the Autauga County tax records list the property owners as follows:
25
26 • 130 Lee Circle — Jacks, William K, with an address of 130 Lee Circle, Prattville, AL
27 36067, to Parcel Number 19 05 212 009 012.000;
28 • 212 Edgewood Avenue — Strength Margaret B Marion Hill, with an address of 1493
29 County Road 39, Deatsville, AL 36022, to Parcel Number 19 02 10 2 002 006.000; and
30
31 WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the
32
33 Code Enforcement Officer gave written notice to the owners of said properties on June 2, 2023,
34
35 to correct, remedy or remove the abundance of overgrown grass and weeds within ten (10)
36
37 days; and
38
39 WHEREAS, the owners of said properties have failed and/or refused to correct, remedy
40
41 or remove said condition by the expiration of said notice; and
42
43 WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City
44
45 Council to declare the abundance of overgrown grass and weeds to be a public nuisance and
46
47 abate the same; and
48
49 NOW, THEREFORE, BE IT RESOLVED THAT:

51 1. the City Council of the City of Prattville declares the abundance of overgrown grass and
52 weeds at the above -listed properties to be a public nuisance that is due to be abated; and
53 2. the owners of said properties are ordered to abate said nuisance and appear before the
54 City Council at a Public Hearing at 6:00 p.m. on July 18, 2023, at Prattville City Hall; and
55 3. the notice of Public Hearing on the matter, as required by law, will be provided in a
56 publication of general circulation, by certified mail, and by signage on the subject property.

BE IT ORDAINED that Ordinance Book 2022, Page 035 is hereby amended to allow
four-story multi -family structures, with no ground floor restrictions, as part of this proposed

THAT this proposed Ordinance and a synopsis were advertised for two (2) weeks in the
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the
City of Prattville, and that the City Council of the City of Prattville, at its Public Hearing on June
20, 2023, at 6:00 p.m., considered said proposed amended Ordinance and that at such time
and place all persons who desired had an opportunity to be heard in favor of or in opposition
to such ordinance.
ALL other items and provisions of the zoning ordinance of the City of Prattville not herein
specifically amended shall remain in full force and effect.
THE amendments herein contained were considered and recommended by the City of
Prattville Planning Commission on May 1, 2023.
THIS Ordinance shall become effective upon its passage and execution as provided by
law.

WHEREAS, Mary Virginia Harris is a prominent citizen of the City of Prattville; and
WHEREAS, Ms. Hams graduated from North Highland School; and
WHEREAS, Ms. Harris was the first African American licensed nurse at the Prattville
General Hospital; and
WHEREAS, the City of Prattville desires to honor her legacy by naming the pavilion at
North Highland Park as the "Mary Virginia Harris Pavilion".
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the pavilion at North Highland Park is hereby named the "Mary Virginia Hams Pavilion".

to purchase one (1) 2023 Ford Expedition; and
WHEREAS, said vehicle is available through State of Alabama Contract No. T191 L from
Stivers Ford Lincoln, Inc. at a cost not to exceed $50,160.00; and
WHEREAS, this is a budgeted expense for the Parks and Recreation Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
funds in an amount not to exceed $50,160.00 for the purchase of said vehicle are hereby
authorized and approved to be paid to Stivers Ford Lincoln, Inc., and said funds are approved
and appropriated from FY2023 Budget Line Item Parks and Recreation/ Capital Outlay.

WHEREAS, the City of Prattville is interested in applying under the Montgomery MPO's
FY2024 TAP for Court Street streetscapes; and
WHEREAS, Krebs Engineering, Inc. has the staff and expertise to prepare said
application for the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
an application be submitted to the Montgomery MPO and the City Council commits to all
matching funds.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and

Cooperative, Contract No. 032119-JDC, from Warrior Tractor and Equipment Company, Inc.
at a cost not to exceed $225,896.32; and
WHEREAS, this is a budgeted expense for the Engineering Department.

WHEREAS, the City of Prattville Engineering Department has identified a need to
purchase one (1) 2024 Kenworth T380 flatbed dump truck; and
WHEREAS, said truck is available through the Sourcewell Purchasing Cooperative,
Contract No. 060920-KTC, from Kenworth of Montgomery, Inc., at a cost not to exceed
$159,509.00; and
WHEREAS, a portion of this expense is budgeted for the Engineering Department; and
WHEREAS, the Finance Director has identified a certain sum of surplus funds available
for departments that came in under budget in prior fiscal years.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the FY2023 Budget is hereby amended as follows:
Decrease Engineering/ Departmental Reserves $84,749.18
Increase Engineering/ Capital Outlay $84,749.18
BE IT FURTHER RESOLVED that funds in an amount not to exceed $159,509.00 for
the purchase of said truck are hereby authorized and approved to be paid to Kenworth of
Montgomery, Inc., and said funds are approved and appropriated from FY2023 Budget Line
Item Engineering/ Capital Outlay.

WHEREAS, Goodwyn Mills Cawood LLC has the expertise to provide said engineering
services at a cost not to exceed $140,700.00; and
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to
secure services with engineers possessing a high degree of professional skill to be let without
competitive bidding; and
WHEREAS, this is a budgeted expense in the Capital Projects Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into said agreement with Goodwyn Mills Cawood LLC
for said engineering services at a cost not to exceed $140,700.00, and funds are approved and
appropriated from FY2023 Budget Line Item Capital Projects Fund/ Cobbs Ford Road Turn
Lanes.

ORDINANCE
[To Surplus Real Property and Authorize the Mayor to Enter into a Real Estate Exchange
Agreement with The Water Works Board of the City of Prattville.]

WHEREAS, the City Council of the City of Prattville is authorized to direct the disposal
of any real property not needed for public or municipal purposes pursuant to the authority
granted by §11-47-20, Code of Alabama, 1975, as amended; and
WHEREAS, the City of Prattville owns Lot 9 of Plat 3 of South Industrial Park shown in
Exhibit "A", which is no longer needed for public or municipal purposes and awaiting surplus;
and
WHEREAS, The Water Works Board of the City of Prattville owns property located East
of Washington Street and adjacent to the Autauga-Prattville Public Library shown in Exhibit "B";
and is no longer utilized as a water facility; and
WHEREAS, the Water Works Board desires to acquire Lot 9 of Plat 3 of South Industrial
Park for the purpose of constructing additional water facilities; and
WHEREAS, the City desires to acquire the property located East of Washington Street
adjacent to the Autauga-Prattville Public Library that is surrounded by Pratt Park; and
WHEREAS, both parties are in agreement to exchange said properties by the execution
of warranty deeds.
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Prattville, that
it is hereby established Lot 9 of Plat 3 of South Industrial Park is no longer needed for public
or municipal purposes.
BE IT FURTHER ORDAINED the Mayor is authorized to enter into a Real Estate
Exchange Agreement with The Water Works Board of the City of Prattville for said properties.
BE IT FURTHER ORDAINED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this Ordinance.
